REQUEST: Approval of an existing satellite dish which was
installed without County review.
STAFF COMMENTS: The applicant is requesting approval of an
existing satellite dish at 0120 Letey Lane, Woody Creek. Staff
has the ability to administratively review the request pursuant
to Section 6- 6.1(f) of the Pitkin County Land Use Code. This
section also refers to visual review pursuant to Section 5 -105.2
of the Code. Staff makes the following findings relative to the
proposal:
1. The dish is located 50 feet from the south property line and
55 feet from the western property line.
2. The dish is visible from homes on adjoining properties to the
south and west. The applicant indicates that adjoining property
owners, with the exception of one, have no objections to the
location of the dish. The neighbor adjoining directly on the
south has submitted a letter of complaint to the file. The
neighbor objects to the silver screen material and the reflective
nature of the material. The dish is also visible from Highway 82.
The dish is not visible from Woody Creek Road, as there are
mature Cottonwood trees which screen it adequately.
3. The applicant proposes to screen the dish with berming on the
south and west. The applicant also intends to plant clusters of
Aspen trees along the property fenceline on the south and west
boundary lines in the vicinity of the dish in order to screen
views of adjoining neighbors. Planting and berming are to occur
no later than June 29, 1991. Finally, the applicant will be
requested to paint the dish a charcoal grey color in order to
lessen it's visibility from the Highway. The paint is to be
lead -free. Painting is to be completed no later than June 29,
1991.
4. Given compliance with the visual screening techniques
addressed above, the application generally meets requirements of
CJ0Jv2
Section 5 -105.2 of the Code regarding visual concerns.
RECOMMENDATION: Approval of the satellite dish placement subject
to the following conditions:
1. The applicant shall screen the dish with berming on the
south and west sides of the Aish.
2. The applicant shall plant clusters of Aspen trees along the
property fenceline on the south and west boundary lines in
the vicinity of the dish in order to screen views of
adjoining neighbors.
3. The applicant shall paint the dish a charcoal grey color in
order to lessen it's visibility from the Highway. The paint
is to be lead -free. This condition shall be complied with
unless the applicant is able to document the claim that
painting the dish, in a manner recommended by the
manufacturer, will damage the operation of the dish.
Documentation shall be accepted in the form of a letter from
the manufacturer and /or in the form of published material
produced by the manufacturer.
4. Planting, berming and painting are to occur no later than
June 29, 1991.

Regarding the color of the Britvar -5 ulsn, iL was determined at
the time of their review that the dark screen was preferable, in
terms of overall visual impact to the surrounding environment.
As a result, they will not be requested to paint their dish to be
less visible in the snow.

recent satellite dish approval, the following condition continues
to apply:

Attached please find a letter from the supplier of our Paraclipse satellite
dish concerning the affect of painting the dish on its performance and its
warranty.
In addition, it has come to our attention this winter that, in fact, our
dish, with snow on the ground as a backdrop, is not clearly visible. However,
the Britvar's dish, situated directly in front of our living room window, is
black. Against the white snow it could not be more visible. We demand that
the Britvar's dish be painted, to be less visible in the snow. Their dish is
of a lesser quality than a Paraclipse and painting will most likely not affect
its performance or warranty.
In addition, to date, one dead tree is all that has been done to lessen the
affect of the Britvar's dish from Highway 82 and from our living room windows.

The Pitkin County Zoning Department has noticed that a satellite
dish has been installed on your property at 0120 Letey Lane. The
Pitkin County Land Use Code requires that an application be
submitted to the Planning Office and approved by them. for the
placement of satellite dishes.

Dear Ellen,
I am writing to request a permit for my existing satellite dish. The
placement of the dish is within the required set backs. Please see attached
a copy of a recent survey plat with the exact location.
Upon completion of the construction of our home, we intend to lessen the
visuAl impact of the satellite dish through the use of earth berms and the
planting of trees. The trees will be integrated with the berms so as to
provide a natural setting.

