� WHEREAS, Centennial is the owiier of che land designated -
_.� � as Lot 3 on the Second Amended Plat of the Centennial
^>;:3 Condominium recorded in the recurds of Pitkin County,
a Colorado; and �'

- ;� • WFIEREAS, the second amended plat dedicated for public
roads and utilities the 60-fo�t-wide rights of way far Park
Circle, Brown Lane and Spiuce Street, which dedications were
ru� wider than required by the county which were accepted by the
` Board of County Cammissioners of Pitkin County; and

�``��= wxEREAS, a po�tion of three of the buildings as con- � ,

°;*�;; structed on Lot 3 overhang and encroach slightly on the
airspace o� the 60-foot-wide public road rights-of-way
°-::.'� easemer.ts but do not interfere with the use of the easements
;;=';s in the right of way for roadway and utility purposes;
� NOW, THEREFORE, in consideration af the foregoing and
ten dollars ($10.001 and other consideration, the parties
.,i agree as follows. '

# 1. Partial Release Easement. The Board hereby
,..�'.� releases and reconveys to Centennial that portion of the
60-foot-wide rights of way described above located directly
" ��``� underneath the overhang or encroachment of certain buildinys �
as now constructed on Lot 3 of the Centennial Condominium '
into the airspace of such dedicated public road rights of ,.
way as shown on the Improvement Survey of Lot 3 of the
Centennial Subdivision, a caQy of which is attached hereto
� ' as Exhibit A and described as: The northwest side porch and
� ` sto=age area of Building F encroachment into the northeast
•=�':-� side of the Park Circle right of way; the north side second
story overhang of Building G into the south side of the `
;.'i Brown Lane right of way; the east side second and chird �f .
,:�� story overhang and covered stairway overhang of Huilding S
into the west side of the Spruce Stzeet right of way.
� 2. Binding Effect. The provisions of this �: �.
agreement shall bind and inure to the benefit of the parties !'
j and their successors in title. The covenants herein shall jy. ,.
j attach to and run with the land and be appurtenant to the n
� land so that a transfer of legal title to the parcels or '
-t portions thereof shall automatically transfer interest in ��' .
