VACATING BSEC6 DRlVE IN REDSTUNE

� WHER&AS, Irving Tasman (hereinaftec "Petitioner") has �;'�_. ;
presented a petition reqaesting the vacation of Beech Drive in ";'��, '
Redstone, Colorado; and
. WHBREAS, the Pitkin County Planning and Zoning Commission
heard the above petition at a regulazly scheduled meeting on �{� .��'
April 2, 1986 and recommended by their Resolation No. 86-13 that '��
the Board of County Commissioners of Pitkin County, Colorado
(hereinafter "Board") deny the Petitioner's request to vacate
Beech Drive; and • �
WHffitBAS, the Board heard the petitionec's request to vacate `

I Beech Drive at a cegularly scheduled duly noticed public hearing .
� on June 9, 1986; and

i WHEREAS, the Boar.d finds that the small lot size on which �^ �
t
- ''� the Petitioners residence and business is located will create an . '
� undue hardship due to Floor Area Ratio restrictions; and
� WHEREAS, the Petitioner has proposed to provide cectain
� community services to o£fset the loss of Beech Drive as a public

' NOW, TBEREFORE, BE IT RBSOLVED by the Boacd that it does ` '

� heceby vacate Beech Drive in Redstone, Colorado, subject to the
I .

follo«Jing conditions:
± 1. The Petitioner shall provide water to Redstone Park ��' �
i until a permanent hook up between the Pack and the :�
j Redstone Water District is established. The Petitioner
� will donate $2,006 to Pitkin County for the installa- �"
tion of said hook up at such time as the County ,
requests said donation but in no event shall the k��•.
donation be made later than December 31, 1988. =;F '.•
� 2. A water fountain to be dedicated for public use will be
.-., � constructed by the Petitioner in a location to be ":"�

6. Prior to the construction of any building addition
' which will increase the size of the Petitioner's �

approval through the Pitkin County 2041 FloodpZafn
� Review process.

' 7. Upon the request of the Board, the Petitioner sha11 •
° provide construction easements alon9 the Crystal River
as may be necessacy for public works projects, includ- ?
inq but not limited to flood contro2 work and struc- �
tures.
3 8. The portion of Beech brive that reverts to the Appli- � .
� can t s ha l l be maintaine d as public open space and shall
� further remain as pedestrian access to the park and f
�„� Crystal River. No fences or other obstructions to
` ; public travel shall be placed w it6in the vacated right- - • �
_ of-w ay.
