'Without the support of your office and that of the North Forty Homeowners, Tetra Tech utrderstands that the Board of County Commissioners will deny the application at the hearing tomorrow. Your time and effort is greatly appreciated, and I look forward to working with you towards a common goal, Tbank you for your help in this matter, Lowell Nelson Market Team Lead 00000; 4 3-7 -4 MEMORANDUM TO: Board of County Commissioners Regular Meeting — February 25, 2004 THRU: Cindy Houb� l unity Development Director FROM: Ezra Louthis, Planner RE: Nextel Special Review for a Telecommunications Facility SUMMARY: The Applicant is requesting Special Review approval pursuant to Code Section 3- 210 for the construction of a wireless telecommunications facility, including three 8' whip antennas (two inches in diameter) and a 15' X 20' equipment shelter to be built at the Colorado Mountain College Aspen Campus. The equipment shelter would be attached to the southwestern (Highway 82 side) exterior of the existing building and would be approximately 14' tall. The three antennas would be placed along the spine of the CMC building (tallest point of the roof), and extend to a height of 38'. APPLICANT: Nextel (Tetra Tech, Inc.) REPRESENTAIVE: Mike Sharlow LOCATION: Colorado Mountain College adjacent to the North 40 Subdivision; 0255 Sage Way ZONING: AH2/PUD BACKGROUND: The CMC is located on Lot 1 of the North Forty PUD. In 2000, Sprint applied for a similar request to place a wireless telecommunications facility at CMC. The request was denied pursuant to BOCC Resolution 065 -2001 (see Attachment A) based on the finding that such a facility is not consistent with the intent of the zone district. REFERRAL COMMENTS: The application was referred to the Pitkin County Zoning Officer, but no comments were received. All referral comments received are attached. • Phil Shultz, RFTA Manager of Radio, stated that due to the similarities in frequency between Nextel and the radio operations of RFTA and Holy Cross Electric, they are opposed to the application. • North Forty HOA opposes the application due to health and visual concerns. STAFF COMMENTS: Special Review Standards Section 3 -210: A telecommunication facility is considered a Special Review Use within the B -2 zone district and is subject to the following standards pursuant to Section 3 -210 of the Land Use Code: A. The special review use shall consider: -000002 The applicable County Master Plan; Response: The Colorado Mountain College lies within the Urban Growth Boundary that has been identified in the 2000 Aspen Area Community Plan. It does not appear that the proposed antennas violate any polices outlined in the AACP. The college was approved as part of the North 40 development project. The North 40 development does have architectural standards. 2. County Land Use Policies in Article 2; Response: The proposed addition is consistent with applicable Code Policies in Article 2 3. The intent of the zone district in which it is proposed to be located; Response; The intent of the AH2/PUD zone district is to "provide for the use of land for the production of Category 1, 2, 3, and 4 affordable housing and resident occupied units and lots (as defined by the Housing Authority Guidelines of the Aspen/ Pitkin County Housing Authority) within the Aspen Metro area. The zone district also permits a limited component of free market units to off -set the cost of developing affordable housing. It is contemplated that land may also be subdivided in connection with a development plan." Additionally, "the Affordable Housing (AH2/PUD) Zone District is intended for residential use primarily by permanent residents of the community. Recreational and institutional uses customarily found in proximity to residential uses are included as special review uses. Commercial uses which are accessory to the housing development are also included as special review uses." Although some commercial uses are listed as Special Review uses, radio transmitters or cellular facilities are not included in the Special Review use as they are in other zone districts. It is Staff's belief that a wireless telecommunications facility is not consistent with the intent of the zone district. 4. The character of the immediate vicinity of the parcel proposed for development and surrounding land uses, or enhance the mixture of complimentary uses and activities in the immediate vicinity of the proposed parcel for development; Response: The proposed antennas will not enhance the visual quality of the surrounding area nor will it highly degrade it. The proposed use is not consistent with immediate residential neighborhood. B. The location, size, design and operating characteristics of the proposed special review use must be in harmony with the surrounding area and minimize adverse effects, including visual impacts, impacts on pedestrian and vehicular circulation, parking, trash, service delivery, noise, vibrations and odor on surrounding properties. Response: The proposed facility may have minimal visual impacts on the surrounding environment but will not be in harmony with surrounding development. The proposal will not adversely effect pedestrian or vehicular circulation, parking, trash, service delivery, noise, vibrations, and odors on the parcel or surrounding properties. 