William F. Schoeberlein, hereinafter "Applicant" has applied to the Board of County Commissioners of Pitkin County, Colorado, hereinafter "Board ", for approval of a caretaker dwelling unit pursuant to Section 3 -1511 B. of the Land Use Code. 2. The Applicant's lot is zoned AFR -10 and is approximately 4 acres in size. 3. Said parcel is located on 7282 Upper River Road. 4. The Applicants propose to construct and deed restrict an attached caretaker dwelling unit pursuant to Housing Guidelines in effect at the time of building permit issuance for the unit. 5. The Board heard this application at a regularly scheduled meeting on July 26 1994, at which time evidence and testimony was presented with respect to the application. 6. The Board finds that the proposed caretaker unit complies with the criteria established in Section 3 -1511 of the Land Use Code. REQUEST: The applicant proposes to construct a 718 square foot caretaker unit attached to a residence which is currently under construction. The residence contains approximately 4,000 square feet of floor area. APPLICANT: William F. Schoeberlein APPLICANT'S REPRESENTATIVE: Janet K. Schoeberlein LOCATION: 7282 Upper River Road, Woody Creek ZONING: The lot contains approximately 4 acres and is zoned AFR- 10. ACCESS: Access to the property is via an easement for use of an existing driveway off of Upper River Road. WATER: Water is provided via an existing well. Staff has not reviewed the well permit, but notes that it should be verified that the permit is issued for up to at least two residences prior to issuance of a building permit. SEWER: The applicant has obtained approval of an individual sewage disposal system from the Environmental Health Department. The system is sized to accommodate the primary residence and the proposed caretaker unit. REFERRAL AGENCY COMMENTS: Environmental Health: Chris Chiola recommends that the applicant use low water landscaping, and notes that there may be only one woodburning fireplace and one certified device between the two houses. Zoning: Joanna Schaffner notes that the unit contains approximately 718 square feet of net livable floor area. As the Caretaker Unit provision of the Land Use Code stipulates that these units may be up to 700 square feet in size, Staff recommends that the applicant modify the unit design to eliminate 18 square feet of liveable area. Woody Crook Caucus: The Caucus has no objections to the proposed unit, but recommends that the applicant reconsider dredging their pond to provide structural fill for construction. The Caucus suggests that the pond only fills seasonally with wastewater overflowing from irrigation on the Mesa across Upper River Road. Their concern is that if the pond is further excavated, it will produce a hole that will be unsightly and possibly dangerous for nine to ten months a year. The Caucus recommends that unless the applicant can clearly show that there is a water source for the pond other than temporary irrigation runoff, that no further excavation be pursued. This is not an issue that directly relates to review of the caretaker unit request. However, as a courtesy, Staff recommends that the applicant resolve this issue to the satisfaction of the Caucus. Housing: The Housing Office recommends approval of the unit subject to recordation of a caretaker deed restriction. K LJ L; C STAFF COMMENTS: O Compliance with Section 3 -8.13 of the Land Use Code Pursuant to Section 3- 8.13(c) of the Code, the Board may permit an attached caretaker dwelling unit of 700 square feet or less, on non - conforming lots within the AF -1 zone district under the following conditions and limitations: 1. The total floor area of the principal and caretaker unit shall not exceed the allowable FAR of the applicable zone district; Response: A maximum floor area of 15,000 square feet is currently allowed in the AFR -10 zone district. Additional floor area is subject to special review. The applicant is constructing a home with a total floor area of approximately 4,000 square feet. The addition of a 700 square foot caretaker unit will result in a total floor area which is will within the allowable floor area. 2. The applicant shall deed restrict the unit to comply with the caretaker unit deed restriction pursuant to Section 3 -8.13 (a)(4) of the Land Use Code. Response: The applicant agrees to deed restrict the caretaker unit in accordance with County regulations. 3. The dwelling unit deed restriction may only be removed upon approval by the Board of County Commissioners. Response: The applicant agrees to comply with this restriction. 