WHHRSAS, the Pitkin County Board of Commissioners (herein- #;;_. :

after referred to as the "BOARD") has the responsibility to 9��
review and endorse reassessments of or amendments to comprehen-
sive plans previously adopted for Pitkin County. Thus the BOARD ��1
has reviewed the findings prepared by the Pitkin County Planning 4:,'
..
: and Zoning Commission (hereinafter referred to as the "COMMIS-
� 5ION") of such a reassessment process conducted for the Woody ,;'�:, _
r�
'r' Creek Valley Planning Area of the Pitkin County Aown Valley

� Comprehensive Plan, which p].an was formally edopted on January
. 23, 1987; and,
' WHBREAS, the reassessment process for the Woody Creek area
was undertaken by the COMMISSION and County staff in light of two
� development proposals, a new access road to the filam Gravel Pit
k .
and the Roaring Fork Railroad, which warranted a more detailed
planning effort in this portion of the Down Valley area; and
j WHfiREAS, the reassessment
process consisted of four work-
{ sessioas with the COMMISSION, a site inspection with the COMMIS-
� SION and the BOARD, and two public meetings with the COMMISSION, .
� the BOARD and the general public at the following dates and
� locations:

WHSREAS, the Pitkin County Down Vallev Comprehensive Plan:
Woody Creek Area Reassessment has been developed by County Staff
that describes the Bxisting Conditions, Sxisting/Past Master Plan
Recommendations and Possible Future Cohditions of the Woody Creek
area. The COMMISSION reviewed this document and developed with
County Staff Goals and Objectives, possible Land Use Alternat-
ives, Evaluation Criteria, and Evaluation Criteria Matrices and �i.i?f:::

established a Preferred land Use Alternative for the Woody Creek
,;�.>.:_.._
Valley Planniag Area. This preferred land use alternative is '�f�" `',

attached as Sxhibit "A"; and, �`�'

WH$RSAS, The COMMIS5ION, at it's October 13, 1987 meeting,

; recommended the following findings concerning the Pitkin County ���: .

-�; � - The proposed Elam Gravel Pit access road should be con- � !"
structed to mitigate the impacts of truck traffic to the :4
Woody Creek area;
- Designation of a SERVICS/COMMBRCIAL/INDUSTRIAL band Use
District on the bench of land surrounding the Slam Gravel
! Pit on the Future Land Use Map should not be considered
under the Pitkin Countv Down Vallev Comvrehensive Plan;
- Designation of a PUBLIC/INSTITUTIONAL Land Use District on
the hench of land surrounding the Elam Gravel Pit on the
Future Land Use Map should not be considered under the
i Pitkin County Down Vallev Comprehensive Plan;
i - The Roaring Fork Railroad proposal should be addressed
through the development review process. This is based on
the condition that the railroad proposal will not undermine
the objectives of the Pitkin Countv Down Yallev Comprehen-
f sive Plan. More specifically, other uses auxiliary to the
� railroad (such as non-intensive industrial or warehousing
activities) will be restrained from occurring in the Woody
� Creek Valley Planning Area.

' At the November 4, 1987 Public Meeting, conducted by the BOARD,
it was desired by those in attendance that these finding be
converted into conditions of approval for the proposed Blam
\ .<
Gravel Pit access road, thereby ensuring that the recommendations
and finding of the CQMMTSSION be upheld; and, -' ;

Pitkin County Planning Commission with respect to the Pitkin
CountY Down VelleY Comnrehensive Plan: Woody Creek Valley
Plennin� Area Reassessment; and,
BB IT F'URTHHR RSSOLVfiD by the Pitkin County Board of
Commissioners that it supports the proposed alignment of the Plam
access road and will coordinate with filam Construction, Inc., in

BE IT FINALLY RSSOLV@D that the Pitkin County Board of y
Commissioners adopts the following five (5) policy statements to
guide the County in the future concerning land uses on the Woody �''

J Creek bench of land contiguous with the proposed Slam access
road: �

.t� 2) Current land use zoning on the bench (RS-20) will not be �
effected or chan ed b the BOARD without E� �

-�, :� noticing of adjacent Iandowners and adequate opportunity for �

��1 2) The proposed Elam Gravel Pit access road will remain a '
_,� private access easement from the northern boundaries of the . '
<S W/J ranch to the Slam Gravel Pit property. Said private
;;� access essement will be specifically for the purposes of �
reaching and leaving the Slam Gravel Pit property, the %
_p..� Baxter property and the Meens property;
3) At no time will this Board consider to undertake or assume
maintenance of this stretch of private roadway, or claim
- this stretch of private roadway as part of the County Roed
;x,' System for Highway User Tax Fund purposes, or endeavor to
secure public right-of-way along the private access easement
;r;. for any purpose whatsoever;
4) Poasible placement of a county road and fleet maintenaace
facility on the bench of land surrounding Lhe Slam Gravel
- Pit will not be considered by this Board of County Commiss-
" ioners;

°.� 5) The filam Special Use Per�it may be revised or altered in a
manner which respects the residential character of Che Woody
Creek area and reasonably mitigatee the impacts of the Slam
�'�t Gravel Pit on the neighborhood.

Alternative II-A: P2acement of the Proposed Slam Access Road
' This alternetive would see the placement of the proposed access
road to the gravel operatione on the bench, but would leave the
existing land uses patterns intact. Land use designationa would
remain the same and the Glam access road would be relocated to
' intersect with McLain Flats Road.
