This is fourth �?:`"` ;:� reading of the Rurai and ltemote Rezoning consideration. i. .` ;�.;::�'; Three planning areas comprised of sites that were classified by the Assessor's Office as Agricu[tural and had been � "" � ' historically ranched have beea removed from the Rura!and Remote Rezoning considerauon. Consideration of y` � �` agricultural lands will be handled in a different manner. Work sessions have occurred on this matter and more �<�``�'-" w meetings are expected. �,; =: � �:�. Suzanne Konchan noted that properties within the Crystal,Prince Creek and Capito!Creek Planning Areas,are not � a portion of this ordinance. They aze not a part of the 4th reading adoption and they aze under a different �'ryi � oonsideration. 1'his also holds true for a portion of I.enado and they are all headed off in their own,special �� � planning azeas. t n � Suzanne Konchan note@ ordinance conditions which were endorsed by the P&Z,refinements to the accumulation '`, � criteria,a new section which was added to the rural and remote district that allows properties to accumulate floor ,�� area and build lazger structures if they meet a certain criteria. There was much discussion about what accamulation � formula would apply for properties that would seek to go through this process.The Planning&Zoning not forward - a specific recommendation as to how many S.A.per 35 acres they would endorse in an accumulation formula. � Many agricultural ranch lands were still being wnsidered for rurai and remate rezoning and this is how this criteria began to develop. Since agriculWral lands were taken out,the accumulation provisions aze still in the proposed ;,� reguiations. The concept is to allow more square footage on a 3S acre formula to encourage people to cluster ,;� , development on a pazcel located in the rurat and remote wne district in order to meet the ctiteria. There aze . unresolved issues xelative to what needs to be in the ordinance. s Suzanne Konchan discnssed some of the revisions which have been incorporated into the current draft of the i ordinance as a result of the P&Z hearing. � It was noted that Tom Cazdamone made a presentation before the Planning Commission on impacts of residendal _ � development in alpine and subalpine azeas. 1 � . �r Suzanne Konc6an expiained that P&Z and staff recommend that the uses of leach field wells and sepdc systems, � � water wells and new driveways,which are now generaily prohibited uses in the RR area,should be moved W t1 allowed uses if they aze below the subalpine line. � A chart was prepazed which shows what the RR district allows in terms of house sizes,footprint limitations,decks, � � ' . � porches outhouses,and mechanical buildings. Different dimensional standazds have been developed for unrestricted � units and RO units. It was noted that public input indicates that additional storage is needed below frost-line in RO units. More squaze footage wouid be aliowed for RO units as a result of that input. Suzanne Konchan discussed the additional square footage which has been proposed. There is a two tiered set of restrictions. Non-restricted � . 1 units are proQosed to be 700 S.A., while restricted units would be 1000 S.A. 5taff put together five issues for P&Z • ;�;•, consideration which were commented on and are being offered to the BOCC tonight. They could come in and asked for as much as 50 percent �`.x'•-� � additional S.A. -P&Z unanimously opposed the concept. They thought it would resuit in an incrementally t r lazger house in these critical areas with more population and more impact co the back courttry and it would �%'t be more affective and less arbitrary to set a specific standard. Planning Office has a mixed feeling on this �•_ - --- issue. "''�' ! � • Increase in allowable structure space- House size 800 S.A.to resuicted units and 600 S.A. for �`' =,;•,,_ • � unrestricted. Staff proposed to increase unrestricted units to 1000 S.A. and restricted units at 1200 S.A. P&Z did not suppoR increasing the standazds based on the ecological impacts of deve►opiag in the rural and remote areas and because of tha difficulty of providing emergency services to these azeas. - ..,`7 . • Given the new technologies that continue to develop the need to have your sewage facilities in a separate . oufhouse will become less necessary in the future. These systems can be contained within the house. The same is true with mechanical. With the continuing advances in solar technologies and other alternatives, -�!< people will probably be ab(e to build these cahins without rreedirtg the mechanica!space. Suzanne Konchan began discussion of TDR. Receiving azeas have been identified. An issue ihat was unresolved at €� the BOCC and P&Z was asked to comment on was developing a receiving azea for the Frying Pan Val[ey rural and ,� � remote area. This azea is exempt from the GMP. All of the propeRies in the Frying Pan Valley, if subdivided into 35 acres,will result in a potential of 28 � developments. Accumuiadon will be able to apply. Staff]ooked at three areas outside of the limits of the Town of ��• s Basalt. The Planning Commission and staff ace of the opinion that the one mile boundary is the more appropriate � � starting point for determining a receiving area. Staff did not feel Section 36 was capable of receiving developmenk -. � The area doser to Basalt was more appropriate. i �_.