4. There shall be provided one off - street parking space for the unit. Response: One space within the three car garage shall be reserved for the occupant of the caretaker unit. S. Caretaker Dwelling Units must be located in conformance with the standards of the Land Use Code, including but not limited to, scenic and environmental standards and 1041 Hazard regulations. Response: No 1041 Review was required for the Schoeberlein residence, as no 1041 hazards /resources were mapped on the applicant's parcel. As the caretaker unit is contained within the 4,000 square foot residence, it will be perceived as part of the residence and should be compatible with the neighborhood. The residence and unit are well within required setbacks for the zone district. RECOMMENDATION: Staff recommends approval of the request subject to the following 3 uiol e conditions: M 1. SEWAGE TREATMENT AND COLLECTION: Sections 2 -7 and 5 -200: 'It is the policy of the County to ensure that land is not committed to any use and that no use is initiated without adequate evidence that facilities to collect, treat and dispose of anticipated types and quantities of waste water are available or can and will be provided with suitable capacity, quality of discharge, suitable point of discharge and dependability.' The applicant has applied for and obtained a individual sewage disposal system (ISDS) permit through this Department. This permit is for both the main house and the caretaker unit and is sized appropriately. The applicant has met all requirements needed for such a permit. ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2 -6 and 5 -205, 'It is the policy of the County to ensure that land is not committed to any use and that no use is initiated without adequate evidence that a water supply of adequate quality, quantity, pressure and dependability is available to support the use intended.' The applicant has provided proof of adequate water quantity and quality. It is recommended that low water landscaping (xeriscaping) be used and that the timing of any sprinkler systems be decreased for low water plants. The Colorado State University Cooperative Extension office can be contacted for more information on xeriscaping. WATER QUALITY IMPACTS: Sections 2 -22 and 5- 107.2: 'It is the policy of the County to preserve and 'protect its present water resources. To this end it is the policy of the County that no land use be initiated which would )adversely affect the quantity, quality, or accessibility of the County's water resources; or which would occur at the expense of established water - dependent agricultural activities; or which would result in increased salinization of water resources, loss of minimum stream flows, further destruction of wildlife habitat, or major expenditures to reacquire or redistribute major water resources. Schaffner, County Zoning Officer DATE: June 27, 1994 RE: Schoeberlein Caretaker Dwelling Unit Review Parcel ID# 2643- 093 -00 -010 I have reviewed the above referenced application and offer the following comments. ZONE: AFR -10, ten acre minimum lot size This parcel contains approximately four acres and is non - conforming in size. An approximately 4,000 square foot, five bedroom, single family residence was recently approved for this site. The approved structure complied with all zoning regulations. The proposed unit is located within the single family residence and will not affect setbacks, floor area or height. The proposed unit contains approximately 628 square feet of net livable floor area on the ground level, plus a 90 square foot loft accessed by a ladder, for a total of 718 square feet of net livable floor area. This application appears to be within the law and appropriate by current standards for constructing residential units of this type. The only concern that the district Planning Commission has with this proposal is the reference on the site plan map to "provide structural fill by dredging existing pond on site ". As far as we know, this "pond" has no reliable source of water and only fills seasonally with waste water overflowing from irrigation on the mesa across Upper River Road. if this is the case then further excavation of the "pond" will produce a hole that would be unsightly and possibly dangerous for the nine to ten months per year that it contains no water. The Board may permit caretaker dwelling units up to four hundred (400) square feet on non - conforming lots in the R -6, R -15 and R-1 5A zone districts. All such units must be either attached to, or within, the principal residence. These dwelling units shall be included in the calculation of floor area for the property on which they are located, and applicable FAR requirements shall be met. The deed restrictions referred to in A.4. must be adopted and placed on the unit; however, the provisions of A.5 may be utilized to modify these requirements. According to the applicant, the unit is to be less than 700 square feet. The Housing Office requests actual floor plans of the proposed caretaker dwelling unit with the net liveable square footage calculated. The conditions listed below must also be met, and this will satisfy the Housing Office requirements. The applicant shall by deed restriction or other permanent commitment running with the land, guarantee that the caretaker unit shall not be required to be rented; not be condominiumized or sold; be limited to occupancy by not more than two (2) adults, and related children, who qualify as (and have been found by the Housing Authority to be) employees of the community under such guidelines as may be rented for terms not less than six (6) months if rented. The Caretaker Dwelling Unit may be occupied by members of the immediate family even though they may not qualify as employees of the community. "Immediate Family" shall mean a person related by blood or marriage who is a first cousin (or closer relative) and his or her children.
