Staff has been provided a summary of changes. He used a few pages out of Glertn Horn's memo �.� � to remind the Board and members of the public what the changes are. Tim explained he will discuss the ,_,� changes, then briefly discuss the applicanYs proposal with respect to the amendments artd the proposal for _ AH. Tim Malloy believes the AH iegislation has some problems related to the current AH/RO legislation , ` being considered by the City. �:;,a; � Rela6ve to the Thunderbowl neighborhood area,while staff believes there are significant improvements, r they have concerns which still exist in the area of the upper three lots in the Thunderbowl neighborhood. �''} ( Tim explained that the buildmg enveIopes have been shifted down but they aze roughly in the same location as before. The east properiy has been shifted away from the ski area. While sfaff thinks this is a positive t improvement to the plan, he believes a site inspection is�warranted to determine the amount of egress for : skiers before a staff comment is forwazded. Tim explained that there are s611 some very small azeas impacted on 30 percent slog�s. He is less concerned because quite a bit of the area involving 30 percent v� . sIopes has been removed from the proposal. He mentioned that the staff pzoposaI reduced the number of lots by 4 in fhis portion of the project,rather than reducing by only 2. � The Muoon neighborhood has been reduce�to 16 single-family lots. Several lots have been reserved for possible TDR potential. Tim discussed a boundary of blue avaianche zone. Tim explained that Lot i requires access through that blue wne,although the building envelope is pmposed to be located outside of �, the zone. Lot 4 is next to a blue zone. The applicant's drawing stiii inclades Clazk Lane which gces � � """_;— thmugh the upper portion of the property. That azea crosses steep slopes and unstable soils. Staff's proposal suggests that the development be kept lower on the site to avoid steep slopes and unstable soils. � � Tim Malloy discussed the rezoning proposed. Staff supports the change in request for rezoning which has � � greater reduction in lots. � - ' Tim Matloy discussed the Village Core changes proposed. Tim noted that staff has been comfortable with j' . the Viltage Core throughout the process. Tim discussed the music students' use of the dorms in the i summer. He nated that the applicants propose that music students who have no vehicles will be allowed to ;. apply for housing at Highlands. Several questions were raised about the use of Tourist Accommodation units. At this point in time, staff - i has not crafted conditions of approval on those units. The units are currently proposed to be manageti ��`: Isimilazly to those in eacistence at Tfie Gant. ` ` F Y+� iMick Ireland discussed the square footage to be designatetl as TDR square footage. •• IGlenn Horn explained that BOCC approved restrictions would be established as to how the TA units would '�y,�. be used. They want to assure that TA units will remain TA units. 1". 3im True asked about the breakdown of Category 1, 2, 3 and 4 units. Glenn Horn directed the BOCC to 4� look at a table in which the unit mixes are described as foliows: 29 Category 1,Dorm units; 8 Category 1, one bedroom flats; 8 Category 2, one bedroom flats; 28 Category 3, three bedroom town home units;2 Category 2, two bedroom.flats; and 23 Category 4,four bedroom single family homes. ; Bob Child questioned staff about the AH zone district and if staff feels the Code is being compromised. �;i�''� 1 Staff did not indicate that the code was being compromised. Tim Malloy was also not concerned about 4 others coming in with the same type of requests. Glenn Hom explained that they ue trying to comply with where the Community is going with the AACP and the 60:40 population mix. The applicant was wncerned about going with a straight AH zone because the proposed codified version for the AH zone is quite old. Glenn Horn explained AA said that tradirional zoning doesn't always fit for ski ueas and that you need to take a more flexible approach. Glenn explained that he is concemed about the 6me and effort that it will take to create an AH wne district at the base of + 'a _,� the ski azea. The azea and bulk requirements and use requirements aze already there. The overlay only ; deals with the 70:30, 60:40 mix. I GIenn Hom expiained that if, in fact, tfie AH zone goes in the direcdon where the actual population mix is . 7034 rather than 60:40, some consideration should be made in the ra6os because of the high land intensive a- , ' single-family affordabie housing units being proposed, � Glenn Horn spoke hypothetically about 4 free mazket residences in a project. The code says the calcu]adon }'� to come up with an employee generation figure is as follows: .33 x 4 = 1.32 employees. In the AACP, �� � you use a 60:40 rdUo. If you apply 4 free mazket plus 6 units in AH you get 10 people. That is a 60:�0 ;#. # project. What this suggesu is that if you have four people living in a free market component of a project, ' , � } it will generate 6 employees. The response should be that the AACP is not impact based. Highlands intends to house 245 employees. The ;�� ; applicant is proposing to house 98 employees in excess of that which is required by Code. Glenn Hom - �';.-.r,-y suggests that the character of the AACP concept is covered for the 60:4U mix and the code is covered also. • Glenn Horn explained that he does not believe that doable dip is an issue. � -' _ ( Discussion ensued on the 60:40 and 70:30 population mix and wfien the appIicant became aware of this i being discussed. i.