�� The Colorado State Forest Service of the State Board of Agricul- �°�''' '
s ture, and Pitkin County desire to jointly participate in a trial
� effort to utilize available fire suppression aircraft for control-
ling wildfires (being brush and forest fires, but not structural •
fires) on nonfederal lands in Pitkin County. The Colorado State � :.',
Forest Service (CSFS) and Pitkin County also desire to test cost-
' sharing of specific, initial attack fire aircraft necessary for
wildfire suppression. ���� • •

1. Encourage aggressive initial attack when such actions .
can prevent larger more costly wildfires;

;:_`'y 2. Evaluate £ire aircraft use as an early warning for
t possible Emergency Fire Fund contract implementation in

A. To take part in this test, Pitkin County agrees to: '

1. Maintain participation in the state-wide Emergency Fire . Y
�„�.2' Fund (EFF) Contract; �

� - 2. Designate the County Sheriff and one alternate represen- �
,._-� tative as the only County individuals authorized to
order aircraft under thfs Agreement, and transmit those
names to cSF5 prior to May 15; for this purpose, the
`� County hereby designates the Sheriff and Undersheriff as

3. Order needed aircraft direct from Western Slope Fire
Coordination Center at Grand Junction, Colorado; for
� this purpose, the telephone numbers of the Center, in
� order of priority, are as foZlows: �'

shall provide training to the Pitkin County Incident

4. Notify the Grand Junction District of the Colorado State •

,:,-�y� suppression aircraft, if so .requested by Pitkin County,
.-� or immediately after such order, which assistance in-
cludes, without limitation, as follows: recommended
- tactics to control the incident; calculation oF forces
necessary to control the inoident; estimate of necessary
aircraft, number of drops and County share of costs; •
- adflitional air support or air tanker drops; advice on
Emergency Fire Fund implementation potentials. �:
2. Aggregate billings for fire aircraft used and gay their
full cost.

Only qualified, adequately-trained crews and adequately-
maintained aircraft will be sent in response to Pitkin
County�s order. �
4. If aircraft ordered by the County are out-of-state, � ,
flight casts to arrive at the closest Colorado loading
base will be disclosed at time of request by the County �
Q and may have to be paid for by the County at one hundred
percent of the cost.

5. This trial effort refers only to initial attack aircraft Y
� used to bring wildEire incidents "under control.�' It
• does not extend to °mop up" operations.

6. CSFS approval prior to order of first aircraft is not
necessary. CSFS must be notified when first aircraft is
;�� ordered.
�''` 7. More than one aircraft resource may be used simultaneous-
�=;„ ly on an incident if determined by the Incident Commander .

''µ� 8. This Agreement does not apply to search and rescue, law , '.
enforcement or County-owned airaraft operations or to
_ fire suppression subject to the EFF Contract, i
- 9. Participation in this test program does not require the
County to utilize fire aircraft if such aircraft are not
neaessary fo prevent higher suppression costs or value
losses as determined by the Incident Commander at the
-;:�,.� scene.

� lo. This Agreement does not guarantee aircraft availability '
within Colorada or at a particular base. Fire suppres- ' �*r�
{_;;' sion aircraft are often called to other locations in
_ Colorado or the United States for wildfire suppressian. •
Such aircraft may also be unavailable while in Colorado
[ ;� d�ue to required rest/repairs.
- il. Indemnification. To the extent autherized by Zaw, CSFS
.;.� (and its contractors or subcontractors) shall indemnify,
save and hold harmless the County, its officials, employ-
- ees and agents, against any and all claims, damages,
liability and court awards including wsts, expenses,
and attorney fees incurred as a result of any act or
- omission by CSFS, or its employees, agents, subcontrac- -
= tors, or assignees pursuant to the terms of this Agree- �
ment. ,
