"'--�� "Applicant") has requested Special Review approval to operate the

Independence Gravel Pit which is located approximately 12.5 miles
east of Aspen adjacent to State Aighway 82; and
WHERBAS, a public hearing was held before the Board of County
�;`;,� Commissioners (hereinafter "BOard") wherein evidence and testimony

- were presented with zespect to the proposed g=avel pit.

NOW, THBRBFORB, BE IT RESOLVSD by the Board that it does hereby

-;,.�, grant approval for the 5pecial Review permit subject to the fol2owing
:;°;h
-= � conditions:
1. This permit shall run for a seven (7) year period commencing
- on the date of approval by the Board of County Commissioners.
� 2. Prior to April lst and the commencement of operations each '��i
�. -�' gear of the permit period, the applicant shall submit a ��
i;'.;'ii statement of continued compliance with the conditions of
t ^ this permit to the County Planning Office. The Planning
4 h Office shall schednle a public hearing before the Board
"� of County Commissioners at which time the applicant's perfor-
��'`'" mance under the terms of this permit shall be reviewed
;,` ��., along with the applicant.'s operating and reclamation plan

p. , for the next season s operation.
:.;:;.� 3. The hours of operation of the Pzt shall be limited to between
`•°� �:00 A.M. and 7:00 P.M.

;,x 4. This permit shall be non-transferable.

-a 5. At all times when the Pit is in use, appropriate routine
safety procedures in conformance with all applicable state r.
�`-;� and federal laws shall be adhered to. �";;�

r �� 6. The production site(s) shall comply with the State of Colorado �
_ .� Noise Abatement Law Title 25, Article 12. n.

r;.-� 7. No wastewater shall be permitted to enter natural drainages. =�,`',?
" All on-site drainage shall be retained in the non-discharging ��' '

�s'� 8. The applicant shall comply with all applicable State and

future submissions made to the State Mined Land Reclamation
�" �`� Department and/or U.S. Forest Service tegarding permits,
�. ' the operating plan, reclamation and performance bonding.
14. The applicant shall work with the County Environmental
"- Coordinator, the Bureau of Reclamation and the U.S. Forest
"•'•` Service to develo an a �_
p ppropriate Reclamation Plan and .;��1
'�`-`, Bond to insure conformance with the conditions of the local `;
�;;_:� zoning (special review) resolution as required by C.R.S. 1973, !

� 34-32-109(6). The Reclamation Plan shall include, in addition ,:
� '1 to the provision proposed by the applicant as Exhibit "E°
`,� to the Special Review application, the detailed revegetation
� � procedure described in the attached Highway Department
_, � Memo dated September 17, 1980. Phased reclamation shall
' occur within two (2) years after each phased excavation
�",'1 and the entire site shall be completely reclaimed within -
+-';j two (2) years of the last date of operation.

C-;a 15. Uses of material from the pit shall be limited to use east
�--`1 of Aspen. �'