___� , � Suzanne Konchan noted for the record that there are two property owners voluntarily asked for rezoning to rural ';. � and remote rezoning,the Balcomb Stevenson group and Golden Age Resorts at the Townsite of Rubey in the Independent Pass study area. Their options for transferring development rights out of their properties was the , reasoning behind the requests. , , � Suzanne Konchan noted that the Code allows for a request for TDR by special review and it is exempt from growth ' € management, Golden Age took advantage of this process. Another 1'DR was doser to the metro azea and is f located at the Urchel site. Suzanne pointed out that the TDR program is an important aspect of the rural and remote �� i s zone district and may become an important part of the Agricul[ural legislation. ��` 4 n , - For the purposes of adoption of rural and remote rezoning at this time,while admitting that more work needs to be 6+ ; ; done on TDRs,and in an effort to put more boundaries on this so that the public knows what to expect out of this � � program,staff proposes to allow two times the structurai altocation in the wne district,no matter what the number f ends up being(Suzanne has assumed it to be 1000 S.A.). ', •... ��'t , - Staff looked up information on average sizes of all of the housing units that the Pitkin County Housing Of6ce has in �:" '�� its inventory. Most all housing units aze close to Aspen,have water and sewage and have access to emergency ' ' services. The average ownership units is 937 S.A.,and rental is 670 S.A. !` i .:;, : '�•: ` # Suzanne Konchan noted that the P&Z was asked to do site'visits. The Planning Commission will make 6me in their .• ��- _- _ __.� schedule to accomplish site visits if the HOCC decides to go that route. �,�,: �;:`-+> 3uzanne Konchan noted that the Ryan pazcel,in upper Castle Creek, was discussed at length in the first and second ( .;, � reading meetings. Excluding that bisected property should be reconsidered. P&Z supported the staff's suggestion C 3 that this property be removed from rural and remote. The upper Castle Creek vafley has not had any master E planning done W it. The Castle/Mazoon planning group that devised the consensus statements,committed to doing � _ master planning of that upper valley area. Staff and P&Z adds this to the list of needing more planning efforts. � i • a Two letters have been received,one from Betty Lamont and one from Stanley Dearhammer,requesting a special heazing regarding their properties in the Frying Pan valley. The BOCC was to hear from them at the meeting �" today. �f j.'r i Bob Child suggested limiting the receiving area for the Frying Pan,or excluding the upper valley market should be � considered. i` f Suzanne Konchan noted that this was discussed at the Boazd level. She is an advocate for making the receiving f I areas as large as possible for all of the rural and remote azeas. She ran into some resistance from BOCC�mbers �� � and the P&Z about the upper valley area being able to absorb all of the development rights from the Down Valley Area. Since there is still a Special Review ability,cumulative impacts can still be looked at. , - Suzanne Konchan noted that there is a potential for 173 development rights in total based on a 35 acre pazcel size limit. How many of those might seek a TDR is difficult to predict and,if a 2000 S.A. formula for each TDR is incorporated, it begins to put boundazies on what that 173 might mean. There aze competing issues with the Metro. area,the City of Aspen,population caps,and the AACP. Jennifer Craig was offered ffie opportunity to comment and declined at this time. A---- R.St.Andrew noted that the people who had land in the 60s and 70s,and still own it,love it and they take good � care of it. He explained now the zoning is being changed on them. He wants the BOCC to give people who live �i in the subalpine area the opportunity to take care of it themselves. � Pat Fender is from Emma. She believes there is already a lot of crowding in Basalt and in Aspen. She questions ` putting the 28 houses in the 1 mile area around Basalt. She thinks 28 houses spread out is more reasonable. She � also did not think that restricted housing sizes is a fair compazison for determining acceptable house sizes in the � free-muket. She asked how much Pitkin Counry has spent in the last five yeazs on lawsuits resulting from planning ;�, and wning issues. She knows that lawsuits will result on these planning issue. �.' � � ;�:- i Iudy Wyse asked the BOCC to restructure the RR zone. House size and TDRs are not the only issues and this is a 5 j���° significant