approaches to design and construction of the Project.
1.1.4 Based on the mutually agreed upon progzam and Project �

Owner, the Architect shall prepare, for approval by the �
Owner, Construction Documents consisting of Drawings ,:•
and Specifications setting forth in detail the require-

� r� 1.2.4 The Architect shall prepare the necessary bidding t'`
�� in£ormation, bidding forms, the Conditions of the '
Contract, and the form of Agreement between the Owner
and the Contractor, subject to owaer's approval.
�`� 1.2.5 The Architect shall advise the Owner of a�y adjustments
to previous Statements of Probable Construction Costs
indicated by changes in requirements or general market

i 1.2.6 The Architect shall prepare and file the necessary ��
:_� documents for the approval of government authorities � �`
� having jurisdiction over the project, including �
'; environmental reports, research studies, special f
documentation, or special tests, subject to the

1.2.7 The Architect, following the Owner's approval of the
Construction Documents and of the latest Statement of
Yrobable Construction Cost, shall assist the owner in -
obtaining bids, make recommendations, and assist in
_,.�_ awarding and preparing contracts for construction.

j 1.3 CONSTRIICTION ADMINISTRATION

:� 1.3.1 The Construction Phase will commence with the award of
i the Contract for Construction and, together with the
• :;f Architect's obligation to provide Basic Services under i: : .,
;'� this Agreement, will terminate when final payment to ,••.",.;.���
the Contractor is due, or ninety (90) days after the _ I:;=.'
`� Date of Substantial Completion of the Work, whichever p;,F

�I 1.3.2 The Architect shall provide administration of the ;�;•:', :
;� Contract for Construction as set forth below.
1.3.3 The Architect shall be a representative of the owner �.•';,1
;-� during the Construction Phase, and shall advise and �
consult with the owner. Instructions to the Contractor
shall be forwarded through the Architect. The Archi- i �
+� tect shall have authority to act on behalf of the Owner ,
only to the extent provided in the contract Documents � •.
�'_:;� unless otherwise modified by written instrument in ;
accordance with Subparagraph 1.3.16. �

1.3.4 The Architect shall visit the site at intervals �;
; �..,�,� appropriate to the stage of construction to become ' , •
familiar with the progress and quality of the Work and
' to determine if the Work is proceeding in accordance � �`
,3>� with the Contract Documents. However, the Architect ; ', . ;
shall not be required to make exhaustive or continuous ; �::
L';� on-site inspections to check the quantity or quality of ?
[.;.� the work. On the basis of such on-site observations as ;
an architect, the Architect shall keep the Owner �
`;.e informed of the progress and quality of the Work, and ;
<j shall perform his duties in order to guard the owner � � .
against defects and deficiencies in the Work of the �
'�� Contractor, subject to the limitations herein. '

1.3.5 The Architect shall not have control or charge of, and (
shall not be responsible for construction means, ,
methods, techniques, sequences or procedures, or for �
,� safety precautions and programs in connection with the � "
�' � Work, for the acts or omissions of the Contractor,
' � Subcontractors or any other person performing any of
the Work, or for the failure of any of them to carry
out the Work in accordance with the Contract Documents.

1.3.6 The Architect shall at all times have access to the
Work wherever it is in preparation or progress.
1.3.7 The Architect shall determine the amounts owing to the ;
Contractor based on observations at the site and on �
evaluations of the Contractor's Applications for
Payment, and shall issue Certificates for Payment in
such amaunts, as provided in the Contract Documents.
? 1.3.8 The Issuance of a Certificate for Payment shall ( �
a constitute a representation by the Architect to the t
�� Owner, based on the Architect�s observation at the site i
�! as provided in Subparagraph 1.3.4 and on the data

interpretations necessary for the proper execution or I '

1.3.10 Interpretations and decisions of the Architect shall be �.

interpretation or decision rendered in good faith in
such capacity. •
1.3.11 The Architect's decisions in matters relating to
artistic effect shall be final if consistent with the
intent of the Contract Documents.
�._- 1.3.12 The Architect shall notify the Owner of any work which �
� does not conform to the Contract Docwnents and, shall
make recommendations to the Owner regarding appropriate
�i action to be taken. Based upon instructions of the i
r� owner, the Architect may reject such Work on the '
i Owner's behalf. Whenever in the Architect's reasonable � �

tation of the intent of the Contract Documents, the �:�•• � �

with the information given in the Contract Docuaents.
!� Such action shall be taken with reasonable promptness
so as to cause no delay. The Architect's review or

indicate approval of an assembly of which the item is a
- component, nor shall it relieve the Contractor oP his

1.3.14 The Architect shall prepare Change Orders for the ;

TERMINATION OF AGREEMENT

4. Assist Pitkin County During Bidding/Negotiations:
The Architect will be available to answer questions and
inguiries of contractors bidding on the project. The
