WSEREAS, Leonard and Pepper Weinglass (hereinaftet "Applicants") � .
:'_� have requested special review approval for an empZoyee dwelling unit °

� t? pursuant to Section 3-8.13(d) of the Pitkin County Land Use Code; and '
'<� �1HSREAS, a meeting was held befoze the Soard of County Commissioners
of Pitkin County Colorado (hereinafter "Board") at their regular

:;�'. meeting on February 24, 1986, at which time the applicant presented

'`a;� WHEREAS, the Board finds that this application does meet the
�'``'$ applicable requirements of the Land IIse Code.
���",� NOW. THERSFORE. BE IT RESOLVED by the Board that it does hereby

.__::� grant special review approval for an employee dwelling unit subject to
, : � the following conditions:
� 1. The Applicants shall comply with health and safety reguirements
`:� as determined by the Uniform Buildfng Code and County i:
',:;� Building Inspector. `;

remain an employee unit by deed restzicting it in compliance
� ::� with the recommendations of the Aousing Office in their memo
dated January 10, 1986 and attached hereto as exhibit "A".
• '�'�� Rent shall be calculated based on 1,200 square feet of floor
'ti area using moderate income guidelines.

`�'� pxior to June 8, 1981 may be aporoved by the Soard which do not
�``� meet the requirenents of the Section otherwise. The existing
��•� residence has two bedrooms, a den, livinq room, kitchen, and
carport totaling 18Q0 sq. ft, tahich er.ceeds the maximum 1200 sq.
ft. in the code. ihe a11o4rable rent will be calculated on the �
�':;�__ 1200 sq, ft. allowable for moderate income in the employee guide-
;,;;�a� lines: The f]ousing Office feels this unit would be adequate for
, a manager of an agricultural operation and recommends approval of
;ti,,�� the employee housing residence. It is suggested that the �
following deed testriction be placed on the unit:
1. The owner hereby covenants that the employee rent-al
unit shall remain a rental unit and shall not be condo-
miniumized. Use and occupancy of the employee rental unit •
. shaZl be limited to housing for qualified employees in
'' � accordattce r�ith the moderate rental guz@elines established � ,,
by the Housing Anthority of the City of Aspen and Pitkin
'�� County or a successor thereto. The Ownet of the unit shall ��
` "?`� have the right to lease the unit to qualified employees of
. his own selection. Such individuaZs may be employed by the
{ � , O��rner, or employed in Aspen/Pitkin County, provided such
persons fulfilZ the requirements of a qualified emplo_yee.
"�?ualified employee" zs used herein shall mean any person
