W I T N E S S E T H:
WHEREAS, the County and the City jointly own the lands
, _ known as the Pitkzn County Landfill, described in Deed Book ,
;� Page ; and
r� WHEREAS, the County and the City are empowered to act
�, s� in mutual association to operate a solid waste facility; and
' _� WFiEREAS, it is necessary to provide a managemeht frame-
,
'•'�:t work for operation of the facilfty.
�� NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS:
,'� 1. The Pitkin County Sanitary Landfill shall be oper- ;�

-':;'z ated ae a department of the County under the management of the
`;� County, which is authorized to contract for the performance of

;� � all or any part of the facility's activities. The award of any

such contract shall be made by the Board of County Commiesioners.
± The County shall also be responsible for prep�ration of the #:.•
�_ annual operating and aapitaZ improvement budgets. �
� 2. User service fees shall be collected by the County �

_ Treasurer, as authorized under C.R.S. 30-20-115, and ehall be set �

- � from time to time by Resolution of the Board of County Commis-

sioners as necessary to maintain the requisite level of subsidy, !- •'

:ti 3. Financial administration shall be provided by the
N� County Finance Department at no charge to the City. Escpenditures
,:ry:
';;�- shall not be allowed to exceed the adopted annual budgets. ,
Amehdments to the annual budgets shall be made by supplemental •
_ appropriations or amendments approved in advance by the County.
;'�=,� 4. The City shall incur no obligation to contribute to •
':��i
';,`� the annual operating budget referred to herein without its prior �
-_:�,
;:;t;� written consent. �
� � 5. This Agreement shall be amended only in writing,
executed by the parties hereto.
�`:`';`: 6. This Agreement may be terminated by either party

_ " upon sixty (60) days advance written notice to the other party.
,� IN WITNESS WHEREOF, the parties hereto have set their
