The Board asked staff to � draft to the executive director to express the Board's concerns � r with respect to the proposed port of entry. - Ralph Trapini, representing CDOT, said the problem is that the $250,000 that CDOT is able to initially able put into this project is e�ctensively to construct a port o£ entry, and he thinks there =' is going to be very little concern over what exactly that port of ! �, entry cost. They are concerned about qetting the money in that � • project and building a four lane templet and moving ahead. He ,� ' suggested that if there are no port of entries in the project, it � _..,___ could raise some question about the applicability of that state � funding that is being used to put one in. Insulating leaky house lowers utility bilis and allows families to use scaze resources for other needs. This service is especially needed in Colorado where our harsh � climate can create a severe hardship on people who can't afford to pay their utility bills. The one � significant change allows smoking at the "bar area" of food service ° , establishments. ;'� PREVIOUS HOARD ACTION: The BOCC passed on second reading Ordinance + 94-09 on April 2b, 1994. . `t:� ADVISORY BOARD ACTION: The Clean Air Advisory Board (CAAB) has not had time to comment on this ordinance revision due to the short time frame needed to put this on the July 12, 1995 agenda. They will have an opportunity to comment before second reading and - _ . . public hearing. However, Tom Smith, Chairman of the CAAB was ';,M1 ___._ .._. __ ;A� notified of this pending action on July 5, 1995. �. , � bI3CUSSIqN: Since the implementation of Ordinance 94-09 there has been discussion concerning the fairness of the Pitkin County Clean Indoor Air Act. The issue surrounds the ability of businesses in unincorporated Pitkin County to compete with Zike businesses in surrounding communities who are regulated by less restrictive non- , smoking ordinances. The claim has heen that negative economic + � � impacts were realized in such places as Redstone. �. � ' During discussions with citizens of Pitkin County, the BOCC committed to revisit this ordinance if surrounding communities chose not to strengthen their no-smoking ordinances to imitate - Pitkin County's. As of this date the City o£ Aspen, Town of " Snowmass Village, Town of Basalt and the Town of Carbohdale have 'i not modified their ordinaces. As the result of this status, the BOCC has instructed this department to draft the ordinance before the Board. During research and testimony for Ordinance 94-09, there was much investigation as to the health effects of second hand smoke (also called Environmental Tobacco Smoke [ETS]) by this department. •`� There will be no repeat of that data at this time si�ce the facts � ;�;; " still point to the dangers of ETS, and no information has come ` • fol-�rard disputing that science.
