terminate its participation in tliis Agreement six monrlis
after providing written notice of such termination to the
� other parties to this Asreement. This Agreement may be

State. In this case the State must approve such termination

GRANT ADMINISTRATION APtll IPiPLEMENTATION
i. The Region 12 RLFC does hereby agree to become the t
subgrantee for tlie above mentioned grant. As subgrantee the ��'
: Region 12 RLrC assumes all responsibility as allowed under
the laws, rules and regulations governin� 11UD-CDBG prngrams .'�
or federal grants in general. The Region 12 RLEC shall
! administer the program in accordance with the attached loan

1. The R-IZ RLPC shall comply with alI the conditions of the
HUD-CDBC state contract Lor project 1(87-868 as found in

as part oL said contrnct. The R-12 RLPC shall also comply �'''t•
with all the laws, rules, and regulations governing IIUD-CDBG I'-�-��'��;��
programs and federal grants in general that may be ��=,=:'�., .
applicable unJer this state contract. "'

' SUPPORT S�RVICLS AND CONTRIBUTIONS

1. The courtty does hereby agree to provide the foll.owing
services to lhe R-12 RLFC for this program: �
; A.) Provide for the accounting of all grant funds and ''ti'
conduct an audit of this grant in conjunction with other ,�',;.
T coanty funds in accordance with the single audit corccept aad

`� 4 Upon its request, Summit Counly map Ue reimbursed by R-12
F RLFC for the costs of the portion of the 5ummit Cowity audit

? " ' B.) From time to time L-he R-12 RLP'C, through its Loan
� Administrator will apply to the state for funds as part of '
� ' the contract mentioned herein. As L-hose Fund requests are
; approved by the state, funds will be transferred to Summit •
� County, as the lead connCy in the ttUD-CDBG Contract �#87-868, i '
and it is lierein agreed that all funds so received by Summit
. County will be immediately transferred to tlie R-1Z RLFC
account in order to be disbursed and/or held for
' disbursement. The Summit County staf# position responsible
for the immediate disbursal oF funds to the R-12 RLrC is the
� Summit County Fiscal Otficer.

� 1. The R-12 RLI'C agrees to prepare the preliminary review '!�'
for tlie IIUD-CD13G program as a whole as well as individual
environmental revie��s for specific business loans. The R-12
i RLFC will also prepare the necessary public notices know as
�' Finding of No SigniEicant Impact (FOSNI), Notice of Request
I for Release of Funds (NORRLOr) and l-he actual Request for
Release oE Punds (RRLOC). These and other communication

quarterly progress reports within 15 doys following Che end �

shall he presenL-ed to the Commissioners for review prior to

demands and claims to compensation arising under this Contract are contingent
upon receipt of such funds by the State. In the event that such funds or any

a. General Provisions. Tliis Project consists o£ providing Community Development
Block Grant (CDBG) funJs to the Contractor for a revolving fund program to

permanent jobs will be directly created or retained through the provision of
CDBG funds. The Contractor shall insure tl�at at least seventy percent (70%) ,. •
� of all jobs created are filZed by low and moderate income persons. At �.east
� fifty-one percent (51Z) of jobs created or retained by each borrower sliall be
' filled by low and moderate income persons.

' (5) An advisory committee which is representative of public and privat•e

exceed ten (10) years unless it is demonstrated that a longer term is
necessary to leverage other public or private tunds. Providing assistance
for . a term of grenter than ten years shall be done only after receiving prior

including but not limiled to principal and interest poyments, origination

income shall be retained by the Contractor or SuU-grantee and added to other
