Dear Board Members: This letter sets forth the reasons supporting our request for variances of the Pitkin County setback regulations and demonstrates how approval of the requested setback variances will alleviate hardships which we will otherwise encounter in building a single family residence on Lots 21, 22 and 23 of the Crystal River Park Subdivision. The following variances are hereby requested: 1) a variance from the 100 foot setback for structures from major roads pursuant to section 3-50.20A.2. of the Pitkin County Land Use Code; 2) a variance from the 50 foot sight distance setback for major roads pursuant to section 3-50.20B.2.; 3) a variance from the 30 foot minimum rear yard setback for parcels having an area greater than 30,000 square feet pursuant to Section 3-50.50. Variances from major road and sight distance setback requirements The Crystal River Park Subdivision was approved by the Board of County Commissioners for Pitkin County in August, 1966. The rear lot lines for Lots 21, 22 and 23 of the Crystal River Park Subdivision are adjacent to the Colorado Department of Transportation right-of--way for State Highway 133. The depth of Lots 21, 22 and 23 is very narrow and varies from a maximum of 111 feet to a minimum of 89 feet so that, enforcement of either the 100 foot major road setback or 50 foot sight distance requirement precludes construction of a single family home on these lots as there also is a 30 foot front yard setback requirement for the lots. The major road and sight distance setback requirements represent undue hardships. Granting variances from the 100 foot major road setback and the 50 foot sight distance setback is appropriate because Lots 21, 22 and 23 are situated on a level meadow approximately 20 to 40 feet above the surface of State Highway 133. The rear lot lines for these lots is at the edge of a bluffwhich rises from the shoulder of State Highway 133. The topographic separation between the highway and these lots mitigates the safety requirement associated with the 50 foot sight distance setback. Likewise, the blufffonning the rear lot lines for Lots 21, 22 and 23, precludes the usefulness of the L00 foot setback for highway transportation purposes. Variance from minimum rear yard setback requirement A variance has been requested from the 30 foot minimum rear yard setback requirement for Pitkin County Board of Adjustment January 11, 1998 Page No. 2 Lots 21, 22 and 23 of the Crystal River Park Subdivision. Due to the narrowness of these lots, the orientation of these lots along the curving Crystal Park Drive and the 30 foot minimum front yard setback which corresponds to the 30 foot setback requirement in the land use covenants, enforcement of the 30 foot minimum rear yard setback requirement creates a building envelope which is excessively narrow. The site plan for the proposed 1,600 square foot single family home depicts a building orientation which is parallel to the long axis of the building envelope and conforms with the 30 foot minimum front yard setback requirement. However, the house structure will encroach less than seven feet on the 30 foot minimum reaz yazd setback so that, enforcement of this 30 foot setback is a hardship to siting the house structure. Granting a variance from the 30 foot minimum rear yard setback requirement will not cause any negative impacts to the adjoining landowners. The encroachment to the rear setback does not negatively impact the adjoining landowner, Colorado Department of Transportation, because of the topographic separation between Lots 21 22 and 23, and State Highway 133. Likewise, the landowners adjoining the CDOT property across the Crystal River, Mr. and Mrs. Kieler, will not be negatively impacted because of the topographic separation, and distance from Lots 21, 22 and 23. CRV Properties, Inc., owns the open space parcel dedicated to the Crystal River Park Homeowners Association, which is adjacent to the front of Lots 21, 22 and 23. CRV Properties, Inc., has provided us with a letter in support of our requested setback variances. Finally, granting a variance from the 30 foot minimum rear yard setback requirement does not negatively impact the respective adjoining owners of Lot 20 and Lot 24 of the Crystal River Park Subdivision. Case #98-03, Tom Kinnev, 622 Redstone Blvd Redstone CO Lukes introduced the request fora 75' major road setback variance, where 100' is required, and a 5' rear yazd setback vaziance, where 30' is required, for construction of a single family residence. Schaffner indicated that this property is in the Crystal River Pazk Subdivision, just south of Redstone, and that the applicant had just gone through the planning process to merge three adjacent lots into one. Ruth Kinney was present and noted that the 100' road setback requirement essentially makes the long narrow lot unbuildable. She said that she had received preliminary approval for the location of the home from the homeowners association's architectural committee. She produced a letter from Bob McCormick, a representative of the homeowners association who manages the adjacent open space pazcel, in support of the application. Bonnie Sherwood, a neighbor of the applicant, and her friend Gale Bryant, were present as an interested party. They had been curious to know what plans were being proposed and after viewing them were in support of the application. Lukes moved to grant a 75' major road setback vaziance, where 100' is required, and a 5' reaz yazd setback vaziance, where 30' is required, specifically as shown on the plans submitted, due to downzoning.