I am writing in response to your letter of 28 August 1990 rgesting additional
information regarding our satellite dish. Following is a list of items to
complete the application:
1. 0120 Letey Lane, Woody Creek
2. Our lot is completely flat. There are no existing hills or trees to
presently shield the dish. However, our surrounding neighbors (Hagmans,
Andersons and Uyeharas) state that they have no problem with the dish. The
only surrounding road is the road which we own and winch runs through our
property allowing our neighbors access to their homes. (The Britvars chose to
put in a secad driveway into their property directly down our property line to
ruin our view across the meadow. They had an already existng and very good
driveway serving their property). We intend to use evergreens and Aspens as
plant materials to mitigate the visual impact of the dish. The height of the
berm will be as high as possible without looking out of proportion to the
surrounding terrain and at the same time attempting to mitigate the visual impact.
This height can only be specifically determined when we are in the process of
berming itself. The dish is a 12' Paraclipse with natural metal color.
3. Berms and trees will surround the dish in a semi- circle.
Next spring we intend to do landscaping and berming on our entire property with
trees and berming throughout. This will also mitigate the effect of the dish by
breaking up the flat visual field of view which now exists because of the natural
phenomenon of the "flat" lot.
Our spring landscaping will also attempt to mitigate the impact of our neighbors,
the Britvars, dish on us. Their dish is located directly in front of our living
room /dining room windows. They have six acres on which to locate their dish and
chose to locate it where it was most visible to us. They have done no berming.
They planted one dead tree in their contemptuous "attempt" to mitigate the visual
impact on us.
And, our spring landscaping is intended also to shield us from the piles of

trash, junk trucks filled with old tires, gas storage tank, metal scaffolding,
piles of flagstone, old lumber, cement mixers, gas cans etc. etc. which the
Britvars have purposely piled on both property lines - our property line and
the Hagman's property line.

Dear Ellen:
This letter is in regards to my concern about the location
of the Roberts' satellite dish located Letey Lane, Woody
Creek.
As we discussed previously, I am living directly in front
of this dish. The dish is a silver /white color and reflects
sunlight. The dish is located at a point where it is not
only visible from our property, but from all other adjoining
neighbors properties as well.
Aside from the visibility of the dish from our properties,
it is also PLAINLY viewed from Highway 82. I was going to
the Dump the other day and could see the satellite glaring
on the Roberts' property from high on the Dump road.
I am protesting the location of this dish. It's appearance
is far more offensive than the commonly used black -color dish.
The Roberts should either paint their dish a darker color to
blend with the natural color of the earth, or have a coiner made
for it. Preferably the dish should be relocated to the other
side of their property. If the dish was moved to the other sale
(east) of their property it would be a lesser eye -sore for us
and would be only slightly visible from the other neighboring
properties. Further, on the east side it would not be visible
from the highway.

as requested, providing further documentation and data "that painting the
dish, in a manner recommended by the manufacturer, will damage the operation
of the dish." I stress the fact that this letter is from the manufacturer of

Dear Ms. Roberts:
You have inquired about the advisability of painting your aluminum, natural
finish Paraclipse antenna. I cannot recommend this for several very good
reasons.
In the first place, we sell both natural finish and painted antennas and the two pass
through two entirely different production lines in their finishing stages because
the require dramatically different finishing procedures.
Natural finish antennas are specially treated in three different baths to smooth and
"toughen" their finish to withstand the elements; an acid bath, a neutralizing bath
and a cleansing rinse. This finish is exactly the opposite of what we need for a
painted antenna.
Painted antennas are put through an entirely different set of chemical sprays to
etch and "soften" their surfaces in order to enable paint adhesion. These antennas
are then dried and pre- heated in a 400' F. oven to prepare them to
electrostatically receive a coating of dry, powdered paint on the etched, very
warm surface. The antenna is again passed through the oven to melt the dry paint
and cure it onto the surface, assuring long lasting adhesion to the metal and a
durable finish.
Secondly, should you attempt to paint over an antenna that was prepared for a
natural, 'toughened" finish; you will not get the adhesion you need and your
finish will not stand up to weather or time. It may look good after it dries, but
you will shortly have an eyesore that neither you nor your neighbors will
appreciate. A., /j
