W I T N E S S E T H:
'WHEREAS, the Board is seized of any estate in what is
. commonly called the Rio Grande Trail, which is the former �°s�.;'�.:.
Denver and Rio Grande railroad right-of-way, and �;: ?

� WHEREAS, Hines/Duncan are seized in fee simple of a parcel { �
of land southwest of the Red Mountain Road and slightly
southwest of the ?tio Grande Trail, and
WHEREAS, the sewer line to service the property of Hines/
Duncan is located within the Rio Grande Trail right-of-way,
NOW THEREFORE, HE IT RESOLVED that for and in t
consideration of the sum of Ten Dollars ($10.00), and other �
consideration, and the mutual promises herein set forth, it is
agreed as follows:
l. The Hoard grants to Hines/DUncan the right to `
construct and operate a sewer line from the property described

in Exhibit A, underneath the surface of tihe Rio Grande Trail, �'�"
an easement described as follows to connect the two residences ,��
to be constructed on the Hines/Duncan property to the sewer

2. Hines/Duncan covenant and agree to disturb for ; �.:-
'�• the minimal time necessary to dig and install the sewer line, ��
to repave the Rio Grande Trail and restore it to its prior
condition; and agree to indemnify and hold harmless the Board
from any damage to that Trail. The minimal time estimated to
dig and install the line is four hours; and during such
interruption, the contractor shall provide an alternate path
Por walkers and bikers.
3. Hines/Duncan represent there will be no
subsidence of the surface. However, if that representation
should be incorrect, Hines/Duncan agree for themselves and
their successors forthwith to repair, re-blacktop, and be t

responsible for any subsidence caused by the sewer line �, °'
easement at their sole expense.
4. This easement will run with the land described '\ .';
in Exhibit A attached hereto, and be binding upon the parties ,

This grant and approval of an assiqnment of a private way
easement is made by the BOARD OF COUNTY COMMISSIONERS OF PITKIN
' COUNTY (hereinafter "Pitkin County"), to JEFFREY C. HINES, JOHN
H. DUNCAN, and BRENDA P. DUNCAN (hereinafter "Hines/Duncan").
WFIEREAS, the Denver Rio Grande Western Railroad Company _
(hereinafter "the Railroad") granted a private way license, '��ti� �-
dated July 15, 1959, to Samuel W. Howell and William Lane for v;:-�;

the purposes of providinq an access easement across and along ?
the railroad right of way to a parcel of land owned by the ''�+''• • -
grantees in the northwest quarter of Section 7, Township lo :"'�' ,

� South, Range 84 West of the Sixth P.M., which private way '�:;. _
license was recorded in Hook 188 at Page 366 of the records of �:

WHEREAS, William Lane and Samuel W. Howell divided their ��_•
tenancy in common between them by boundary line deeds recorded ��`
in Book 243 at Page 600 and Book 243 at Page 601 of the records �`�;'.��'.

WHEREAS, in a dissolution of marriage, William Lane ,� ,
:. conveyed his interest in that marital property in Section 7 �
above described to his former wife, Joan B. Lane, by a deed
- recorded in Book 501 at Page 995; and
WHEREAS, the Railroad conveyed to Pitkin County the
railroad right of way by deed dated June 18, 1969, recorded in
Book 243 at Page 217, subject to all prior easements, including
the private way license referenced above; by a correction deed
dated November 1, 1974, recorded in Book 310 at page ��; and
by a quit claim deed dated May 27, 1976, recorded in Book 312
at Page 561; and
WHEREAS, Joan Lane conveyed her property to Hines/Duncan
by deed dated October 2, 1986, and recorded in Sook 520 at Page
138 of the records of Pitkin County, accessed by the private �
way license, and assigned the rights to the use of the access
� easement which connects the Hines/Duncan and other parcels to
Red Mountain Road, and which has been in place since 1949 to
Hines/Duncan; and
WHEREAS, the parties desire to confirm the assignment of �,..
_ the rights to use such private way license to Hines/Duncan by
virtue of the division of the cotenancy between Howell and Lane y, ''
` and the conveyance from her husband, William Lane, to her in t
