, .`~� WHEREAS, Pitkin County is the owner of Lots 1 and 2,
�;,:=� Randall Park Subdivision, according to the Map thereof recorded
'-L,;� in Plat Book 9 at Page 41 of the real estate records of Pitkin

�,�� WHEREAS, Pitkin County has committed to sell Lot 1,
Randall Park Subdivision to Fleet Properties, Inc., pursuant to

=��� Ordinance No 84-OR-11; and �

:���. WFiEREAS, the deed by which Pitkin County took title to
:;=�� the property later subdivided as the Randall Park Subdivision

(which deed is found in Book 340 at Page 779 of those records)
� .� contains certain restrictions that must be released (by Instrument ,.

of Release) prior to conveyance of Lot 1; and
WHEREAS, said Instrument of Release is determined to be
���� necessarily incidental to Ordinance No. 84-OR-11 and not a dis-
��•`� position of real property as contemplated by Section 8.7 of the
