� �MERG�NCY RESOLUTION OF THE PITKIN COUNTY BOARD OF -
COUNTX COMMISSIONERS RESTRICTING AND PROHIBITING THE �
TRANSFER OF DEVELOPMENT RIGHTS FROM PROPERTIES LOCATED *�
WITHIN THE FRYING PAN RIVCR DRAINAGE AND STUDY AREA WHICH ��•
ARE ZONED RURAL/REMOTE ' •
Resolution#97-�
�:
I. On March I 1, 1997,the Pitkin Courtty Board of County Commissioners
("BOCC)held a town meeting in Thomasville in the Frying Pan River,a community ;`
within Pitkin County.
2. Residents from Thomasville and Meredith as well as the Frying Pan River Valley
requested the BOCC to immediately prohibit the transfer of development rights from the
!� � . Rural/Remote zone district within the Frying Pan River drainage.

` 3. The BOCC heard testimo�y from residents of this area that the continued transfer
} of development rights was having a detrimental effect on their community. The residents
stated concerns that the transfer of development rights would impair or detrimentaUy
� impact their ability to recommend to tfie BOCC future zoning initiatives ar master
� planning efforts involving the regulated growth of their community.
. , ? 4. The BOCC has previously committed itseif to continua(reviews of the
' - ! � transferable development rights program.

5. Residents of the Frying Pan River Valley are presently engaged in the
� : establishment of a caucus as provided by the Pitkin County Home Rule Charter. Upon
' , establishment of that caucus the residents will have an enhanced ability to recommend
� , changes to the zoning within their community.
_ 5. The BOCC Fnds that without adoption of an emergency resolution prohibiting the
� transfer of development rights from the Valley,the residents efforts to recommend
' changes to existing zoning provisions could be impaired and constitute a detrimental
- effect on the public health,safety and welfare for the communities within the Frying Pan
� , Valley.
t " 7. By this resolution,the BOCC directs its staff[o prepare and recommend any
appropriate,permanent changes to the Rural/Remote district as it currently exisis in the
i ' Frying Pan VaUey. �
' 8. The BOCC recognizes that certain individuals or entities may have acquired
s interests in real property within the Frying Pan Valley which is zoned Rural/Remote for
the purpose of utilizing the existing transferable development rights program. Therefore,

this resolution shall not apply to properties with ownership interests acquired between -��.�4`'�:

NOW THEREFORE,be it resolved that the Board of County Commissioners of '�•
Pitkin County,Colorado,restricts and prohibits the[ransfer of development rights from , ° �
properties located within the Frying Pan River drainage and study area which are zoned " �
Rural/Remote. ,
This restriction and prohibition shall not apply to properties with ownership '
interests acquired between November 15, 1995 and March IZ, f 997.

The BOCC finds that this resolution is necessary for the preservation of the public `
health,safety and welfare. '
Any property owner who is adversely impacted by this emergency resolufion may s
± � � . appeal the application of this resolufion ro the BOCC. r

� This emergency resolution is effective immediately.
4
Terms of this resolution shal!expire 180 days after its effective date.
