' John Ely, County Attorney, said this is second reading on a �
resolution recognizing the Owl Creek Caucus. The caucus area
inc].udes all properties within the Owl and Spring Creek watersheds, #
� including all those properties to which access is achieved via Owl j,
Creek Road beginning a point one and one half miles from its
intersection with Highway 82 and continuing thereon to the boundary �;�
4 of the Town of Snowmass Village as it intersects Owl Creek Road. %�."
� Ely said in discussions earlier with other staff, he is
� recommending that the resolution be amended to include the bylaws
for the caucus and a map depicting the boundaries of the area
, incorporated into the caucus.

Association appeared before the Board to request that the
commissioners to redraw commission boundaries for voting districts ;

' � Ethridge noted that the Board of County Commissioners directed
3 staff to crank up the flood and mud task force because of the
� potential o£ a flooding in the area due to the amount of heavy
[ snowfall.
iChild reported that at the Smart Growth meeting held in Vail, there �
� was a committee established of 13 citizens who will come together
. ' 4 from the 13 counties represented at that meeting who will come up
' with ideas to send on up to the state level. Also, at the state
1 level there will be a state-wide committee established with two
f inembers out of each of l0 different districts to look at all of the
Iideas that have come up from citizens all over the state.

proposed, the homesite will be close to other existing homesites "=';r�"''
and therefo�e, basically all the three disturbances will be clumped
in one spot and he thinks that is the best alternative. `� ,�r: .

Wright explained that it does not make any difference from a �i: •.
wildlife standpoint. Wright said with regard to the house size
issue, it all revolves around how the structure is built, and how ��°
much activity there will be with that structure. He recommended ,��r1
that the home be of low profile and that the homesite be tucked in i. �
j and natural vegetation be used to screen the structure. Also, with
I reqard to the lighting, he thinks that can be worked with such as L '.��
"� limiting the amount of windows on the side that faces the area y
� where the elk use more, limited outside lighting, etc. j

given how close it is going to be to critical wildlife habitat? ;a, '.
Cardomone respon@e@ that from the research he has been able to do, '
- he can't find any evidence or proof that house size has an
inPluence. He said he finds himsel£ not disagreeing at all with
anything Kevin Wright has said. He said it really has to do with r . �
` many other factors such as disturbance during construction, human •'�
' activity, liqhting and removal of vegetation. Mr. Cardomone's

John Young, representing the adjacent owner, said that Wayne's
suggestion of moving the homesite, are very problematic to his
client in terms of the quality of life from the two homeowners.
He thinks that clustering them together as has been suggested, �
� makes the most sense and requested that the Board approved the a;
building envelope as proposed by the applicant. � - '

! Rick Neiley, representing the applicant, said the reason the
� proposed site was selected was because of the recommendations by i::
� the Division of Wildlife and the Colorado State Forest Service. ��;'

� A discussion ensued with regard to the existing structure and the T
applicant's plan for removal of the cabin. `. ,

Neiley said the Morgans have, in the last 30 days been prepared to "
start work on that. They hava not been in a position to proceed �
because they don't have a location to put that cabin into right
now. Also, they have not wanted to proceed, because it is not '?
j their desire to do anything up there this time of the year, because
� it could have detrimental impacts on wildlife. He said the i
� objective is and when the agreement was entered into, was to �
provide an expeditious and well timed transition between what has �
been the existing cabin and what will be the new location. At this
4 point in time, tl�ey don't even know where they can plan to move �
it. He said as they sit here today, they are four months delayed
� through no fault of theirs. He requested that the deadline be
- - ! extended for removing the cabin and repairing the site through the
- first of October. He has talked to Kevin Wright about this and he
• told him that there would no negative impacts to wildlife if this
request is granted. ;
A discussion ensued with regard to the applicant's request for an
-. extension of time to move the existing cabin. ;`

Ireland said he would be willing to approve a temporary site for
the Morgans to move the cabin to until they can do something with
it.
Ireland offered a 7500 square foot homa on the site proposed by
Ethridge or approval of a 6,000 square foot home on the site choaen . �

