- 4. AUTHORITY AND RESPONSIBILITY OF THE PROJECT MANAGER. All work

8. AGREEMENT MADE IN COIARADO. The parties agree that this .
Agreement was made in accordance with the laws of the State of �
Colorado and shall be so construed. Venue is agreed to be - '

9. ATTORNEY'S FEES. In the event that legal action is necessary
to enforce any of the provisions of this Agreement, the prevail-
ing party shall be entitled to its costs and reasonable attorne-

10. WAIVER OF PRESUMPTION. This Agreement was neqotiated and . '

3. OWNER CONTACT. The Contractor will contact the Owner and/or

' the Contractor will contact the owner or his authorized represen-

Contractor with questions, requests for clarification or explana-

';'# 10. WORK SCIiEDULE AND PARTIAL PAYMENTS
Work on the appraisal is to begin on the date the Contract is .
i`� signed by all parties. Partial Payment amounting to one-third .

:,_-� of that date, one-third (1/3) shall be paid upon receipt of the _
Final Report and an invoice for the Contract amount noted in

?:�� Paragraph I.2., above. Further partial payment amounting to one-
! � � third (1/3) of the. Contract Amount shall be paid upon the
�� County�s receipt of notice from the Review Appraiser certifying

Lr his acceptance of tha appraisal for final reconciliation. Such
.:_.;i acceptance will certify only that the appraisal contains the
,,;,;� minimum information hecessary to begin final reconciliation and
"��� will not be unreasonably withheld. Final payment of any outstand- i

-� ing fees will be made within 60 days of the completion of the
`;a work, notwithstanding the receipt of such acceptance and barring y;
