CONTRACT FOR ELECTRIC SERVICE

. The undersigned (hereinaPter called the "Appli- •
� , cant"), its successors and assigns, hereby agrees to •
purchase electric energy from HOLY CROSS ELECTRIC ASSOCI- ,�%�''

- ATION, INC. (hereinafter called the "ASSOCiation"), and
�` hereby agrees to all of the following terms and condi- �

�'i:;:.j If electric energy is made available to the Appli- �
;�=?�? cant by the Association, said Association has invested in

;+t, � of this Contract. Upon electric energy being made avail-
<_.••.= able to the premises described below, the Applicant spe-
,_� cifically covenants and agrees, and binds himself, his '
heirs, devises and personal representatives, in consider- ��
,: � ation oE such construction by the Association as follows:

A. The Applicant will, from the date energy
:-;,,a is made available to said premises, for the full period
,.::;;••:ti of ten (10) years, but no later than October 31, 1995,
purchase from the Association all electric energy pur-
chased for use on the premises described below and will
�"� pay therefor at rates to be determined from time to time
�;�; �: in accordance with the Bylaws of the Association, pro-
• °;:`{ vided that the Association may limit the amount of elec- ,�;;�j
,, tric energy to be furnished for industrial uses.

� � B. During the time described in paragraph "A" .
� above, beginning on November 1, 1985, the Applicant will .�
�' '� pay a bill oE at least three thousand dollars ($3,000.00)
`� per month, plus tax, regardless of the number of kilowatt
-• ,� hours used. Payment oE this minimum charge shall entitle
�-''�,a the Applicant to the use of the number oE kilowatt hours
corresponding to the minimum charge in accordance with
'��=�� the applicable rate.

;� 2. The Applicant's premises are located in Pitkin ?
County, Colorado, and are more fully described in Exhibit A �
attached hereto. ��
. 3. The Applicant will comply with and be bound by �'�
+;��� the provisions oE the Certificate of Incorporation and
� : Bylaws of the Association, and such Rules and Regulations
as may from time to time be adopted by the Association.

tion for any such debts or liabilities.
5. The acceptance of this Contract by the Associ-
� ation shall constitute an agreement between the Applicant

� quent violation hereof.