Tim Malloy said he met with the Basalt Fire Marshall to discuss `'
what standards should be applied both with respect to structure ��'�� =�
� fire and specifically to wildfire. The fire marshall told him that . .�
i a structure in excess of 5,000 square feet increases significantly
i the danger due to backdraft. Their recommendation was that ;;;;?... �
� sprinkling of the structure siqnificantly reduces the hazard
because the fire can be put out in a very small amount of time. �

Krabacher said that a couple of problems that they have run into �c:�: _:
is that the structural engineer says that the cabin can't be moved. ,:•
However, it encroaches on the ad7oining property right now. Also, :` l;;
� they would have to move 75 feet of trees around it in order to get �:��i.�� '
� the necessary machinery to move it� and they can't really go on the
� neighbors property and cut down trees to do that. Therefore, they
. � think the best of all alternatives is that they drop the proposal !'�`
� for an additional free market guest house on the property, and t^
demolish the cabin.
- Krabacher said with regard to a caretaker or an employee housing i
� unit, they have to do an augmentation plan for the water, and there f.
is no guarantee that they will be successful with that. So he
would like to have it clear that they don't have to apply for a f
- water augmentation plan if they choose to just have a single
residence with the existing well.
{ Malloy said at the Planning and Zoning Commission level, Amy
j Amidron felt very stronqly about preserving this structure. He
3 asked spoke with her this afternoon and she asked whether there
; would be any problem as to just leaving the cabin where it is. As �
. j far as the County is concerned there wouldn't be because it is a
� legally existing structure. Therefore, it is more or less an issue
� between the private property owners to whether or not they have a
conflict about is straddling the property. He could be improved
� or added onto with any variance process provided the addition
didn't increase the encroachment or the setback problems, but
. , modification of it would have to go through the special review
7,. process. �

With reqard to the condition associated with the auqmentatioa plan,
Malloy said his opinion would be that the condition should read
either/or. Either thay demolish or make non habital tha structures
, or they gat an auqmentation plan.

I condition be removed because he doesn�t see aay need to have low

i Herb Klein, representing the applicant, said the code says that if
� the unit is more than 700 square feet, it�s an employee unit, and
if it's less than 700 square feet it is a caretaker unit. Anci they �
! would like to have the option to make renovatians on that, and if
f those renovations result in less than 700 square feet, that it be'
. t treated as a caretaker unit. He said the code is specific about
� this.
y Malloy clarified that what is being dealt with here is a bandit
' unit. What the bandit unit provision says, if it is over 700
� square feet it is an employee dwelling unit. � .

and Water Conservation(LWCF)purchases. The work of the LWCF in acquiring private lapds * -
for protection in the public domain is essential in preserving wildemess areas and assuring
access to landlocked public lands. A five-year moratorium would seriously endanger the ;���-
preservation of wedands and wilderness areas in Colorado that could be saved through the work
of the LWCF. We strongly oppose this funding cut and urge yon to vote against this , ;;�
moratorium.

; and Water Conservation(LWCF�purchases. The work of the LWCF in acquiring private lands
for protection in the public domain is essential in preserving wildemess azeas�and assuring ���y�
access to landlocked public lands. A five-year moratorium would seriously endanger the
preservation of wetlands and wildemess areas in Colorado that could be saved through the work . ;,?f
of the LWCF. We strongly oppose this funding cut and urge you to vote against this
moratorium.
IWe also urge you to sign a letter being circulated to the House Interior Appropriations '
� Subcommittee Chairman Ralph Regula and ranking Demcerat Sid Yates supporting continued �

would like to request that you consider re-drawing the district boundaries so that the

For example,four of the seven directors currentiy reside in District 5 and the remaining 3 • ;�?
directors reside in District 3. The idea of consolidafing the ranch into one district was
discussed at a boazd meeting on May 8,and the undersigned D'uectors voted unanimously

