Colette Penne and Fred Crowley. ' �,c CALL TO ORDER: Chairman Madsen called the meetinq to order at 4:30 p.m. `� �s.' He stated that the public hearing was actually closed at the �,'-:�;'' ' last meeting, but would accept any comments from the public •` after commissioners have finished their deliberations. '� ` � Tom Smith, County Attorney, reported to members that there are �( two more conditions to be implemented: (ij That conditions will be implemented by county staff in a way not inconsistent with Federal Permits. (2) That the $1,000 bond already posted with the Forest Service for revegetation serve for the County Prospec- • ting Permit to the extent that those sums are not retained by the U.S. Forest Service. Penne moved to grant a Prospectinq Permit to the Colorado Conundrum with the 12 conditions outlined in staff's memo which is attached to and made a part of these minutes as Exhibit "A". Crowley seconded and the motion passed with three yea and one nay vote by Slake. In the event that the applicant pursues to implement a full scale mininq activity on the site pursuant to section 3-3.6 of the Land Use Code, it shall be demonstrated prior to consideration of an application to the County that the site has been� reclaimed to the � satisfaction of the County. , 10. Excavation and prospectinq will be limited to the � � loading area and an area on the small bench located ' within a quarter acre of the small grouping of marble deposits. 11. By acceptance of this permit, permittee consents to the application of a12 of any portion of his $1,000.00 cash c_ bond previously posted with the U.S. Forest Service to secure performance of his obligations under this � �' permit, to the extent those sums are not retained by Che U.S. Forest Service to Pund its own revegetation '. i ,. requirements. 1, � . :: _. 12.
