rates going up. However, their access to the airport is becoming 'i
more and more difficult. A2so, they use to be able to go curb
� side. Now they have to possibly walk people across three lanes of ,?}
E traffic to get to their vehicles. Also, their bus permits were
transferrable at one time and now they are not.

Joe Wells has read over the map and there is one area that is not
-.� in compliance with the mapping. She said the intent was to keep
---• the original boundary of the Little Annie area. There is one area
that overlaps this area by a half of a section, which would have
eliminated a portion of the rural and remote district in the
! original Little Annie zone district. So they would recommend that '�
+ this be amended to maintain the oYiginal Little Annie zone district
� and revise the written description in the ordinance for the �
� Maroon/Castle Creek area to basically jog around the south half of ; '
Section 18 to be in compliance with the original rural and remote
i zone district.

Ethridqe thanked Betty Lamont for takinq the time to show him her t�i;,���i�
property. He said he was hoping, after the site visit, that they �.";�

could come to some compromise on this issue. But after reviewing }, :;'i-,,
• the elevations with staff it looks like her property is between c :._���
�! 9,000 and 9,500; about 9200. Although he was hoping to find a way �±�,;� .
� to adjust that, but he can't in good conecious and in fact he has s;:?:: �
' advised the board that it does meet the criteria and without
exemptinq the Frying Pan, he can't recommend that her property be ��.`�-" �

Dan Shipp presented�lette�, written by him, and asked that a��e �'

� He told the Board they should be commended about the thoughts they `-��'
have about tryinq to restrict development here in the valley. He :�;i� _
said the problem they have, as property owners, is the method the „
board has undertaken to restrict that development, which is
prohibiting them from using their properties in manners that they '•-'
felt were appropriate. They have requasted on numerous occasions ����i�.
that a nationally recognized scholar review the ordinance that they �;
! are about to pass. He said their concern is that the Board might � �?
be causinq a bigqer catastrophe in Pitkin County by passing this
; ordinance then by allowing that development.

Shipp said there is going to be an action which is qoing to filed
k as soon as the Ordinance qoes into effect, against Pitkin County 8;
� to compensate the property owners for the damage that they are ��~-
; going to suffer as a result of this Ordinance. If they can prevail '.".,i"�'`
fin that action then the damages are going to be enormous because i:
, of the tremendous amounts of property involved. He said they would
. ask, at this last moment, to take the time, and spend the $2500 or
$5,00o it is going to take to get the proper legal opinion about
the constitutionality of this ordinance before it is passed.
Wilk Wilkinson said as part of the Board upholding the United
States Constitution, they also uphold the Federal Statutes and the
Federal Code. This regulation clearly violates the federal �;
i, statute. The Board is taking this move in blatant opposition and

blatant defiance oP those regulations. It is discrimination and
makinq the burden fall upon the remaininq patented mining claim �,;�
holders in this community and this county, and the holders have
suffered the economic loss so that this county can preserve open
, space to the rest of the public and the tourists that come here, ' •
and he thinks this is outrageous. ,' '
Wilkinson proceeded to read into the record a list of patented �,
� mining claims which this Board of County Commissioners and previous =�.

There have been numerous changes to this ordinance based on citizen I

� He said the spirit of this ordinance is in keeping with the long
_ � American tradition of zoning. The idea behind zoning is
� compatibility of neighborhood and enhancement of overall community
values even thouqh that may sometimes be at the expense of
e individual property owners. He believes in a system that protects '
� the values in a neighborhood from the impacts of a totally free �
S unfedered market place.
Ireland said the neiqhborhood that is being rezoned tonight is a
� somewhat historic act, is a neighborhood that already does have
substantial community value. The neiqhbors for many of these
isolated mining claims are recreational users, wildlife, and the
ecosystem. He does not think this neighborhood, that has ,
traditionally fostered this community's recreational and f •.
environmental values, be subject to suburbanization, which is the
ultimate impact that will occur and has begun to occur in many of
- ---— the high country areas as land values have been driven up in the
' i valley floor and people are beginning to look at the isolated areas
� for luxury home developmant. He thinks those values deserve some
protection, and he thinks this ordinance does that by reducing the
� development to an appropriate scale by providing those owners of
claims with a valuable transferable development right. He believes
it is perfectly appropriate for a rural and remote parcel to have
� a one thousand square foot cabin or to have the right, to in effect
� under this ordinance, create 5,000 feet of development on the
valley floor. Those ara in a rough balance. The impacts of 1,000
square feet at 9500 feet are somewhat a kin to a 5,000 square foot

suggestion from the board as to how to proceed at this point.