- Development of a home site in the wescem most quarter of par�el#42 does have the potential to
. diminish the value of the unmediately adjacent calving habitat on both private and public lands.
, In my opinion,it would be itnpossible to quantify a correlation between house size and its unpact
. on adjacent habitat however,the literature does support a clear negaave co�lation between human
and livestock activity,noise,and lighting and the quality wildlife habitat value,specifically elk
• habitat The timing and duration of construcuon and subsequent activiry and noise,do have a k
direct effect on the actual use of the habitat for calving..,In as much�.s larger houses generally take ! `
� : longer to build,an indirect cocrelafion between squaze footage and impact may exist,but to my. ��

Given my current lmowledge,of pa�el#42 and its reladonship to the surrounding landscape,

� � Thank you for showing me the proposed cabin relocation site on � ,.
this property yesterday. From a wildfire hazard perspective there
are fewer hazards with the new site than there are with the y��;
cabin's present location.
j The new site has less slope associated with it and is further ��`�
! back from the steeply sloped pbrtion of this lot. Additionally,
- ! the new site has the advantage of the access road and irrigation
I ditch below the cabin, thus serving as a fire6reak for any t
wildfires moving upsiope.
Many of the asoen stands in this area have an unusuai understory "+:�
of serviceberry that makes what we would consider a low hazard �"r
fuel , a moderate hazard. The site shown to me does not have this
• understory, but is forested with sapling size aspen. Standard
defensibie space clearing and thinning guidelines would be
adequate mitigatian on this site.
! -Removal of all vegetation within 10 feet of proposed structures
and maintenance of this "defensible space" area in mowed grass or '
non-flammable material such as decorative rock or gravel.

1. ' -Thinning of aspen trees in groups will 6e necessary around the
oroposed structure due to the density of this immature stand.
8uch group selection removaT will break up the current horizonta"1 k
and vertical continuity of fuels. �

- Thinning should be designed to leave clumps of aspen where they I' �
are most desired for landscaping or screening, while breaking up
! the horizontal continuity of the trees across the property.
� Clumps of aspen that are retained should 6e less than 30 feet in
diameter. Spaces created between these clumps should he at least
10 feet in diameter. It is expected that clearings created by the ;`'�
structure, driveway, walkway, and septic system will accomplish a , 'k<:;
large part of the thinning. �� � �`

remaining vegetation to reduce ladder fuels. �

significance. This application is being processed with
a request for approval of a special use permit to allow ��
an additional free-market residence on a parcel with a
; known historic resource. Staff would point out that this
• ' provision appears to have been originally intended to
-` ! apply when a single additional residence was to be
! constructed on a property that has one or more historic
_ j structures. In this case, there are numerous other �;s
dwellings on the property. The applicable Code section '�
� � (3-806(c)) does not specifically address this scenario.
To avoid creating a situation where the legal status oP

that all structures either be legalized via some
provision of the Code, or be removed. In this case, the

iI have reviewed the application for this project and have made a � ���� �
� site visit to examine the existing structures and agree that the �;�� >
� cabin indicated as "#2" in the photographs attached to the
i application, should be considered a Pitkin County historic �
resource. This cabin was built in 1935 as part of a lodge and ''r'
� retains in original character. .
� Under Section 3-806(C) of the Land Use Code, an additional dwelling �'.
may be allowed on a parcel which contains an historic dwelling,
subject to Special Review. Staff supports the approval of this �
request for such an additional dwelling as this section provides :`�
a valuable incentive for property owners to retain and reuse
• historic structures within their development plan. Any future
expansion of this structure will be reviewed as a two step review
under Sections 4-6 and 5-5 and must be determined to be compatible
with and not detrimental to the the historic and architectural
character of the structure. '�
In terms of the proposed relocation of historic cabin on the Cooper
. � parcel, Staff is generally not in favor of relocatinq historic
buildings, however, this structure encroaches onto the adjacent
' property. It is recommended that the conditions of approval for
• � this project include a report from a licensed structural engineer
Ias to how the building will be prepared and braced for the move,
! a description of the receiving site preparation (i.e. information
regarding a foundation, etc.) and possibly a requirement that the
'�.,_.,_ applicant post a bond to insure the safe relocation of the
