••• WHERSAS, James A. Bagley (hereinafter referred to as "Applicant")
is the owner of record of approximately 40.5 acres of real property in
Snowmass Creek more specifically described on the attached exhibit
"A"; and

WHSREAS, the Applicant has requested special review approval
pursuant to Section 3-8.13(b) of the Pitkin County Land Use Code for a
1,200 sq.ft. employee dwelling unit to be constructed within an

� 1. The Applicant shall, by deed restriction or other permanent

� committment running with land, guarantee that the �nployee
,>�; dwelling unit shall remain a rental unit, not be occupied by

qualify as (and have been found by the Housing Authority to `

2. '1'he commercial kennel operation shall be eliminated upon the
