It is a request to build a 3,000 .:;:--; , sq.ft. residence in the Aspen River Valley Ranch on a 22 acre parcel. Francis stated that there are no major issues with this proposal. The area proposed for the dwelling is out of the flood plain. Bob Child expressed a hope that when the Code is rewritten, ic , will be made clear exactly what is necessary to show that water is available and when it must be proven. 1 IAt this point Braudis opened the Public Hearing and asked for • I comruents from the public. Building ''•t., improvements will be outside of the mapped 100 year floodplain. !�`�.�. Applicant is also requesting to convert a garaqe to a caretaker unit and requests a variance to the setbacks. Feels that in dealing with P&Z Commission and Planning staff, he feel they - are not really sure what that means. We need to be more �.� definitive as to what that term means. He stated that the Personnel .Reyiew Board has been working on the revision of tha four chagcers included in tiiis resolution for about seven ;� � months. The ahapters recommended for revision are Chapter I, II, - _ III and IV. 'r . Kipp stated that PRS wanted to recommend a revised Sick/Disabil- ity Benefit as an additional policy. Since the flooc3plain will not be intruded upon by this development, we find it to be an acceptable activity. The Planning staff had originally informed the applicants that the Planr�ing Commission conld grant a setback variance based on Section 3-8.12 of the Land IIse Code. We have since realized that this provision applies to R-30 zoned properties, not RS-30. Therefore, the applicant will be required to apply for a setback variance to the Board of Adjustment rather than to the Planning Commission. The applicants have also requested to convert the existing garage to a "guest" or "caretaker" unit. According to the Land Use Code, detached caretaker or guest units require twice the acreage of the underlying zone district. We present the following review comments for your consideration regarding the referenced proposal: 1. WATER SUPPLY Water is supplied to this residence from the Nettle Creek treated . water pipeline supplying the City of Carbondale. Quality and quantity are sufficient to continue to meet the water supply needs o€ this proposal. 2. SEWAGE DISPOSAL � The existing residence has some sort of onsite wastewater treatment system, but at this point we are not in a position to comment on its construction or whether it complies with the Pitkin County regulations. In 1976, the previous owner applied for and was issued the attached repair permit to correct a malfunctioning system, after we conducted routine soil tests which demonstrated that the soil of the area was suitable and that a system could be installed in compliance with applicable codes. We were not, however, ever notified of the completion of the repairs to the system. As a result, we never conducted any further inspections or granted final approval. Either the owners decided not to complete the repair or failed to notify our office that repairs were done in order to obtain the required final inspection. In the first case, we would insist that the entire system be replaced as a condition of any further building permits being issued. In the second instance, if a reconstructed septic system was finished in 1976 or shortly after, we would request that the current owners verify the location, construction materials and type of septic tank provi- . ded. This can be accomplished by exposing the septic tank and a part of the absorption field. This departmenc continues to presume that the basic conditions of the suitable soils and available area on the site have not changed, and that while the regulatory zequirements have been modified the situation is such that additional permits could be issued on request. Ix� conclusion, any future onsite sewage treatment systems can be constructed to Pitkin County regulations, and these should function for a long period of time if properly maintained. 3. AIR QUALITY IMPACTS The elevation sketch shows another brick chimney on the addition . to the main house. We. assume that this is a fireplace, and wish to remind the owners that the existing air pollution regulations permit only one fireplace for each dwelling unit. We recall that the existing house already has a fireplace.