01 C. There must be adequate public facilities and services to serve the special review use including but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection, emergency medical services, hospital and medical services, drainage systems, and schools. Response: The location currently provides adequate services to support the proposal. D. An application for a special review use must demonstrate to the Board of County Commissioners that the proposed development will not: 1. Materially endanger the public health, safety or welfare; and 2. Substantially injure the value of adjoining or abutting property. Response: The Applicant has argued that installation of this facility will enhance community safety by providing additional cell phone coverage along the Highway 82 corridor. Although no studies have been provided to state whether or not the proposed facility is safe, the Homeowner's of the North Forty Subdivision do not feel comfortable with the potential safety issues raised by such a facility (e.g. "harmful waves "). There is no evidence to substantiate that properties will be devalued from the proposed development. SCENIC OVERLAY (SECTION 3- 60-040 The Colorado Mountain Collage falls within the State Highway 82 Scenic Overlay zone, therefore the Applicant is required to meet the criteria for the overlay zone for the proposed development. Section 3- 60-040 of the Land Use Code establishes the following review criteria for development within scenic overlay areas. 1. Whether the proposed development has utilized existing topography and natural vegetation, such as ridges and hills to screen buildings to the maximum extent possible. Response: The antennas will be mounted flush against the exterior wall of the college and will extend 8' above the ridge or spine. The accompanying equipment cabinets will be located within an addition that will be constructed adjacent to the pottery area/dumpster structure on the west end of the CMC building. There are no existing topographic features such as ridges and hills, aside from what currently exists, which will be utilized to provide additional screening. 2. Whether the proposed development has been designed to complement the natural topography of the land, including, whenever possible and appropriate, the utilization of innovative architectural techniques such as earth sheltered design, natural materials and coloring, non- reflectability and clustering of structures on the least visible portions of the site. Response: The antennas will match the color of the existing building. The proposed addition which will house the equipment cabinets will utilize the same exterior and roofing materials as the existing pottery area/dumpster structure. 3. Whether the proposed development's height and bulk has been designed to avoid, to the maximum extent possible, the visibility of buildingsfrom the highway and public viewplanes. 000004 M Response: The antennas will extend beyond the height of the CMC building, but will only be 2" in diameter. The proposed addition to house the equipment cabinets will not extend beyond the CMC building. 4. The proposed structure shall be placed so it does not break a ridgeline, unless there are no alternate building sites on the lot. Response: No ridgeline area will be broken. S. Whether the proposed development has avoided the location of uses on the highest ground or most visible portion of the site as viewed from State Highway 82 and public rights -of -way, identified in Section (B)(1). Response: The proposed equipment storage addition is not located on the highest ground of the property or the most visible portion of the property as seen from State Highway 82. The antennas will extend to be. the highest point on the property 6 Whether the proposed development has been located outside of the designated Scenic Overlay or on a suitable site at the greatest distance possible from State Highway 82 and identified ridgelines. Response: The entire property is located in the State Highway 82 Scenic Overlay zone. 7. Whether the proposed development has been landscaped in accordance with the adopted State Highway 82 Corridor landscape guidelines and has preserved natural vegetation, to the maximum extent possible, including the avoidance of development within irrigated meadows. Existing vegetation shall be maintained to the maximum extent possible, while using existing vegetation to screen development. A landscaping plan shall be submitted by the applicant and approved by the Planning and Zoning Commission. Response: The objectives of the State Highway 82 Corridor Landscape Guidelines are to preserve historical rural character, preserve spacious open views, preserve the natural ecosystem of the corridor, landscaping should be self - maintaining. The Colorado Mountain College has a landscaping plan which as been partially installed. As part of the proposed addition for the equipment cabinets, some vegetation around this structure will be lost. The Applicant has agreed to replace the lost vegetation. 8. Whether the proposed development's exterior lighting has been designed in such a manner that light sources, such as facade and landscape lighting, will not be seen from public rights -of -way as identified in Section (B)(1). In addition, an application shall be consistent with the lighting regulations identified in the Pitkin County Land Use Code. Response: The Applicant has proposed lighting triggered by motion - sensors. The lighting must comply with the standards of the Land Use Code. 9. Landforms and earth moving shall generally not be acceptable as the sole measure of compliance with these regulations. However, they may be utilized in conjunction with other site techniques designed into the development plan. These methods maybe acceptable when utilized as 000005 one of several methods to complement and enhance development, rather than as the single device for screening development from view from the State Highway 82 Corridor and as mapped. Response: No landforms or earth moving is proposed as part of this application. 