Fred Smith, representing the Aspen Skiing Company, stated that he
thinks this particular aspect has merit. It is one that was j ,
discussed at the last meeting when wa all concluded that it has .�
` some value to it. His particular approach to it would be somewhat

Buttermilk lot and the 195 spaces at the Stapleton lot would be �

If they thought that Buttermilk West and Tiehack is still going to

two year period, they would be able to decide rather than 195 there

Commissioner Ireland said if it wasn't November 15th there would �
be time to work that out. But he thinks what we are faced with is
� an interim solution, and he is not ready to go beyond what staff
.<.:J is recommending here.
Smith said the problem with the interim solution aspect without
some permanency, is that they are being asked to make some �
- significant capital improvements to the area to accommodate a
through-way for the homeowners. Also, they are beinq asked to
� diminish the number of existing parkinq spaces and locate them on
land that they do not own. In the event that the interim solution
is not chosen, when the interim time period is over, and that the
� property owner Mr. Stapleton, is to decide he doesn't wish to Zease
them the property any lonqer, they have lost 75 spaces.
Commissioner Ethridqe said he has no problem with the temporary
spaces, but he is not going to vote for them being permanent spaces
until the larqer issues are worked out.
After a debate with reqard to permanent spaces versus temporary '
; spaces, it was agreed that the numUer of permanent spaces will be
�� 138 spaces with 58 approved for two years on an interim basis, for
� � -�-� °'; a total of 196 spaces, as suggested by staff. ,�
Commisaioner Tuite said he is willing to go as far as staff went,
but he is still willing to entertain the West Buttermilk parking
issue. He said if we could get those cars down on Main Buttermilk
it would be better for the County Road. If the Ski Company is �;
willing not to park cars there, he wants them to have the spaces
down by Main Buttermilk. '
Other commission members agreed that this would make sense.

� The Pitkin County Board of County Commissioners supports the Town of Snowmass Village's �i1
grant applications for a community park aC the entrance to Snowmass and for the seco�phase
of Benedict Park in the Snowmass Village mall. '
We support the Town's efforts to upgrade the appearance of the communicy and to provide
i recreation and open space facilities for permanent residenu. The Town has been working `
diligendy on improving its entrance for several years. The community park portion will ;�'�
I provide the residents of Snowmass Vi(lage with baseball and soccer fields, and a basketball
� court. There are no public ballfields available in town, currendy.
_ � Benedict pazk is part of the Town's vision to restore Brush Creek, which was diverted from
its natural course during the development of Snowmass Village mall and ski area. The result
of this has been serious bank destabilization and environmental degcadation in the Brush Creek
� Corridor. The Town is in the process of carrying out a multi-million dollar creek corridor 'r
e restoration and environmental education plan,part of which includes restoring the original small •
y tributary channel through an undeveloped area in the Snowmass Village commercial core.
Because it is now in private ownership,if the land is not developed into a pazk,it could be lost
� _� forever as open space and a public recreation area. �

district.
3. The "Uses Allowed by Right" Section was revised to allow a

from the Rocky Mountain News,dated September 28, 1995,which indicates that �
there are approximately 14 million people in the world who live above 10,000. • �

The Alpine and Sub-alpine regions around Aspen are not unique '
as it relates to the rest of the world. With 14 million people living above i
10,000 feet, we believe that we are entitled to "join them" by constructing �
houses of a size that is applicable through out the rest of Pitkin County. �
It is unjust and unfair for the county to restrict the size of homes
in the designated Rural &Remote Areas to 1,000 square feet when the size of � :
