Two of the principal elements of the project, i.e., the �< . � f.?w t: � proposed ski area and necessary related facilities and ;;:•. �-,� the clubhouse and recreatioa building, are prohibited uses ;�" . �:,ri„ in the RS-30 PUD zone district in which they are proposed ���" to be located (Sections 3-3.35 and 3-3.19 of the Pitkin 'F:r f a" . :.?; County Land Use Code) . The Applicants have represented { �•= �: that these are essential components of the project. The ��� Board does not agree with the Applicants that proposed uses ,� , '. �t_ and density need not be located in strict conformance to . r'-� adopted zone district boundaries. PUD zoning applies to � only a portion of the property. District boundaries are not ' eliminated by viztue of the application beinq submitted. � �1`" Sections 3-7.2(d) and (f) require that any PUD must rnmply with the use requirements of the zone districts in which it �: is located and with all zone district regulations for the � districts in which the project is located. Rezoning to allow these uses would be inappropriate as inconsistent with the goals, objectives and policies of the Growth Management Policy Plan Opdate (Pitkin County ' Planning and Zoning Commission Resolution No. 84-3) which ' is an amendment to the 1966 Aspen Area General Plan, specifi- cally: ���` ; ,., a. The proposed rezoning to AF-1 for the purpose of developing a skiing area is inconsistent with Policy #4 of Resolution No. 84-3. b. The proposed rezoning to AR-1 for the purpose of estab- lishing urban recreational buildings and guest accommo- �:-j dations is inconsistent with Goal #4 and Obj ective !-::..; #10 of Pitkin County Planning and Zoning Commission - � Resolution No. 84-3, and recommended Action #1 of � the Aspen/Pitkin County Short-Term Accommodations R Report. _..� The RS-30 PUD zone district is most consistent with the _ � dominant agricultural, low-density and environmentally ;='�:� � sensitive natuce of these lands and the surrounding area in the Snowmass/Capital Creek drainages. The intent of the RS- 30 PUD zone district is consistent with planning for this area. + 4. Although some form of guest housing is permitted by special � review in the RS-30 PUD zone district, the proposed multi- "+ family guest housing complex would provide short-term accom- � modations for owners and their guests and would therefore =::�1 ' -$ constitute a lodge. Lodges are a prohibited use in this % zone district (Section 3-3.6). Alternatively, the proposal ;:�`'.�� could be deemed to constitute "multi-family dwellings," since `) : 's the twenty-five (25) units would be built in four or five 1. ¢ buildings. This use is also prohibited (Section 3-3.3) . � In addition, the intent of the RS-30 zone district (Section r 3-1.9(a]) , to create a district which permits only moderate - �.i �� densities in pxedominantly rural areas, would not be met �� : by th is proposal. It would also be inconsistent with th e n criterion that requires minimal visual impacts on the area (Section3-1.9 [c] [4]) . Again, this was identified by the ��`::..t• Applicants as an essential element of the pzoject. _ :� 5. The ski area and approximately thirty-two (32) homes are '= proposed to be located either directly within or in close w - '=r proximity to identified Critical Wildlife Habitat Areas. � '- The ski area and upper tier of homes are located in a calving ;.:, ;f area. Such areas are to be left in their present natural �_ �' .'; state without further development or human activity (Section � �,;�'� 5-404.2[d]) . The area north of Besancon Gulch is a critical s winter range for deer and elk. No residential development s�. i`� _� is permitted in such areas (Section 5-904.2[a]) . Development i proposed for Section 19 and that portion of Section 18 F :• L.� above 8200 feet is in an elk calving area and on a migration �� stagiag atea. Such development is prohibited (Section • '�"'. 5-404.2[c] and [d]) .The applicants have failed to demonstrate `�� that the adverse impacts of the p=oposed development upon � wildlife will be mitigated, and the application contains '�' no s cific information to indicate how miti ation mi ht f�;;:� Pe 9 9 ��.=, occur. The Applicants' October 4, 1984 submittal contains �� substantial new information not previously available to the �� County, the public or other applicants on this issue. This �;, inf ormation was not submitted in compliance with the deadline ���: for submission of the application. For this reason and �I�w" since it substantially alters the application and constitutes ��;;;, a significant modification thereto, it cannot be considered �d by the Board in support of this application. This is i�;:- especially true since acceptance of this modification may �`r�' substantially and unfairly affect the competitiveness of �1:. this application with t�e other application being considered. The applicants have failed to demonstrate t1�at the public � road system, and specifically Sinclair Road, can accommodate i � the traffic which would be generated by the proposed develop- � ment without creafing traffic hazatds or significant service r ' level ceductions beyond the capacity of the County to alleviate i: ,,' � . without si nificant cost to the eneral " " g g public. Sinclair Road is inadequate to accommodate th e traffic to be generated �;�'`'`T. by the project, as specified in Town of Snowmass Resolution Sc,_.,: �;';� j No. 84-36. There is evidence to indicate that significant ,' improvements necessary for compliance with Section 5-202.1(b) � �' may not be possible. There is nothing in the record to - support the reasonableness of the Applicants' offer of `;_� $150,000 for improvements, as required by Section 5-202.1(c). � :,:;i In addition, the Applicants have failed to show that the traffic to be generated by the project can be accommodated -'S�� by Sinclair Road without significant degradation of the � :! level of safety, as required by Section 5-201.1(a). Nor have the Applicants met the requirements of Sections 201.1(b), since i they have failed to show that the additioanl traffic to be 9 generated would not require significant capital costs to :..� upgrade the road to preserve existing conditions in terms of ' levels of service an3 safety. The Soard rejects the October ! >>r;R' 4, 1984 submittal on this issue for tl�e reasons stated in T � paragraph 5 above. Although the Applicants discussed at the � hearing alternative access, there was no evidence to demon- � . "� strate the legal avaiZability of such alternatives.
