The Colorado State Forest Service of the State Board of Agricul- � -
` ture, and Pitkin County desire to jointly participate in a trial ='
effort to utilize available fire suppression aircraft for control- �
ling wildfires (being brush and forest fires, but not structural �-'. ..
fires) on nonfederal lands in Pitkin County for which the Sheriff
is responsible. The CoZorado State Forest Service (CSFS) and ��" `
� Pitkin County also desire to test cost-sharing of specific, t
� initial attack fire aircraft necessary far wildfire suppression. 3„

� The purpose of this test effort is to: �

a 1. Encourage aggressive initial attack when such actions
� can prevent l.arger more costly wildfires;
� 2. Evaluate fire aircraft use as an early warning �or �` -
S possible Emergency Fire Fund contract implementation in �'

A. To take part in this test, Pitkin County agrees to: t�
� 1. Maintain participation in the state-wide Emergehcy Fire
� Fund (EFF) Contract (the parties acknowledge that Pitkin
County is a paid-up, current participant) ;
�� 2. Designate the County Sheriff and one alterhate represen- �,
� tative as the only County individuals authorized to
.� order aircraft under this Agreement, and transmit those j
names to CSFS prior to May 15; for this purpose, the �Y

For purposes of this Agreement, Sheriff Sraudis and
Undersheriff White are designated as °Incident Comman-
ders," with duties described below.

4. Notify the Grand Junction District of the Colorado State rJti
Forest Service immediately upon order of the first c-�

� 5. Upon receipt of invoice from CSFS, reimburse CSFS for
Pitkin County's share of aircraft costs as outlined in

; B. To take part in this test, the Colorado State Forest Service
j agrees to:

� 1. Provide consulting and assistance to Pitkin County,
� either prior to Pitkin County's order for the first fire
€ suppression aircraft, if so requested by Pitkin County,
� or immediately after such order, which assistance in-
� cludes, without limitation, as follows: recommended
* tactics to control the incident; calenlation of forces
a necessary to control the incident; estimate of necessary
; aircraft, number o£ drops and County share of costs; t:
! additional air support or air tanker drops; advice on
� Emergency Fire Fund implementation potentials. +5
i2. Aggregate billings for fire aircraft used and pay their
� full cost.

Only qualified, adequately-trained crews and adequately- �
' maintaihed aircraft will be sent in response to Pitkin
1 County�s order.
� 4. If aircraft ordered by the County are out-of-state,
! #light costs to arrive at the closest Colorado loading
1 base wi21 be disclosed at time of request by the County
' and may have to be paid for by the County at one hundred `
� percent of the cost.
� 5. This trial effort refers only to initial attack aircraft 'i
� used to bring wildfire incidents "under control." It `:`�
j does not extend to ��mop up" operations. "•

necessary. CSFS must be notified when first aircraft is

7. More than one aircraft resource may be used simultaneous-
ly on an incident if determined by the Incident Commander
at the scene.
8. This Agreement does not apply to search and rescue, law ,
enforcement or County-owned aircraft operations or to
fire suppression subject to the EFF Contract. �
9. Participation in this test program does not require the "'`{�:`�•-
County to utiliza fire aircraft if such aircraft are not k`���
necessary to prevent higher suppression costs or value �":'y''�{
losses as determined by the Incident Commander at the ��'-•--

10. This Agreement does not guarantee aircraft availability ,y�,``
' within Colorado or at a particular base. Fire suppres- _tt�=.. ,
� sion aircraft are often called to other locations in 'k`°
' Colorado or the United States for wildfire su ression. �`� �

Such aircraft ma also be unavailable while in Colorado � '-
' due to required rest/repairs. j�Nt�
11. This Agreement and the obligations of both CSFS and �° �
� Pitkin County hereunder are expressly contingent on r'
adequate fnnds being bndqeted and appropriated therefore. ��.
; The parties are, as to each other, independent aontrac- � •:
tors. Either party may terminate this Aqreement upon
thirty (30) days written hotice. In the event of breach
hereof, the non-breaching party may recover its costs
and reasonable attorney fees incurred in any suit brought , .
� by reason of such breach. �
12. Indemnification. To the extent authorized by law, CSFS ( �
(and its contractors or subcontractors) shall 3ndemnify, +
save and hold harmless the County, its officials, employ-
ees and agents, aqainst any and all claims, damages,
liability and court awards including costs, expenses,
and attorney faes incurred as a result of any act or
omission by CSFS, or its employees, agents, subcontrac-
tors, or assignees pursuant to the terms of th£s Agree-
ment.
