RESOLUTION OF THE BOARD OF COUNTY COMMISSIpNERS � _
OF PITKIN COUNTY, COIARADO, '
SUBMITTING TO THE ELECTORATE QUESTIONS PROPOSING i:
CONVEYANCE OF THE COUNTY TRAIL5 SYSTEM AND WAGNER PARK �,.z;::-

• ,.� WHEREAS, the Board of County Commissioners of Pitkin x..`'

County, colorado, (hereinafter "County") and the City of Aspen, r.;;�'
� Colorado, (hereinafter "City"j, are each lawfully authorized to
�� acquire and maintain trails for the purpose of hiking, bicyc7.ing,
� equestrian, pedestrian and recreational uses; and �
� '
,� WHEREAS, the County owns or has easements with regard t, • ;
to approximately twenty (20} miles of trails locatec3 in the City � �
;� of Aspen and the unincorporated areas of the County (hereinafter
�� °County Trails System"), which have been maintained by the County;

� -,.��� WHEREAS, the County owns approximately 2.5 acres, r �-
, :.`..
located in the City, commonly known as Wagner Park; and .
��-" WHEREAS, the County and the City entered into a j oint
�:.
_ maintenance and policing Agreement, dated September 13, 1976,
whereby the County assumed responsibility for the costs of main-
;;`i,� taining, zepairing, and signing all of the trails within the city ;
�
of Aspen; and
WHEREAS, the County desires to terminate the aforesaid
. �
� Agreement and to convey the County Trails System to the City t ,

because the City has a parks and recreation department, because

the City has demonstrated its willingness to budget for this

purpose, and because the trails serve as an Aspen metropolitan '�
area resort amenity; and �''� �

"' � WHEREAS, the County desires to convey Wagner Park to

�� the City because it is located in the City, because it is main- ;':
� tained by the City, and because it is an urban amenity; and � +�
WHEREAS, Section 8.7.1 of the Pitkin County Home Rule
Charter authorizes the Board of County Commissioners to sell,
� lease, or otherwise dispose of real property under such terms and �� '
�•N •
I��^ conditions as the Board of County Commissioners deems to be in •
the best interest of the County, provided that any sale of park a
,:�;� or reareational facilities shall not be approved until the ques-
°� tion thereof is submitted to and approved by the electorate at a
regular election; �
NOW, THEREFORE, BE I�' RESOI,VED BY THE BOARD OF COUNTY `
' COMMISSIONERS OF PITKIN COUNTY, COIARADO, that the followinq

"f question shall be placed on the ballot for the General Election •
�� to be held on November 4, 1986:
� Shall the Board of County Commissioners
of Pitkin County, Colorado, be authorized `'.
to sell or otherwise dispose of the �`
;; County Trails System and Wagner Park to %., ,
� the City of Aspen, Colorado, subject to a � '
� restrictive covenant that such property � � ,.
must be used for park or recreational '!
� purposes unless otherwise approved by the
:, registered qualified electors of the City
� of Aspen and upon such additional terms
and conditions as the Board of County � •
Commissioners shall deem to be in the
`best interest of the County, all as set �
i forth in Resolution No. 86- 90 ? � '

BE IT FURTHER RE50LVED, that within thirty (30) days

from the approval oP this Resolution, notice shall be published
in The Aspen Times of the text of this Resolution and the date of � ` . ,.

�,,; the election, provided that the text of the proposed Trails
'� Agreement between the City and the County, attaahed hereto as
� Exhibit A, which shall be amended to provide that the County ;

, shall convey to the City only easements over the entire trails �-, .•>`�

- system; need not be published, but that reference thereto shall
be made, and its availability for inspection at the Pitkin County r�:.���, �

Courthouse shall be indicated. If a majority of the registered �:-� •

qualified electors voting thereon vote in favor of the question, '
� the Board shall be authorized upon approval thereof to contract r . .

with the City of Aspen for said conveyances upon such terms and