`':w: '- i�:,':: .___'-. ... ._ f�.. . Bill Ayres explained that he understands that the previous objecdves have been addressed by the applicant. � � He urged the BOCC to move forward with this project to Detailed Submission. w: . A member of the public asked about the employee generation and he suggested that the applicant's proposal � • almost doubles the.33 multiplication factor. Even if the figures are one-half of what they should be this " � project sGll meets the 60:40 needs. He suggested it is rime to move on. � � A member of the public, named Bob,explained that he is concerned about the debate which conlinues on # items which are not part of the code. It is a deflection and waste of energy to debate items that are noY I� ; part of the Code. He urged the BOCC to move on. f Mick Ireland responded that the applicant has asked for changes to be made in the Code and therefore the � public has the right to discuss what is appropriate for the community. � Rick7ones is a neighbor to the project. He stated he represents severai neighbors that are going to be affected by this project. Rick contends that there are dramadc changes being asked for here. Under the code,33 feet is the maximum height. The average height in this project is 40 feet. Whip 7ones'original � project requested a variance of only two percent. The actual rewning request has changed, an overlay AH is being requested,popula6on mix is changed from seasonal to year-round. The Mazoon neighborhood has changed. Total non-exempt squaze footage rather than total square footage has been affected. Density and mass was a huge issue before the compromise was raised. Rick contends that[he reducfion of 2 percent is ; ; not much of a change, thaf conversion is sGll an issue,and that economic jus6fication for the rewning + � request has not been dropped. Rick suggested that the BOCC needs to decide if the Planning Commission ----- should review this project under the old or new code before remanding it back to it for review. He prefers , ' ? the review under the new code. Rick looked at the Castle Creek/Maroon Creek Caucus documentaGon to determine what the"black box" theory was. The documentation was missing. Rick Jones brought up construc6on impacts. He wants the change in use and population mix to be reviewed by the Planning � � Commission. Rick spoke about the Castle/Maroon Creek caucus' request for a moratorium on development j • in the area un61 the intersection of Highway 82 and Maroon/CasUe Creek roads was addressed. Mick Ireland explained that the employee housing situation is desperate. 'r Mick Ireland explained that at a previous meeting, traffic midgation and pazldng was discussed and the •;"� ---- - - BOCC asked that the applicant wme back with a proposal that works. r':`� ,::!: H explained that you have a base vi(lage, restaurant space,retail space, TA units, residentiaI units and AH �`�` " - � units. Each have specific requirements for parking. He suggested that the ski area needs to be bifurcated i` from the base review. He explained that 292 spaces will be eliminated. What is going on in front, is the parking for the uses in the Village. There will be 170 spaces . � there. There will be one space for every TA unit. People in TA units have a teadency to use public transit � more often and the van shutfles will also be used. The transit demand management measures will promote � the idea that the TA occupants will not need cars. 1 I � Tim Malloy commented that he thought the amount of parking for the AH units is low. The applicant + • concurs with this noting that only one space per unit was proposed. H suggests fhat 1.5 spaces are needed ' and there will be 69 spaces in the village parking area designated for AH. He explained that there aze 38 spaces left over for the retail and restaurant uses. The Code requires,for non-residential or commercial � space,there should be one spot for every 400 s.f. of restaurant or retail space. If this is applied,74 spaces � are needed. The applicant only has 381eft over. H suggests that one space for every 400 s.f. of retail. and restaurant doesn't apply to a project like the Aspen Highlands Viltage. H contends that it wiil be too . difficult to go out and shop or eat unless you are already there. People will be deterred by a pazldng fee and the deterrents for access. s Tim Malloy noted his concems about separating the parldng for the ski uea from the parldng of the base � village. He contends in certain issues,both projects need to be considered jointly. Tim explained that i • while a reducfion in the initiai access capacity indicates a reduction in parking stalls would be acceptable, a- the Master Plan for the mountain indicates a confinual increase in skier visits. He also believes that there _ -- ---=- � �� will be an increase in slders because we will see a better ski mountain. Jim True suggested that increase in transit rather than increase in pazking is what should be discussed. � ; � Mick Ireland explained that no one knows what the entrance to Aspen is going to be, there is doubt about ; : funding and how it would be done,and the general agreement is not to spend money on an intersection that might be bulldozed shortly thereafter. Mick contends that the real solution, or one of the most important, ' � is to bifurcate Mazoon Creek Road from CastIe Creek Road and to create an intercept lot on the"Podolak" property. Mick discussed the 600 spaces proposed for Buttermilk.
