RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO, GRANTING AN EXEMPTION
FROM THE DEFINITION OF SUBDIVISION FOR THE CONVEYANCE
BY LINDA J. HARLEM AND BROOKE A. PETERSON OF A PART OF
CERTAIN REAL PROPERTY LOCATED IN SAID PITKIN COUNTY, COLORADO
Resolution No. 77-5(1
WHEREAS, Linda J. Harlem and Brooke A. Peterson are optionees
under a receipt and option contract for the following described real
property in Pitkin County, Colorado:
A tract of land situated in Lot 15, Section 9,
Township 9 South, Range 85 West of the Sixth
Principal Meridian described as follows:
Beginning at a point on the Southwesterly
line of Countv Road whence the South quarter
corner of said Section 9 bears South 39 °41' East
867.46 feet;
thence South 45 031' West 287.04 feet;
thence North 71 058' West 348.82 feet;
thence North 65 039' West 244.40 .feet;
thence North 55 021' East 169.33 feet;
thence South 89 °48' East 382.22 feet;
thence South 45 012' East 100.20 feet;
thence North 42 048' East 111.65 feet to a point on
Southwesterly line of said County Road;
thence South 47 °35' East 33.70 feet along South-
westerly line of said County Road;
thence South 35 051' East 112.34 feet along South-
westerly line of said County Road;
thence South 35 051' East 112.34 feet along South-
westerly line of said County Road to the point
of beginning.

WHEREAS, they request an exemption from the definition of the
subdivision for the purpose of parceling the said property, and
WHEREAS, Harlem and Peterson, upon the closing of their
contract with Robert Plum propose to convey a part of the afore-
mentioned real property to Steven Pruden, and
WHEREAS, the proposed conveyance meets the requirements
of Section 4.02.02 of the Pitkin County Land Use Code making the
grant of the requested exemption appropriate at this time,

NOW, THEREFORE, LET IT BE RESOLVED by the Board
of County Commissioners of Pitkin County, Colorado, that there

be and hereby is granted to Linda J. Harlem and Brooke A. Peterson
an exemption from the definition of subdivision for the parcelling
and conveyance of a part of the aforementioned real property,
which parcel to be conveyed shall be a piece of property of
approximately one (1) acre in size to be more particularly described
by 'a survey to be recorded upon or prior to the sale by Harlem
and Peterson to Pruden.
BE IT FURTHER RESOLVED that this exemption is conditioned
upon the conveyance of this parcel only to Pruden, for the benefit
of his adjacent property, it being the intention of the Board
that the conveyance to be made benefit the property of Pruden
only and not create a separate indentifiable parcel for develop-
ment purposes.

for four ten -day periods this year since Highway 82 has one of the ten highest inci-
dents of accidents in the State. Five cars will intensively patrol the Highway for
ten days. These periods generally coincide with the peak accident periods for the
.highway. The peak accident period for Highway 82 is the end of April and the beginning
of May; that will be the first period for the intensive patrols.
1041 Karen Smith, of the Planning Office, presented a contract between the County and the
Mapping
Funds State of Colorado for the use of 1041 supplemental funds. Pitkin County will receive
$10,000 to be used for mapping. This will standardize the scale of the CSU and other
1041 maps so that they are all of the scale 1" to 1000'. The contract contained a
typographical error.
On a motion from Edwards and a second by Kinsley the Commissioners unanimously
approved the contract as amended.
Peterson- Brooke Peterson presented a request for a subdivision exemption for himself and
Harlem
Subdivision Linda Harlem. They want to sell one acre of land to Steven Pruden, an adjacent pro -

perty owner. Peterson's parcel contains 3.25 acres and Pruden owns one -half an acre.
This will not increase the development potential of either property since they are
both non - conforming uses; it will simply facilitate agricultural use of Pruden's
property and reduce the purchase price of the Peterson property. The Planning Office
recommended approval.
On a motion by Child and a second by Kinsley the Commissioners moved to authorize
the Chairman to sign this subdivision exemption after approval by the County Attorney.
The motion passed unanimously.
Sharkey Sandy Stuller, the County Attorney, presented a request to sue Tom Sharkey dba John
Suit
Thomas Interiors for $2939.33 which he owes the County. When Sharkey did the installa-
tion of the carpeting for the Airport Terminal, the County guaranteed payment to
Berwin Carpets. The County paid Sharkey for the job, including the carpet, but he
failed t4 pay the entire bill to Berven Carpets. George Ochs stated that Sharkey has
acknowledged he owes the County the money but won't pay.
Kinsley moved and Child secoded to authorize. the County Attorney iu sue. The
motion passed unanimously. (Edwards was not present.)

RE: Peterson Subdivision Exemption

This is a request for subdivision exemption by Brooke Peterson and
Linda Harlem to sell one acre of land to an adjacent property owner,
Mr. Steven Pruden. Mr. Peterson's parcel contains 3.25 acres; Mr.
Pruden's one -half acre. Mr. Pruden desires the additional land for
use as pasture. Both properties are developed with a single - family
house ( the old Woody Creek Schoolhouse). The property is zoned
AF -1 (10 acre minimum lots).
The exchange of property will not affect development potential for
either site and will facilitate agricultural use of the Pruden's
property and reduce the cost of purchase of the Peterson property.
The Planning Office recommends approval of the exemption subject
to recordation of a recorded survey of the revised property lines
together with the Commissioner's Resolution in the office of the
Clerk and Recorder.

As you know I am making this application on behalf of myself
and Linda J. Harlem for an exemption from the definition of sub-
division for a parcel of property we are buying in Woody Creek.
We are the optionees under a receipt and option contract for
this property which is presently owned by Robert Plum. This
parcel contains approximately 3.25 acres plus a single family
dwelling. We would like an exemption from the definition of sub-
division so that we might sell the property to Steven Pruden
simultaneously with our closing with the Plums. Mr. Pruden is
the owner of a house (the old schoolhouse) which is continguous
to our land.
Mr. Pruden desires this one (1) acre solely for the purpose
of obtaining some additional pasture land and we are willing to
covenant to that effect. His lot is at present quite small and
the addition of this acre will make the lot more conforming to
the present zoning in this area, A.F. -l.
This exemption will not increase the density of the area as
Mr. Pruden does not desire to create an additional building site,
nor would it increase the land use impact of the properties.

I have enclosed a rough sketch plan of the proposed division
which will be finalized when the survey of the property is made.
I would be more than happy to answer any questions which you
might have concerning this request, but I do believe that the
request is both reasonable and that it clearly meets the intent
and purpose of the county requirements for exemption from the
definition of subdivision.
