WHEREAS, Pitkin County owns and sponsors the Aspen/Pit- �f::' .'

of the Airport and to set, charge, collect and enforce rates,
fees and charges for the use thereof; and �
WHEREAS, the County adopted Resolution #$7-56, its
annual Airport rate-maKing resolutfon on September 14, 1987: and

WHEREAS, since the, adoption of Resolution �87-56,
certain events and developments have taken place affecting
Airport rate-making, namely: budget estimates for 1988, continu-
ing negotiations for the acquisition of the Airpozt Ranch
`� property; continuing negotiations with the two present signatory

`� scheduled air carriers; and a federal district court lawsuit
� objecting to the rates, Eees and charges established by Resolu- t`
tion #87-56; and

WEiEREAS. the County, in an effort to keep its Airport
rate-making in conformance with applicable law, intends to amend
Resolution #87-56 to conform to said changed circumstances;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF PITKIN COUNTY, COIARADO:
Sectlon 1. That Section 1 of Resolution �87-56 be ,�;;�:�.`,_ _ .

repealed and reenacted to read as follows: `���`

"Sectfon 1. It is hereby declared to be the policy oE
the Board of County Commissioners of Pitkin County, Colorado ,��. -
("Hoard"), for the ma»agement, planning, financing and develop- ��'�.
ment of the Aspen/Pitkin County Airport (Sardy Field) and for the
establishment of rates, fees and charges for the use of the r�.�
Airport: �`
a.;;'�'1 �
1. The Airport will be managed, planned, financed and F:;:.l
developed in a commercially reasonable manner, consistent with e': �:
� accepted Airport manaqement, planning, financing and development
practices, the long-term financial health of the Airport and �
- Aspen's status as a premier mountain resort community with peak
winter and summer seasons and a substantial year-round business
and residential community.
2. The Airport will be operated as an enterprise fund;
that is, the Airport is to be financially self-supporting and all
operating, financing, debt service and capital replacement and
improvement expenses are to be paid by the lessees, licensees and
permittees at the Airport. Likewise, all revenues generated at w
the Airport shall be spent on the operations, planning and
improvement of the Airport. -
3. Capital projects, whenever possible and reason-
able, but especially when the size of such projects is ineffi-
cient for debt financing, shall be funded by cash from opera- .
tions. Funds for capital costs shall be accumulate$ as follows:
First, funds sufficient for capital replacement; Second, Funds
sufficient to provide local matching funds for the amaunt of
Federal Aviation Administration (FAA) grant funding on an annual
� basis that can be reasonably anticipated (actual expenditures of �
fuads subject to FAA approval of projects and compliance with
annual budgets, multi-year financial plans or the Airport Master
Plan [and updates thereof]); Last, funds sufficient for capital � �
replacement, improvement or land acquisition not eligible for FAA
funding but which, in the determination of the Board, are
necessary for Airport management, development, or long term `• '
planning. All such capital accumulations and expenditures shall

be supported by annual budgets, multi-year financial plans,
Master Plans (including updates thereof) or other long-term
planning studies. All such capital accumulations shall be
earmarked for specific projects or acquisitions and, with respect
to projects or acquisitions with long lead times, the County
slaall make certifications at least annually, as part of its rate-
making process, of good faith progress in such projects and .
acquisitions.
4. Debt for Airport projects shall be undertaken only '��';`:. -

of the highest possible investment-grade instruments, to insure ,.�_.�,.
the most cost-efficient debt and to maintain the Airport's long- �,•

5. The rates, fees and charges established for ��'

lessees, licensees and permittees shall be, to the extent • •
required by law or by further policy of this Board, fair, f�_`.�
reasonable, equitable, not unjustly discriminatory and not •�.,;+'; '`
burdensome, all 3s determined by this Board upon substantial ?�''�.� ..
competent evidence. In making these determinations, this Board :�'�"ss:t.:
shall considar at least the following factors (in no order of ��=`� �•
priority) : r'
�`
� a. the total actual Airport costs incurred to be � _
- recovered;
b. the Airport's annual budget, adopted multi-year
financial plan and projections, and adopted Airport
Master Plan (and updates thereof) ;
c. market conditions, e.g., comparable costs and
charges in comparable Airport and commercial
locations; Z
: d. the cost of providing services and facilities to
the various classes of lessees, licensees and
permittees and the impact on, need for, use of and
benefit to these users from present and future
• Airport land areas, facilities and services;
e. custom or accepted practices in the industry, with
adjustments for the mountainous, high-peak-season
resort environment of the Airport;

f. requirements of federal and state statutes; the
Pitkin County Home Rule Charter and Code; and FAA � �'
funding and/or operational requirements; k
g, planned and anticipated capital costs, including ���:

be considered and established by this Board annually as part of �.. ,

reasonable, constructive input from Airport lessees, licensees �>!.�

Section 2. That Section 3 of Resolution #87-56 shall �� ; `

� be repealed and reenacted to read as follows: �
� "Section 3. That the landing fee for signatory sche-
j duled air carriers and signatory FAA Part 135 charter operators
contained in Section 4-1 of Article 4 of the Pitkin County
; Airport Regulations, Title IV, Pitkin County Code (and the
'� Airport's schedule of rates, fees and charges for lessees,
licensees and permittees), shall be and hereby is repealed and
i reenacted as follows:

� '4-1 There is hereby imposed on, and shall
be paid by, all. signatory scheduled air �
'�� carriers and signatory FAA Part 135 charter �
operators authorized to serve Pitkin County F
j and using the airport, a rate or charge on �
j all arrivals of aircraft, from which such
a carrier or operator shall derive revenue, !-
'� equal to sixty-five cents ($.65) per one
thousand (1,000) pounds of maximum allowable
gross landing weight; and a rate or charge on �
all arrivals of aircraft, from which such
� carrier or operator shall not derive revenue t
` (including touch and go operations), equal to �`, '
� fifty-five cents ($.55) per one thousand
�; (1,000) pounds of maximum allowable gross
� landing weight; provided there is imposed for t
each such landing the minimum sum of three

no rate or charge shall be due and payable in
the event an aircraft departs from the
airport for another destination and is
forced to return and land at the airport
because of ineteorological condition, mechani-
cal or operating causes or for any similar
emergency or precautionary reason. The term

Section 3. That Section 4 of Resolution #87-56 be
repealed and reenacted to read as follows:
"That the Terminal Rental for signatory airlines shall be set at
a total of $535,828 per year (approximately $26.0o per square '�
foot)."
Section 4. That all rates, fees, and charges herein
estabZished are determined and declared by this Board to be in ' •
compliance with its rate-making policy as set out in Section 1., �
herein.
Section 5. Sections 2 and 3 of this Resolution shall
be effective from and after 12:01 am, MST, December 28, 1987. t
All other sections shall be effective upon adoption. � �
Section 6. The provisions of this Resolution shall be
