TRAFFIC DURING CONSTRUCTION ON THE
MOUNTAIN BY THE ASPEN SKIING COMPANY

� WHEREAS, the Aspen Skiing Company (ASCj, which operates
the Aspen Mountain skiing facility, is constructing major addi- �
� tions to its ski lift system on the north face of Aspen Mountain; C .� �

WFiEREAS, the various ASC construction projects involve ;+ �
� 1
the movement of heavy equipment and materials; and 1�
-� WHEREAS, the Aspen Mountain "Road” has historically F
pbeen used by the public in the summer and fall seasons for recre- �
� ational txail purposes and as access to other scenic areas; and �` (
� ~� WHEREAS, the ASC construction activity on Aspen Mountain
�� planned for the summer and fall of 1986 may constitute a hazard
.,:;::
� to public traffic on the Aspen Mountain "Road;" and
g WHEREAS, ASC has made a request of Pitkin County to °�
adopt temporary regulations to close the "Road" to public traffic �

; during the 1986 summer and fall seasohs as a safety measure; and .
WHEREAS, Pitkin County has authority to adopt such '
+' temporary regulations and to close public roads pursuant to, � y
e�
inter alia, 1973 C.R.S. 30-11-107(h), 30-35-201(3) and 42-4- 3`.' ,

County, Colorado, (BOCC), is familiar with the ASC construction `p

projeats and the "Road," has conducted a public hearing on the
temporary closure of the "Road" and has found and determined that �

County Road and Bridge Director. The sole purpose and content of '
the permit shall be to coordinate access to the property with the �' '
ASC construction activity for the safe and efficient use of the

road and to settle release, indemnification and/or insurance �`_
� issues among the affected parties. No fee shall be charged for �:

�i the preparation or issuance of such permit. �;

That the closure shall not take effect until the �'Road" �
� has been properly signed, pursuant to 1.973 C.R.S. 42-4-109(2). ,

�� . That the County Manager and/or the Sheriff shall have �

the authority to enforce this temporary closure. Penalties for

`� violation of this closure shall be as provided by law.
