Space and Trails, introduced this item as a first reading and set
for public hearing of the Arbaney Kittle Trail Easement.
� Hamilton noted that in 1991, the open Space and Trails Program �
; purchased from the Arbaneys and Wyland Kittle eleven acres of open
� space land and a guaranteed right to develop a trail along an
" ; approximate southeastern boundary of their property. The trail was
P built in 1993 and since then, staff has been working on trying to
� get an as-built survey to finalize that agreement. This has been
received and they are now processing a minor subdivision amendment
i to that plat to reflect the trail and that should be completed by
i the time the ordinance comes back to the Board for second reading
and public hearing. �

submitted by Michael and Deirdre Morgan, for conceptual submission
approval to create an approximately 2.5 acre building envelope on

Krizmanich reiterated his comments from his memorandum that the i'! `�

, and known habit for elk production, but past approvals have not
been that restrictive, and that is where he had a hard time �y.�

A discussion ensued with respect to the proposed building envelope a

Ethridge pointed out that no where is there a definitive statement
from the Division of Wildlife about calving habitat. He does not
know how the Board can make a decision if it does not have a
wildlife expert telling them, by site inspection, where the
production habitat is located.

Krizmanich submitted a letter from the Division of Wildlife dated
February 5, 1995, which states that the log home currently lies
within a elk calving area as identified by himself and Randy Cote. �+
That the primary calving area on the lot lies from a small ridge
fjust west of the current home.
iRick Neiley, representing the applicant, referred to his letter, '•

which is included in the Board's packets in which he specifically
asked Kevin Wright whether or not any limitation, except for the
house size, in his view, would be said he spoke to Kevin Wright,
with the Division of Wildlife, and he did not have any
recommendations regarding house size or the type of houses. He ,
said the approval that was granted in 1992 a number of the other , � .
sites on the western portion of the ranch are within mapped habitat '
and the Division of Wildlife recommendation was to require a low
profile home in that area. A review of the County records �`
' establishes that the approval granted to the bulk of the lots in �
� the subdivision under imposes homesite constraints on Lots 17 ��}'

He said he does not think it is appropriate to impose square
footage limitations on improvements on the Morgan property. A copy ��:�. z •

Neiley noted that the code says that there is a prohibition against �

Wildlife has requested a two and one half acre building envelope i _
and that is the standard which has been applied throughout the l
ranch. Also, he thinks the Board has to recognize that there is j
a precedential value of the other approvais on the ranch. The
Board needs to review each application on a case by case basis, but t
they also have to consider what approvals were granted for
similarly situated building sites, and this case, the similar
I situated building sites have no FAR restrictions whatsoever.
After further discussion, it was agreed that this matter should be
tabled pending the representatives from the Division of Wildlife `
. being able to attend the meeting to clarify their position
� regarding the wildlife issue, (the building envelope being
imme@iate2y adjacent to an identified calving area) the size of the
envelope and house size.
� A discussion ensued with regard to whether or not the Board should
� take action on the applicant's request for an extension of time for �
� removal of the illegally constructed cabin.

It was agreed that this matter should be tabled also to be
considered at the next meeting simultaneously with the land use
application.
� Ethridqe moved to table this matter and continue the public hearinq

i standing position of support for the recreational values of Ruedi -
Reservoir and find recreation to be a very precious asset to the �
� Roaring Fork Valley. �
`� To that end, we are interested in preserving the water levels in ��y�/r
I Ruedi during the summer and fall seasons. These seasons see � '
isignificant use in Ruedi by water recreational activities and we
i would like to see that capacity preserved. Fluctuating levels
Iwithin Ruedi are a detriment to those activities. Therefore, we
are supportive of the acquisition of these waters, so long as the
i water level in Ruedi is preserved. z'
i We hope that you will take this into consideration as you proceed
�� with management plans for the sale of the water. We support a y �

� SACRGROUND; A cabin was previously constructed on this property '�.
without permits. Pitkin County initiated an enforcement action
which resulted in a land use application which was subsequently i1
denied due to impacts on Elk Production Areas. This application
proposes an a2ternative site to the one that was denied. Part '�A"
of the applicant's Introduction describes the history of this
' � parcel in detail. �f
This current application proposes to develop a new building :;...
envelope that is located closer to the existing ranch access road `�
and which is near an approved building site on the adjoining �`�
property. The new site is located in the least impactive area on
� the lot and can adequately mitigate 1041 hazard area impacts.
The outstanding issue at this time is the appropriate home size
limitation to mitigate wildlife impacts. The Planning Comznission
recommends a floor area limit of 1,50o square feet. The staff
� notes that recent approvals for similarly situated properties in
the County contain limitations ranging between 5,000 and 10,000
{ --- � square feet of floor area. The staff supports the intent of the �
' Planning Commission; however, based on recent approvals, we �
recommend a floor area limit of 5,000 square feet. (

