ASPEN SCHOOL DISTRICf CODE AMENDMENTS,2nd Reading: This is an application for a Code ".;
amendment to establish a land dedication for the Roazing Fork and Aspen Schooi Districts. Issues to be addressed
aze that the first$100,�0 of property value be ezempt from the proposed school distrid land dedication requirement.
- Also,an opinion was sought if the Roaring Fork School District could be ezempt from the proposed ame�ment. A
short list of cases aze expected to come under this requirement which Tim Matloy listed for the Boazd.
' - John Ely discussed issues with respect to legal concerns. Cases in the pipeline that have not acquired vested rights, !
wili be affected by any changes to the LUC. This legislation wouid apply to those projects. Ely is of the opinion '.
, that this should apply County-wide. Ely indicated that if the Soazd would like to make exemptions foc affordable

� Alan Richman,representing the Aspen School District,described the method for developing the formula which is `'

� - I� It was noted that there aze 500 children in the K-4 classes in the elementary school. Twenty of 102 kindergarten ��,
children aze living in employee housing projects. This is roughiy 20 percent. In the first and second grade classes,

for comment. The Boazd had suggested that Kevin Wright be offere�severai alternatives with respect to the best ?�
� buildi�g envelope on the site with respect to impacts on wildlife. The TS Hammer stake or suggested revised �'.11
� envelope,50 feet to the south and west were suggested. The TS Hammer stake envelope was preferred. Rick Magill
showed a road which needs to be revegetate3 immediacely.

, Ethridge noted that the reason for delays in approving this�project was because of concerns for wildlife impacts. f

Rick Magill spoke about the maintenance of Coal Creek Road. A condition is proposed for addition to[he resolution .i`�
with respect to road maintenance and requiring the applicant join a road improvement district should one be formed,
� if ihe cunent negotiations with the Pfanenstiel's with respect to the road somehow do not take place or fail through.

explained that the app(icant is requesting approval of one single-family residence,and a detached caretaker unit to be '.
located in a proposed bazn. The proposal requests subdivision of an appcoximately 35.4 acre pazcel from a 550 acre a�

� revised to reference the Housing Authority Guidelines and Condition No.27 was added which requires detailed and

- deed-restrict to an agricultural preservation and wildlife enhancement azea. Staff pointed out conservation easements

� Herb Klein noted that this family has children and for safery reasons they want driveway lighting. Herb noted that
� the PBcZ spent quite a bit of time on this issue and safety was of a concern. The applicant would like one down-light
every fifty feet which wouid be 6 lights.

AMENDID MOTION-Ethridge agreed to amend his motion to allow for two lightc within the first fifty fe�of the
driveway which will solve the access problems from the road. Discussion continued. Minimal entrance lighting and
- gazage lighting which is motion activated or otherwise might be acceptable. The motion was amended to allow
lighting no more than 40 inches high to light die entcance to the driveway and within 50 feet,another one az the

REVIEW: Mick Ireland opened the public hearing on this matter. Malloy noted the Board has reviewed U►is issue
before. The request is ro continue using the p�operty for an existing non-permitted contractor storage yazd and �
_ material soRing/recycling operation. Malloy overviewed the history of the applications,approvais and uses on this �
� property' � . '
The Planning Commission is recommending approval,while staff is recommending denial. Staff contends that the
� operation is inconsistent with the Down Valley Comprehensive Plan and the Woody Creek Master Plan.and the
� Woody Creek Caucus has expressed adamam opposition to the use. There is concern about uuck traffic in the azea.
' However,as long as Elam is still operating,there wili still be significant amounts of truck vaffic there. Malloy
overviewed the staffs reasoning behind the opposition to the request. '°,>;

qualiry. 'Ct►ere were eight Wcks monitored in August. The mileage starting at Cazbondale,was 28,70Q miles. After i .
shutting down the racetrack site,the miteage for the eight trucks increased to 39,645. This is an increase of 10,900 `
miles put on Highway 82. This is broken down per day. This is an increase of 38%VMT.

Brandt spoke about water resource impacts,noise,impacts on the road system,compatibility with agricultural laods,
housing,and energy conservation. He summarized ihat as long as Elam Gravel Pit is in operation,Aspen '
. E Earthmoving has less impact because it is next door. If this application is denied,the trucks will still continue to '
drive up and down the valley. Brandt contends that removal of this use will decrease the life of the Elam Gmvel Pit
and the dump and puts more trafFic on Highway 82.

Ethridge contends that the noise is not compatible with residential use. �

Brandt believes that Elam and Aspen Earthmoving aze pazallel uses and should both go through the same process.
• He does not see any great demand to put residential houses where these uses aze located.
� Jim Collins explained that the zoning does not allow this use. The Down Valley Plan does not encourage it and the
Woody Creek Plan specifically prohibits this use. He noted the history of the use. �

enough to remove the use. He believes the life of this use should be equal to that of the Etam Gravel Pit.
