' i ��� 5-400.2 Applicability of Regulations ,j � ''� These regulations shall apply generally to any development � application reviewed under the common procedure (Article 6) � of this Code and specifically to any proposed development in � areas of local and state interest and to the conduct of ;� activities of local and state interest designated or adopted - � by the Board of County Commissioners and listed below. Any i use which is allowed by right in the underlying zone f� district and which is in an area of local and•state inter- est, shall be processed under the review procedures of this ; section 5-400. Any use which is allowed by special review ; .j and which is in an area of local and state interest, shall <<„ ti be processed under the review procedures of this section 5- � 400, along with those of Section 3-6. Proof of ''�" �, � full compliance (i.e., technical design, finalization of legal , :`;1 documents, issuance of water court decrees, etc.) may be required ` ,,:.i if these improvements are affected by 1041 hazards, but otherwise `�1 will only be required prior to obtaining a building permit. �'i . ,j (vii) sewage (septic or hook up to existing � - _� system); � (viii) water supply; ,:�'j --� (ix) utilities (underground/above ground); and (x) proof of access (if not accessed directly off a public right-of-way). ' 5-400.7 Appeal Procedures �'� ; �;:i t ;_� (a) Any person who is dissatisfied with a boundary line , decision made by the Zoning Official or the Planning � Director (see Section 5-400.3(b)) may appeal to the :�� Pitkin County Planning Commission for a decision to ' � modify or uphold the decision. ��� ,:a (b) Any person adversely affected or aggrieved by a �'�'� decision of the Planning Commission may appeal to the ,'"� BOCC. The applicant may present his or her applica- tion, evidence and testimony to the Board of County _' Commissioners at a scheduled public hearing noticed a.'j according to the standards of Section 6-3.4(d) . The '`; Board of County Commissioners shall make a deter- :;; mination at such hearing as to whether or not to uphold, modify or reverse the decision made by the Planning Commission. The decision of the Board shall be the final action of the County. ;y� (c) The Board shall conduct a hearing within forty-five ' ,.� (45) days of the Planning and Zoning Commission hearing � regarding the application unless action is postponed '� foc the purpose of gathering additional information.
