';�'� WHEREAS, by prior action the Board of Co nty Commissio-
ners has adopted Article 5 of the Pitkin County Airport Regula-
`� tions, Title IV, Pitkin County Code; and
s'_� WxEREAS, the Code does not adequately define retail
'}= fuel sales nor adequately specify the scope of activities �.

,=:� permitted to Airport concessionaires and aircraft owners who are
,,� au�horized to self-fuel their own aircraft; and
;,;s� WHEREAS, in the interests of safety and quality service
�i at the Airport, it is the intention of the County by these
�`-� requlations to limit retail fuel sales to full-service fixed-base '�
. �::�
`� operator(s} and to permit self-fueling in those limited circum-
-�� stances where aircraft are under the direct control of those who
E.�� wish to self-£uel; and
WHEREA5, pursuant to gublic notice, a public hearing �
� was held on these proposed regulations on March 10, 1986, at

'3 which time all interested persons were provided with an opportun-
� ity to comment, and at which time a record in support of these x

regulations was made; and �'�

WHEREAS, the Board decided to continue the public fx:
�� hearing on the proposed minimum specifications for commercial
?.::,:
� activities at the Airport and to proceed with the adoption of -
�{ these amendments to Article 5, which procedure received no
3 objaction from members of the public;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
� COMMI5SIONERS OF PITKIN COUNTY, COIARADO, that the Board of
County Commissioners does hereby approve amendments to the Pitkin
County Code, Title IV, Airport Regulations, by the inclusion of
� the attached amendments to Article 5, Fueling Regulations,

, ,'.•�� 5-12 Trucks used for fueling must meet the requirements of the
i Pitkin County Airport Fue2ing Check List, as they may be
� amended from time-to-time. All fueling equipment, facilit-
>'� ies and operators niust be in compliance with applicable �
regulations of, the State of Colorado and the Federal
Government, including, without limitation, the United
'` � States EPA, State Department of Health, C,R.S. 8-20-101, et
• _ ; seq•, and the requirements of any applicable insurance
-�x:_R pol iCy.

�„r;` Any flammable Iiquid truck found to be in unsafe operating
xz"�,�r' condition shall he placed out of service by order of the
-x�� Airport Manager. No truck so placed out of' service shall
��?s?x` be operated on the Airport until it has been placed in safe
;;;,s`,'2r;�� and serviceable condition and approved by the Airport
'�<`•T' Manager. Any such truck shall be insured to the satisfac-
j4� tion of the County, consistent with the requirements of
r,S';-,� Article 33 of these Regulations.

� '�ir. 5-14 Fuel and oil trucks shall be parked in remote areas design-
&�4� ated by the Airgort Manager unless preparing to service or
?� actually servicing an aircraft.
