Rwcorder RESOLDTION OF THE BOARD OF COUNTY COIHMISSIONERS OF PITRIN CODNTY, COLORADO AMENDING THE COMltERCIAL DEVELOPMENT QQOTA SYSTEM Resolution No. 84- 64 eooK 470 ��,cE613 WHEREAS, on April 2, 1984, the Board of County Commissioners �• _�.'. (hereinafter "Board") did adopt Resolution 84-23, amending Section a� - 5-510 and 5-300 of the Pitkin County Land Use Code; and ` _ Q^i.:i it W9EREAS, as a condition of adopting said Resolution, the Board '�'- :i - did direct the Planning Office to return no later than June 15, 1984, . with an alternative to square footaoe as the basis for the County's - commercial development quota; and ;i':,`.`i W6EREAS, on hlay 22, 1484, the Pitkin County Planning and Zoning - Commission did review two proposed Code amendments, including a proposal known as the employnent generation unit (EGU) , intended to supplant �i =`' the 20,000 square foot quota, and a proposed new scoring criterion, ::F�_:y.' . - r';;: � :� visual vulnerability, intended to address the problems which may <` ° = result fcom the potential size of commercial developments which could ' be built under the EGU system, and did recommend the adoption of ... } a same; and :i` ; , ` a WAEREAS, on July 16, 1984, the Board did hold a public hearin9 i�_ f � to consider the recommendations of the Planning Commission, at which �•' i" 3 � � time evidence and testimony were presented; and , I �i;:'.-.j WHEREAS, the Board does find that the proposed EGU system is `>i a more precise and equitable method of ineasuring the growth impacts ti�'°j of commercial development than is square footage due to the varied r:, , Y , ' j nature of commercial uses in the County; and � � � WHEREAS, the Board does find that it is important for Pitkin *' - � � County to have a commercial development quota so as to insure that � .��...h {.: -_.:a the rate of commercial growth is in balance taith the rate of residential � : :�:;'� 'F•...p !��F.:-.'. . _ and lodge development, to provide a mechanism for insuring that the ;d:: . ;?.:��� S.'�.... .. � t.. , �q impacts of commercial growth can be met and to obtain projects r�hich �:`� are of the greatest public benefit. The Plannin9 Commission shall obtain `' ` - � the advice of the fioasing Authority prior to determining the - employee generation of the project. In lieu of utilizing this calcalation, the Planning Commission ; may determine the actual number of employees to be genecated by the project, based on evidence provided by the applicant '� and contirmed by the Housing Authority, and use this number ? as the project's EGU Eotal. � �; - ��'`?: BE IT ALSO RESOLVED by the t3oard that it does hereby amend Section ; `?' S-520.6(a) (1.) (B? (x) to read as follows: � . (x) The applicant's proposal to satisfy Section 5-300 of the - Land Use Code by housing the employees which are generated as a result of the commercial development, including an identification ; � of the number of employment generation units (EGU) which the :� applicant believes the development entails. ;'�?'`"` BE IT ALSO AESOLVED by the Board that it does hereby amend Section � '� 5-510.6(a) (2) (B) by the enactment of a new subsection � s (v) to read � `'.� as follows: � :,� (v) Visual vulnerability (maximum three [3] points) considering ' the extent to which the applicant uses mitigating techniques , y such as sitin9, bufferitt9, natural topography and vegetation q + -<� and setbacks to offset the visibility of the project (man made 1 ? berms are not encouraged). �i BE IT FINALLY RESOLVED by the Board that it does hereby amend - _ti "� the chazt in Section 5-510.6(a) (3) by the inclusion of the visual 1 � vulnerability criterion with a multiplier of "1".