10. Whether the proposed development has been designed so as to avoid, to the maximum extent possible, any Scenic Viewplane identified on the State Highway 82 Corridor Master Plan and Down Valley Comprehensive Plan. Response: There are no Scenic Viewplanes mapped for this area. IL In the case where 1041 hazard areas may be in conflict with preservation of scenic areas, the Board acknowledges that 1041 issues take precedence over scenic concerns. These issues shall be reviewed on a case -by -case basis. Response: There are no 1041 hazards associated with the proposed development activities. RECOMMENDATION: Staff recommends that the BOCC deny the Nextel Special Review for a Telecommunications Facility located at Colorado Mountain College due to the facilities' inconsistency with the intent of the AH2/PUD zone district and the potential conflict with RFTA radio operations. The Roaring Fork Transportation Authority and Holy Cross Electric (the radio system serves both RFTA and Holy Cross) both object to the construction of the cell towers. The RFTA radio system operates in what is called the 821 Megahertz range. In the past several years Nextel has been identified as the source of interference with public service radio systems throughout North America that operate in the 800 MHz range. The proximity of the Nextel cell towers to the Aspen Bus Maintenance Facility would likely hinder our dispatch radios and portable radios . Nextel is well aware of the problem and are currently trying to get the FCC to move all public service radios off the 800 MHz range (it has made an offer of $825 million to move the current users to another frequency). Nextel has presented a plan to the Federal Communications Commission (FCC) for its solution to the interference. However, the artfully named "Project Consensus" is a plan for the future, and has not been approved by the FCC. RFTA is concerned with current conditions whereby Nextel proposes to place a tower with a strong signal, a short distance from our dispatch facility, at a higher elevation. The Roaring Fork Valley is a difficult environment for radio communication under the best of circumstances. Nextel's proposal is a recipe for interference, and it should not be allowed to harm a local public transportation provider on vague assurances that it will fix any problems when they come up. We, the hundreds of people living at North 40, maintain our opposition to such a proposition. We, adamantly oppose the placement of any transmitter, relay device, or cellular phone peripheral equipment, which we find to not only be an eyesore, but may emit harmful waves of any sort. We are also concerned with the precedent that these proposed placements may establish, therefore, the homeowner's board is unanimously opposed to any company placing said equipment on top of the CMC. As the electric utility serving most of the unincorporated areas of Pitkin County, including the Aspen Airport Business Center, Holy Cross communicates with its operations personnel with a private 800 MHz trunked radio system. This system was engineered and constructed in 1994 to provide seamless wide -area coverage from Aspen to Vail to Parachute, utilizing high repeater sites such as Aspen Mountain and Sunlight Peak. The Roaring Fork Transportation Authority became a joint user of the system in 1997. In recent years Nextel cell sites in urban areas have increasingly become a source of localized interference to public safety and commercial 800 MHz radio systems; the City of Denver and Arizona Public Service to name a couple. Police and utility 800 MHz portable radios will literally go deaf when near a Nextel cell site. Nextel has consistently argued that its operations are technically in compliance with Federal regulations, as would likely be the case at the AABC. However, even the Federal Communications Commission does not have an immediate solution at hand to resolve this ongoing issue, of which Holy Cross has gone on record (attached). In conclusion, Holy Cross Energy has insufficient technical information to specifically oppose Nextel's application; however we do wish to go on record as being concerned about the potential impact to RFTA and Holy Cross' critical communications. Nextel's proposal requests the authorization for the construction, use, and maintenance of an unmanned wireless telecommunications facility, which further enhances Nextel's Colorado wireless network. The development of this portion of the network will allow its customers seamless access to Nextel's nationwide network of services. The proposed facility will be in operation 24 hours per day; 7 days a week and will only require routine maintenance once every 4 to 6 weeks. This proposed facility will consist of three (3) omni or whip type antennas and an equipment shelter designed and I .constructed to match the existing structure. Each antenna has an approximate dimension -af5'- 2`tall x 2" in diameter. These antennas are similar to those previously approved at the Airport Fire Station and the Aspen Animal Hospital. The proposed antennas will be n / spaced along the "spine" of the roof as depicted in the photosimulations and drawings ny p attached. You will also find attached as Exhibit B, an antenna specification sheet. Antennas can also be placed on rooftops, integrated into the building's architecture, and other building features if the structure has sufficient height to meet the needs of the service area.
