transportation companies to provide service to the Airport;
THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF PITKIN COUNTY, COLORADO:
Section 1 .
That the License Agreements between Pitkin County and three
ground transportation companies (ASpen Limousine, High Mountain
j Taxi and Mellow Xellow Taxi), in forms identical to that attached
as Exhibit "A," are hereby approved and accepted according to �

� County Airport, also known as Sardy Field (hereinafter the �

"Airport") and the terminal building complex (hereinafter the �
i "Terminal" or the "Air-Carrier Terminal"j and does maintain _
; various spaces. for the use of the public and from time to time

does and shall Zicense or permit the use of parts of these areas
! to various individuals, firms or corporations to serve the users p
� of the Airport; and

� WHEREAS, the County has authority to regulate commer-

� cial activities on Airport property and to enforce these regula-
+•I tions, pursuant to, int2r a ia, C.R.S. 1973 41-4-101, et s_e�i-.,

� Code} and the Airport's Ground Transportation Rules and Regula- -

limousine to and from the Aspen/Pitkin County Airport under
authority granted to it by license{s) from the Public Utilities
Commission (PL1C) of the State of Colorado; and
WHEREAS, the County is willing to permit tha Company to

B. The County also grants the right to use such
roads, driveways, loading and unloading areas, waiting areas and
stacking 2ines as are identified by the Director of Aviation for
taxicab and/or limousine commercial use. .

4. Use of Premises,
A. The County hereby grants to the Company the right
and privilege to occupy the Terminal area described above at all

equipment and supplies necessary to operate its business. The

' booth shall be manned at the discretion of the Company but shall ! ,
be kept and maintained, whether manned or unmanned, in a clean,
picked-up and business-like fashion. The Company further agrees
� to use the area hereinabove describe@ for the said purposes
�� stated only, unless otherwise authorized in advance in writing by
the Director of Aviation. The Company shall be provided with
entry for its vehicles to the taxi and/or limousine loading area,
� subject to any rules and regulations now in effect or hereafter

iadopted regarding the Airport for the purposes of the parking and
i loading of passengers and lugqage, and situate approximately
i where shown on Exhibit "A". No display or device sha1Z be

installed upon the Terminal space which in any way obstructs the
public view of or access to another liaense space, and all

Airport. The Company may, in the discretion of the Director of
Aviation, be permitted to utilize the premises before and after
the hours which it normally operates; PROVIDED, that any escpense -

finish the exterior of the same and provide utility connections

Aviation. All work done by the Company shall be completed

first-class design and finish standards of the Airport. The
Company, subject to the provisions of paragraph 11 hereof, shall

be entitled to remove all items incorporated in the interior i
i finishing and signage of the shell booth so long as the removal �
is completed without damage to the booth structure.
� D. The Zicensed space may be used by the Company for
i purposes of disseminating information to the public and the

� solicitation and coordination of business, all in a businesslike
manner, and for use as office space, limited to the conduct of +

16. Master Plan (Airoort and Transit)/Rates and Charges.
Company acknowledges that the County is planning the construction
and operation of a public mass transit ground-transportation
system, which may restrict or prohibit private vehicular access ��":��=��=>

Airport entrance/frontage road/traffic circulation system and the

a. The Licensee shall conduct its commercial operations

b. Licensee acknowledges that the County has an interest

� attempts at resolution. In addition, Licensee shall submit a
jsemi-annual report to the Director of Aviation, on the first day
j of the month of the months of May and November, of all substan-

� tial complaints received by Licensee, including those referred by

� County. Failure by Licensee to resolve a great majority of

i these complaints to the satisfaction of the Director of Aviation

� shall be grounds for non-renewal of this Agreement.
