����j WHEREAS, Victoria Falk (hereinafter "Applicant") �Fras �s��'de app�-

_'�;� Colorado (hereinafter "BOard") for a Special Review approval for a

caretaker unit of approximately 400 square feet in size within the

_;_Y,� WHBRSAS, on Mazch 10, 1986, the Soard held a public hearing to
=;�";+ review said application; and �
°;:;?!� WHEREAS, the Board reviewed said application pursuant to Section
_,;,•?� 3-8.13(a) o£ the Land Use Code; and ;
` � WHERSAS, the Board finds that this application meets or exceeds

'.:;_� the requirements of Section 3-8.13(a) of the Land Use Code.

�'��'`:� 1. Woodburning devices to be installed in the residence shall
' `_.::{ meet County Code requirements.

' 2. Prior to the occupancy of the residence, the Applicant shall
,'';� provide the following:
�'� a) The owner hereby covenants that the employee dwelling �
`� unit shall at all times remain a rental unit and shall � ?
not be condominiumized nor the beneficial interest sold
''!� separately from the main dwelling. Dse and occupancy
� of the employee dwelling unit shall be limited to
housing for qualified employees in accordance with low
?.-� moderate income irental guidelines. Rent shall be
calculated in accordance with the low income guidelines
established by the Housing Authority of the City of
` Aspen and Pitkin County or a successoc thereto. The
'�;-} owner of the unit shall have the right to lease the
unit to a qualified employee of his own selection.
Such individual may be an employee of the Owner, or
t�:`� employed as a resident caretaker, provided such person _ �
:;:. fulfills the requirements of a qualified employee.
'�:>. "Qualified Employee" as used herein shall mean any
:�`;] person currently residing in and employed in the City
;:.°'�. of Aspen oc Pitkin County for a minim�m average of 30
z,�;� hours per week, nine months out of any twelve-month
�,�,; period, who shall meet low or moderate income and
occupancy eligibility requirements established and
�:±<� applied by the Housing Authority with respect to
;r';�: employee housing.

;�`d Housing Authority Office by the Owner of the unit prior
to occupancy thereof, and must be acceptable to the

Aousing Authority. If the Owner does not rent the
employee unit to a qualified employee the nnit shall be �
made available tor occupancy in accordance with the
Aousfng Authority Guidelines, provided the Owner shall �•== ' ,
have the right to approve any prospective tenant, which � "
approval shall not be unreasonably delayed or withheld. x

i c) The employee dwelling unit is limited to occupancy by 4
not more than two adults. Resident adults must qualify �
'i as, and have been found by the Housing Authority to be,
' `� employeea of the community and residents thereof as i
� referred to above. i

:� d) No lease agreement executed for occupancy of the i
..=3, employee dwelling unit shall provide for a rental terra ;
'd of less than six consecutive months.

e) These covenants shall be deemed to run with the land as
�`� a burden thereof for the benefit of, and shall be
`�� specifically enforceable by, the Board of County
;� Commfssioners of Pitkin County, the Aousing Authority
or the duly authorized designee of the Board of County
` Commissioners of Pitkin County, by any appropriate i
��•� legal action including but not limited to injunction, !
�4 abatement, o= eviction of non-complying tenants during
`.:�i the period of the life of the last surviving member of
the presently existing Board of County Commissioners of
, Pitkin County, Colorado, plus twenty-one years, or for
.� a period of fifty years from the date of recording `;
hereof in the Pitkin County real property records, ,
�:i whichever period shall be less. i
