He said there are a number of issves that do not need to �� _ be made public. � After a short discussion it was agreed to continue with a public meeting. Ireland asked Haughey to respond to three issues as follows: 1. A memorandum of April 12, 1995 to Stan Berryman, which criticizing Commissioner Wayne Ethridge. 2. Why he retained outside counsel to represent him. 3. Why he made the decfsion to create a position and hire . a director for the Open Space and Trails program. � �. . �. Child commented that the relationship between the Board and the r `.+- Manager is based on trust, and that trust, to him has been � . shattered by recent events. � Haughey addressed the issues by stating that with regard to the , , memorandum to Stan Berryman, when he found out Wayne was offended � by that statement he responded in a couple of different ways. The � first was to apologize to Wayne. The second one was to comply with the Board's request that he not take any leave, which was the - punishment that was delivered by the Board. He said this is very difficu2t to do when almost everything you do upsets someone. He said the ��:-:2,� only thing he asks is that the Board take the letter referring to insubordination out of his file. - ; �' � With regard to getting an attorney, Haughey said he feels like he - was placed in a real awkward position because he was told that the "��`J� '` _ : County Attorney had formed an opinion that it was insubordination .�• and that the board agreed. And by doinq that, he was basically cut � I off from the attorney's office. So he felt that he had no choice �'. Jbut to try and seek some advice from someone who was an attorney � � and that is what he did. � Ireland told Haughey that the Board directed him to conduct himself w : � professionally with Wayne and he did not do that and therefore, t� ; that constitutes insubordination. i' .ti.. Tuite said that with respect to the hiring of an open space and � � trails director, there was originally a part time person working with the open space board. The goal was to put five qualified people in different fields that could do a lot of the work. Then � a secretary was hired. At that point the board had a meeting with . Hauqhey and voiced their concern about going from a part time ' person to a part time person and a secretary, and the goal was not to build a bureaucracy on open space. They want as much money as possible to go toward the purchases or the maintenance of these j trails. The board's concern was that the part time position that �� Mark FuZler had was filled with a full time position. There is still a secretary, and in his mind that starts going toward more money being spent on salaries and not more money going to open - space purchases. He also checked with other board members and found out that no one had been consulted on the hiring of a director. Haughey noted that the budget impact from changing from a part time position to a full time position is about $12,000. When he started , working with the Open Space and Trai].s Board it was clear they -. _ __ wanted to move into a more agqressive stance on the acquisitions ^ < and they thought the most efficient way to do it was to internalize their acquisition process in their staff. They wanted to change from a staff that was able to cover a variety of different subjects I to someone who was more concentrated on those acquisitions. So he � I was trying to follow their lead in doing that. j' Ethridge said before he speaks, since the County Manager has ! retained counsel, how what he is able to say can be used against any other board in the future because this is a public meeting. �i. He said he is not going to go through y , all of his documentation primarily because of legal concerns at this point. However, he will read what the apology to him �'�� ''+ illustrates as the depth of the problem that we have. He proceeded to read into the record the memorandum from Haughey as follows: ��: : r .�_�. _ .,. Dear Wayne. I apologize for offending you with my CEO �`�``` exchanqe with Stan Berryman last week concerning the airport sign. ��':' I agree that the note was glib but was not meant to be ill C`^�` intended. As a former stafE member I hope that you can appreciate the casual nature of internal communications. �' =F + f : i Ethridge said as a former staff inember, who spent 11 of 12 years � in a manaqement position, he would expect to be very fortunate to � keep his job if this had happened ance. He said in fact, it � .;,._. ' i happened again. In a mema dated March 28, 1995 regarding the Wingo i ; Bridge. + Ethridge further noted to Haughey that ha agreed to keep his � comments and concerns about him far less public, and every member k _ of the board has told him that they believe he upheld his end of � the bargain. However, after he got back from a trip, he saw this most reaent memo and that coupled with the previous memo leads him to believe that because of the chain of events leads him to believe that he is not the individual who needs to hold this position. Ethridge proceeded to read the memo as follows: � ' Stan I tried to call you this is unacceptahle {this meaning scheduling of the visit on the Wingo Junction Bridgej I repeat, we � need to provide the board the chance the formally look at these. ` Two days at Blue Lake and drop by wi12 not cut it. All we are s askiag for is to have Wayne rip us up. � Ethridge said that he has not pursued this memo with the board. -------- Also, they have offered to discuss the whole matter in private and � not make it go public but his choice is to do so. He noted that 1 there are other numerous other issues that he is not prepared to � go into today. If necessary on June 14th, in order to create a record he will be glad to do that. He told Haughey that it is not � ` two ar three issues, but rather a series of issues that refleats his judgement and his need to control everyth3.ng that is going on. ' � � Ethridge noted that another issue involves farming out Jim Dukes' talents to other jurisdictions and the board not being aware of it. He told Haughey that he has several other items that he will pursue with the board, i£ he chooses to pursue keeping his job. That suggested to him that if there are two memos here how many others have other board members names. y::' ';� �a::: ., i Haughey said the earlier part of the second memo talks about having `N.;. the color panels set up and inviting the board to drop by any time. � ` __ ._._ _ ___ He felt like he was trying to implement the board's direction, and � that is what he was trying to get across to Stan. �a`.�- Tuite told Haughey that he thought the memo was poor judgement. He �'?. said he needs to hear from him as to what he thinks he can do to bring this board back together as much as possible toward feeling good about him. He says the issue with the Director of Open Space and Trails is simply a budget issue and one that he still wants to ' discuss with the open Space Board. Hauqhey said whatever he has to do to rebuild the trust is what we need to do. Tn his mind there are a few things he needs to do. One he needs to increase his communication with the board in work sessions. Secondly, he needs the board's help of staying in the work sessions at the same time. ' Ireland told Haughey that it disturbs him that he did not contact '. him about retaininq outside counsel. Also, to say that going from a part time open space and trails person to a fu1Z time person for � a cost of $12,000 per year is not correct because Mark Fuller was not working exclusively tor open space. And he should recognize j� this. :'1 ' It was the consensus of commission members that it should be � responsibility of Aaughey to tell the board how he can repair the trust. How they can feel confident that when he has a prob2em or � . � make a mistake that they are going to get a full account of the problem, not a letter from an attorney about notice. � i , � Haughey stated that he did talk to him about the mistake and called - --- him as well. He felt like he needed to get some advice, not �4 �` because of a communication problem with the board, but because of � the circumstances under which it was playing out. 6 - With respect to the open space position, Haughey said the �, ' " calculation he went through was based on allocations. ` '' IIreland noted that he should have communicated with the baard is proposal prior to hiring the full time person.
