The applicant, John McBride, has submitted a building permit to
reconfigure Friedls Restaurant in the Marketplace building at the
Aspen Airport Business Center.
The Marketplace Building (Lot 4A, Block 3, AABC) received
Commercial GMQS approval pursuant to Resolution 89 -108 for
redevelopment and additional square footage. The parcel is 1.26
acres and is zoned B -2. Restaurants are allowed by Special Review
in the B -2 zone district. There has been a restaurant in the
Marketplace Building continuously since 1974 until the building was
closed in 1991 for remodelling.
The application for GMQS specified that Dudley's Diner was 3,328
square feet, and that after the remodel the restaurant would remain
at 3,328 square feet. The restaurant has changed ownership and
Friedls' proposed plans indicate that it will be approximately
3,072 square feet.
Section 3 -6. 3 (b) of the Land Use Code sets criteria for alterations
to a structure operating under a Special Review permit to be
considered either a substantial or insubstantial change.
Insubstantial changes may be approved by the Planning Director if:
(1) Activity does not change the basic character or the use
of the land on which the activity occurs, including its basic
visual appearance and method of operation. And, the activity
does not violate any policy or general regulation of the
Pitkin County Land Use Code.
Response: The basic character, use and visual appearance of the
structure will not change as the proposed remodel is within the
structure. The method of operation will be consistent with
previous County approvals for the property. The proposed use does
not violate any policy or general regulation of the Land Use Code.
(2) Activity does not require the applicant to obtain any
other land use permit which cannot be granted by the Planning
Director or Building Inspector.
Response: The addition only requires this approval by the Planning
Director and a building permit. No other land use approvals are
required.

(3) Activity does not substantially increase the need for on-
site parking or utilities, or effect employee housing
generation or provision for the use.
Response: There will be no increase for the need of on -site
parking, utilities or employee generation.
(4) Activity does not increase the floor area of the use by
mote than two percent (2 %) or decrease the open space on the
site by more than three percent (3%,).
Response: There is no increase of the floor area or decrease of
open space on the parcel, as there is no addition of square
footage.
Given the criteria of Section 3 -6.3 of the Code, staff recommends
that the Planning Director approve the applicant's request for the
remodel depicted in building permit 1 -595.

3. Reference permit 1 -62 showing that 34 parking spaces
are required for this building and 59 spaces are provided.
Employee generation and utility use will not differ from
historic levels.
4. The floor area is identical to the floor area prior to
remodel and the open space around the building has not been
reduced.

§ 3-6.3
(1) Activity does not change the basic character or the use of the
land on which the activity occurs, including its basic visual
appearance and method of operation. And, the activity does not
violate any policy or general regulation of the Pitkin County Land
Use Code.
(2) Activity does not require the applicant to obtain any other land
use permit which cannot be granted by the Planning Director or

(c) Any Special Use Permit shall expire after any continuous period of
twelve (12) months of non -use. Any unfulfilled obligations of the
permittee shall continue to be binding after expiration of the permit.
3 -6.4 Special Review Single - family Houses
(a) Review Criteria. Single- family dwelling applications will be
reviewed to ensure conformance with the definition of single - family
dwelling and limitations on occupancy.
(b) Presumption. A family composed of six (6) or more persons
related by blood or marriage shall be presumed to have a need for a
number of bedrooms equivalent to the number of persons in the
family; provided, however, that this presumption is rebuttable, and
evidence to the contrary may be presented.
3 -7 Planned Unit Development
3 -7.1 Purpose
The Planned Unit Development is a procedure which allows variance
from strict adherence to the area and bulk requirements of zone district
regulations (Section 3 -2) in order to encourage and facilitate the
compliance of developments with the policies and regulations of this
Code. Specific purposes include:
(a) Promoting flexibility in the type, design, and siting of structures to
preserve and take advantage of the site's unique, natural, resource or
scenic features and to avoid or mitigate any hazardous areas.
(b) Encouraging more efficient use of land and public streets,
utilities, and governmental services.
(c) Preserving open space for the benefit of residents of develop-
ments as well as the community in general.
(d) Achieving a compatible land use relationship with surrounding
areas.
