� inafter "Applicants") have applied to the Board of County
,i Commissioners of Pitkin County, Colorado (hereinafter "Board")

;;� wHEREAS, the Board heard this application at a regularly �
,� scheduled public meeting on November 10, 1986 at which time �.• ,'

wHSRSAS, the Board finds that this application complies with y
� the criteria for an employee dwelling unit contained in Section

3-8.13 of the Land Use Code.

NOW, THERBFORE, BE IT RESOLVED by the Board that it does
,:3 hereby grant Special Review Approval to the Applicants, subject .

1. To offset the road impacts associated with the in-
• creased residential density of this project, the
applicant hereby commits to joining a road improvement
,.?� district, if formed, to upgrade Red Mountain Road. �. '

' 2. R`he Employee Dwelling Unit shall at all times remain a ?.' �
' rental unit and shall not be comdominiumized. Ose and -
i occupancy of the Employee Dwelling Unit shall be `

i owner or employed as a resident caretakec, provided
suoh person fulfills the requirements of a qualified �'

sioners of Pitkin County, the Housing Authority of the t
City of Aspen and Pitkin County, or the duly authorized
�. designee of the BoaLd of County Commissione=s of Pitkin ,
County, by an appropriate legal action including but
"�� not limited to injunction, abatement, or eviction of
; non-complying tenants during the petiod o£ the life of
'! the last surviving member of the presently existing � �
Board of County Commissioners of Pitkin County, �
Colorado, plus twenty-one years, or £or a period of �
fifty years from the date of reco=ding hereof in the I :%.
Pitkin County real property records, whichever period �
shall be less. �'