, : On April 15, 1995, the applicant's representative, Richard Y.
, Neiley, submitted two letters (attached to the Memorandum) . The �.
first letter discusses the 1,500 square foot home size limit
recommended by the Planning Commission. The letter expresses the '
applicant's position that home size limitations are not appropriate �.

ti.me for completion of removal of the cabin on the above-referenced
property. You will xecall that on August 16, 1994, the County
, 8 approved an r,greement with the Morgans pursuant to which certain
deadlines were established in connection with 1041 Hazard Review �
� and the relocation of the cabin built on the above-referenced :
property. The deadline for relocation of the cabin established by -�.
� the Agreement is August 2, 2995. �
. � In accordance with the Agreement� the Morqans submitted
a General Submission and 1041 Review Application on September 15,
1994. By letter dated September 20, 1994, the Planninq Office
acknowledged that the applic$tion was complete and set it for
review by the Planning and Zoning Commission for December 20, 1994.
On September 28, 1994, the Planning Office rescheduled
y the hearing before the Planning and Zaning Comraission to January 3, �
`�-�--1 1995, because of "scheduling conflicts.°

On October 20, 1994, the Planning Office again ;
rescheduied the hearing, to January 17, 1995. I have included �
, copies of the correspondence regarding the heazings for your
review. ', ,
' On January 17, 1995, I appeared before the Planning and `
� Zoning Commission and presented the application. The Couunission, `�
after reviewing a letter from Kevin Wright of the Division of r�
Wildlife, expressed some uncertainty regarding Mr. Wright's �
recommendation for the location of the building envelope. I

recomraendation of denial so that the application could proceed to ;,r�;..�,
review by the Board of County Commi.ssioners. The Planning and i;;:.
Zoning Commission would not recommend denial and tabled the f�;?`!
application until Eebruary 7, 1995, over the objection of the �.�
applicant.
I On February 7, 1995, the Planning and Zoning Commission, �:��°x
!� after receiving correspondence from Mr. Wright confirming his � i;
. recommendation regarding the buildinq envelope, adopted a
Irecommendation of approval. ��;
Thereafter, i discussed scheduling the Board of County '�
Commission review with the Planning Office. It was my understand- �,.
ing that the application would be scheduled for the March 29, 1995 ;"
meeting. However, this meeting was canceled because of an �, :
insufficient number of board members. The Morgan application was
then scheduled for April 26, 1995.
' � Because of uncertainty regardinq the conditions of r,
� approval o£ the Morgan application, we have not been able to �
prepare and submit a building permit application. We have nqt even ( :��
I been abZe to proceed with specific designs for the structure into �.
which the cabin will be incorporated once a building envelope has g;
been approved.
'�. ..-__! The Morgans fulfilled all of their obligations under the
� August 16, 1994 Agreement in a ti.mely fashion. They have posted a
$103,000 performance bond, which is valid through March 1, 1997.
, The bond has been approved by �he County Attorney's office. d
Earlier this week, I had a telephone conference with Mr. '
' Wright regarding impacts of extending the time for relocation of ,` '
the cabin to October 1, 1995. He stated that no adverse impacts on
wildlife would result Erom such an extension. However, he ,�,'..
requested that no construction activities commence until after June ) (�
21, 1995, the projected conclusion of the elk calving season in the �.�:

construction activities on the pzoperty priar to June 21, 1995, it 4�
is not the Morqan's intention to engage in activities which might �'
idisrupt calving. And, even optimistically, a building permit will
; probably not even issue before the second week of June.
- _ � The delays in the processing of the General Submission
and 1041 Review Application total at least ten (10) weeks, through �
no fault of the Morgans. The eight (8) week extension requested �
herein will allow construction activities to commence after the :
conclusion of calving and in a time frame which recognizes the a
realities experienced in the land use process. Because the Morgans f
bond will remain in place, the County will suffer absolutely no i
risk and no detriment from granting this extension. t,;