change for the owners in the Frying Pan Valley who will be giving up property. Bob Child explained that there was a commiunent to have a meeting in the Thomasville and Redstone azeas to (7 discuss those areas. That commitment was made and this has not been tost track of. �1 f , ' ' Carol Craig has not been notified of any of the meetings and she is included in the rural and remote consideration. � She feels she has a right to have been notified and with enough advance notice to be abie to participate. � � ' Suzanne Konchan noted that Cacol Craig's property is not proposed for rezoning but she has asked to be notified of � these meedngs. She is to be notified of the meetings on agricultural considerations also. S ' ;: Tom Witfison is in Coal Basin and received noti£cation of RR. He asked if they aze in the RR zone district.He told the BOCC he was not notified of the cancelled Redstone meeting. Suzanne Konchan noted that a translator message was put out. � � � . . Tom Willison believes that the rural and remote is a bad idea. '< Doug Unfug is in favor of the rural and remote legislation being consideted. � Mazk Neislanik agrees with Jack Arbaney and believes that everyone needs to stick together and reconsider rural and remote altogether. He suggested that the BOCC needs to sit down with the peopie who own the property W � work something out. He asked for a group work session so that something can be worked out. He believes this � -�-�- process should siar[over. Ms.Dearhammer read a letter which she submit to the record of the meeting. � � Ellen Hunt futty supports the participation of the long-time residents. She is concerned about TDRs not 6eing in place prior to initiating this legislation. She wants everyone W work together and she asked that the BOCC support , the long-time residents. Paut Taddune would like an oppoRUnity to offe�camments at the end of the meeting. He believes this legislation is iaational. He believes the BOCC is choosing the wrong battle,the main reason of which is the people don't j understand the rationale behind the proposed legislation. If it is downzoned, a trade with the Forest Service may be impossible. °�.*;�'•?: Bob Perry said Paul Taddune stated his thoughts fairly ciearly. He ques8oned the ordinance's legality. `' � . �.:�.o,,. Roz Turnbull explained that you need to realistically look at what is being offered. She spoke about the raptors'use �F�� of trees being transiated into no cutting of wood on your property. She explained that this legislation has taken on � ,� ., . � an unprecedented direction. �:: . k,:". � R.H, Nea(does not like what is going on and he contends that bureaucracy is taking ovec f �� � Wilk Wilkinson is adamantly opposed to the proposed regulation. He believes this has been rammed down ' Z everyone's throats and he believes this constitutes a taking. Dan Shipp has had an opportunity to work with the vast majority who aze present ronight in opposition of the rural � and remoce legislation. The people of that committee has asked Dari Shipp to convey their feelings. These people > dodt believe that the BOCC gives a hoot what the people have to say. He also contends that the ordinance is w;'� unconstitutional. He noted that he had suggested to John Ely,who believes this is constitutional,to get an opinion -.', on the matter. He thinks the County should look at the value of the open space in the back country versus the - potential cost from the litigation that will ensue as a result of the ordinance as it is currendy worded. At least 100 people will participate. The attorneys for the Lucas case,who betieve this ordinance is unconsdtudonal,have � agreed to represent the people on a contingent basis. He contends that this will result in the financial collapse of the �s, � County. ,, i Jim True suggested changing the ordinance to make individual water wells a special review use. Discussion ensued. � ''� �i - ,1 A member of the public strongly opposed the rural and remote rezoning. She believes that it will severely decrease ,, ptoperty values. She believes this legislation is an attack on owners' constitutional rights. - � Chris I.everich,a real estate broker in town,can attest to the stigma that is placed on these properties and the lack ' � of interest in these properties because of the concern about highest and best use. He is wncerned about the � , • ! chazitable remainder trust. It will be difficult to ascribe a value to these lands. It will cause people a problem to �, even develop a property in a minor manner. Ae spoke about the size resuiction. He noted that power supplies can be placed nnderground. Simplicity - versus special review is importan[. He believes that special review does not show any good faith. A shor[debate ensued between Russel and Mick Ireland. : S.. Bo6 Perry suggested that a limitation be placed on development to require the developers to purchase TDRs. r .��:... .: .;,n. Bob Child noted that the reason for this ordinance is more than a growth issue.
