1. The Employee Dwelling Unit shall at all times remain a 1:: ,
rental unit and shall not be condominiumized. Use anc7
occupancy of the Employee Dwelling Unit shall be
�.�.,_ limited to housing for qualified employees in accord-
� ance with rental guidelines established by the Housing
' Authority of the City of Aspen and Pitkin County or a ;
� successor thereto. The owne= shall have the right to
j lease the unit to a qualified employee of its own
`i selection. Such individual may be an employee of the z^
• _; owner or �ployed as a resident caretaker, provided �
.' such person fulfills the requirements of a qualified .
;� employee. "Qualified employee" as used herein shall _
:;j mean any person currently =esiding in and employed in -
°1 the City of Aspen oz Pitkin County for a minimum -
;•� average of 30 hours per week nine months out of any 12- ; '
j month period.

,� 2. Verification of employment of person(s) living in the
employee unit shall be completed and file3 with the �
k Housing Authority Office by the owner of the unit prior �_
,;.� to ocaupancy thereof and must be acceptable to the f -
.� Housing Authority. If the Owner does not rent the
+_� employee unit to a qualified employee the unit shall be � ,
made available for occupancy in accordance with the � '
� Aousinq Authority Guidelines, provided the Owner shall
have the right to approve any prospective tenant, which
approval shall not be reasonably delayed or withheld. �
,� 3. The employee dwelling unit is limited to occupancy by- '

`' not more than two adults and related children. i�
�� Resident adults must qualify as and have been found by ;_ .
;;; the Housing Authority to be employees o£ the community !•

'� 4. No lease agreement executec] for occapancy of the
t:� Eanployee Dwelling Unit shall p=ovide £or a rental term

;�#, 5. These covenants shall be deemed to run with the land as � �
a burden thereof for the benefit of, and shall be '
specifically enforced by, the Boa�d of County Commis-
z sioners of Pitkin County, the Housinq Authority of the •
y City of Aspen and Pitkin County, or the ciuly authorized
r designee of the Board of County Commissioners of Pitkin y
� County, by an appropriate legal action including but i
� not limited to injunction, abatement, or eviction of '�
non-complying tenants during the period of the life or i� `
i the last surviving member of the presently existing �
Board of County Commissioners of Pitkin County, i ;
Colorado, plus twenty-one years, or for a period of '
fifty years from the date of recording hereof in the � �__
