OF PITKIN COUNTY AND ELAM CONSTRUCTION, INC REGARDING
THE ELAM GRAVEL PIT AND PITKIN COUNTY SAND AND GRAVEL REGULATIONS

w�uFns, Elam Construction, Inc. (hereinafter shown as Elam) has
operated a sand and gravel pit, rock crusher, cement plant and
� asphalt plant at the so-called "Vagneur Site'� for eight years,

� WIII:REAS, that pit has been operated under valid Special Use
.; Permit #79-132 and extensions thereto, issued by Pitkin County
'": pursuant to Special Use Permitting and Sand and Gravel Regula- -
F� tions as contained in Sections II-5.503, II-3.6 and other
� relevant sections of the Pitkin County Land Use Code, and

� WHII2EAS, Pitkin County (hereinafter referred to as the County) �
�
has designated a public pit site to be used by County contractors
� directly adjacent to the Elam pit site, and �,
�
,� �, Elam's diligence in meeting the terms and conditi- :
_� ons of their permit and extensions thereto has been, and will ��a

E continue to be, addressed at annual hearings before the Pitkin
�<.
� County Commissioners,and k`

� WHEREAS, Elam, the County and adjacent landowners have been

� diligent in attempting to identify and implement alternative �
'.� access routes to and from the pit which will relieve traffic � ' ;;.,

impacts on River Road, and
Wf�s, Elam is in the process of making an application for a
new and revised Special Use Permit to supercede the one currently
in effect, which Permit will address and mitigate traffic
impacts,and �
WHEREAS Elam and the Count have determined to rovide certain t {•�'`

assurances to each other and to the public regarding their �=

policies and intentions regarding the Elam Pit and County Y`;

; regulation of that pit and other sand and gravel operations: $:�.. :

That the County has determined and hereby declare5 as policy the ;��'�

1. That crushed qravel and other raw rock resources are important �
to the economy, safety, development and quality of life of the
upper Roaring Fork Valley.

� 2. That the current site of the Elam gravel pit is, relative to
other potential gravel operation sites, appropriate in terms of
Iits isolation from surrounding residences, potential threat to
j health, life and safety, proximity to centers of population,
i
j envirorunental impacts and operational feasibility.

3. That Pitkin Coun�y has in the past refused permit appliaations

I for alternative gravel pit developments, has no current plans to
I
' approve or promote alternative locations, and has no current
i�
intention of moving its designated pit site to any other

4. That the continued use of the current site is predicated and
will be conditional on the completion of an alternative access
route across adjacent lands and intersecting the River Road at
approximately the location of the True Smith Bridqe prior to the �.{'''

5. That Pitkin County will make every effort to expedite the
processing and consideration of a revised Special Use Permit �:- :.
Application from Elam with the objective of taking final action t'�

6. That Pitkin County will sponsor, and expeditiously act on a

proposal to amend the existing Sand and Gravel regulations of the
� Pitkin County Land Use Code to allow for Permit terms to be
established on an application by application basis.

� THAT ELAM, in anticipation of County action on a revised Special

� Use Permit on or about March 1, 1988 will, in the interim, commit

� to the following:

�� 1. Expeditious submission of an application for, and diligent
� pursuit of, a new Special Use Permit for the "Vagneur Site" in �
9
; accordance with the terms and conditions of the Pitkin County
� �
� Land Use Code and such other conditions of operation as may be �
� required by the Pitkin County Commissioners.

2. If a new Special Use Permit for the "Vagneur Site" is
approved on or about March 1, commencement of construction on a
new access road on or about that date, weather permitting. �
3. If a new Special Use Permit for Elam is approved, opening of ;,•Y,3.'-;;::
a new access road on or before June 15, 1988 and inclusion of f��

4. Upon the opening of a new access road, redirection of all ��

heavy truck traffic to and from the Elam pit to that access road �Yj�

paving, before November 1, 1988.
TI�. ABOVE comprising the mutual resolves and policies of the
= parties towards the issue of the Elam gravel pit and the new
