RECtTALS
1. The Aspen City Council,the Pitkin County Board of County Comtnissioners and �!`t'
the Town Council of Snowmass Village(the"Parties")have previously identified general elements s.:;..��
of their Comprehensive Valley Transportarion Plan(the"Plan")which are eligible for funding from
the Pitkin County one-half cent transit sales and use taac. , „
2, By intergovemmental agreement dated September 14,1993,the Parties agreed:
, : ..
�� a. to conduct regulaz public meetings to continue to refine and agree upon R
proposed projects and transportation elements consistent wiHi or complimentary to
j the Plan;and

: b. that all expenditures and projects to be funded from the County-wide one- r
� half cent transit sales and use taac shall be agreed upon by the Parties and evidenced t
' ! by a resolution adopted 6y tlie goveming body of each party.

- . � i 3. By prior resolution the Parties budgeted$1,624,000 from tlie one-half cent transit
sales and use tax in 1996 for[he upper-valley share of the purehase of the rail right-of-way in the
• ' Roaring Fork Valley. However,the right-of-way purchase has been delayed into 1997,requiring �.
' _ reauthori7ation of this budget for 1997.

� ` 4. Great Outdoors Colorado("GOCO")has granted$2 million toward the purchase of
the rail right-of-way,but only$1 million will be made available at closing with tkte remainder to be
paid within three years. At a public meeting held on January 9, 1997,the Parties considered and
' approved making up this shortfatl at closing with$i million from the one-half cent transit sales and
` use tax. Atfachment"A"illustrates flie$2 million GOCO grant expenditure for the right-of-way in
, 1997 with only$1 million of the grant revenue budgeted in 1997 and the remainder anticipated in
� `i 1949.
t 5. The Colorado Department of Transportation("CDOT"'),Garfield County,and Eagle
County have granted$3 million,$500,000, and$1OQ000,respectively,towazd the purchase of the
j rail right-of-way,and such amounts need to be appropriated as revenues and expenditures in the
1997 budget.
� 6. At a public meeting I�eid on February 6,1997,the Parties considered and approved
' the expenditure of up to $3Q000 from the one-half cent transit sales and use tax for a
Transportation Linkages Workshop,with 50%of the cost to be reimbursed by the Aspen Skiing �"
Company.

7. Budgetarily, more revenues are anticipated to be received in 1997 than were '�r•�� '
appropriated, resulting in a portion of unappropriated fund balance available for unanticipated " ,':
expenditures that occur during the yeaz;and :..', �
8. Upon due and proper notice, published in accordance with the Pitkin County 1�`. .•
Homerule Charter and state budget law,said supplemental budget was open for inspection by the
public at a designated place,a public heazing was he�d on February 26,1997,and interested citizens �;: `? �
were given an opportunity to file or register any objections to said supptementa(budget. ' �
