AGREEMENT FOR THE CONSTRUCTION OF ROAD IMPROVEMENTS
THIS AGREEMENT made this �� day of ` ,� ,
' 198�, by and between Marc S. Friedberg and Karen P. Friedberg,
hereinafter referred to as Friedberg, and the Board of County
Commissioners of Pitkin County, Colorado, hereinafter referred to
as County;
WFiEREAS, Friedberg has granted to the County a certain deed �;'��','i' -
for roadway purposes; and •,:,.;;. .

WHEREAS, to protect the remainder of the Friedberg pro ert �
the County has agreed to construct certain improvements and make ;�.p, •
certain design changes, more fully described below. �,;;� �.:.
NOW, THEREFORE, Friedberg and County, in consideration of
the mutual covenants hereinafter set forth, agree as Follows:
. Article 2. Par]cina and Stairwav Improvements � 5
The County shall construct two parking spaces on the g.,� .
Friedberg property to replace the existing spaces which were lost � =
�;, .
�, due to the reconstruction of the Red Mountain Road.
The new parking spaces will be constructed on a platform 24-
foot wide by 24-foot long and retained by a masonry block
foundation as shown on the attached sketch. Building materials
sha1Z be similar to the structure of the Friedberg residence.
In addition, the County shall replace the existing stairs
using materials and design techniques similar to those of the ;
existing improvements.
�rticle 2 BuiZdina setbaaks
The County shall not oppose exemption from the Building
Setback requirements of the Pitkin County Land Use Code upon
application to the Board of Adjustments should Friedberg wish to
construct a parking garage on their land at the location of the
new parkinq spaces.
Article 3. Construction Practices
' During construction of the Red Mountain Road, the County ;;
� shall take all reasonable care to protect the avergreen trees !"
� adjacent to the construction area. Prior to beginning construc-
; tion on the road, the trees shall be inspected and measuzed.
Should any of the evergreen trees die or show abnormal distress k
for a period of one year followinq completion of the road `
improvement, then the County shall replace the trees, in kind, at ,�
County's sole cost.

Article 4, Dasian Chanaes �����!��
The County shall modify the current construction plans for
- the Red Mountain Road to reflect the following design changes.
� 1. The concrete curb and gutter shall be eliminated
along the West side of the road adjacent to the Friedberg •
, property. �
2. No parking limitation shall be placed at the Red _:;�;�_;,s�.:
Mountain road adjacent to the Friedberg property. '` {t,
