L The James E.Moa-e Pzmily Partnership (hereinafter "Applicant") has
applied io the County for Detailed SuUmission; Planned Unit Development(hereinafter
�, � "PUD"), 5ubdivision, Special Review, Ridgeline Review, Growth Management Quota
`F System("GMQS")Exemption,and 1041 Environmental Hazard Review.In addition,the :
. Applicant has applied for rezonin�pursuant to the Pitkin County Land Use Code. The
y Applicant was granted residential growtli management allocations from the 1993& 1994
metro area allocation pools and General Submission approval,by the Board of County
Conunissioners (hereinafter "Board") pursuant to Board Resolution 95-30, attached as�
x �xl�ibit A.

� 2. Tlie James E.Moore Family PUD project includes the following elements:

* 40 free-market single-family residential lots;

- . * Ski Club Facility;
i * Ski Lifr fiom High School area to the top of Powder Bowl;
• � • * Substantial improvements to the roads and parking lots on the Public School
Campus;and,
* a multi-use trail systent.
3. The subject praperty is lpproximately 179 acres in size, and is more specifically
described in tl�e attached Exhibit B. At the time of Detailed Su6mission application,
. `; � approximately one hundred forty-one (141) acres of the property were zoned
� AgriculturallForestry/Residential-IO ("AFR-10"). Refer to Exhibit C for a copy of the Pitkin
� County Land Use Code standards for the AFR-l0 zone. At the time of Detailed Submission
application,approximately thirty-seven (37)acres were zoned Agricultural/Forestry/Residential-
�t 2("AFR-2"). Refer to Exhibit D for a copy of d�e Pitkin County Land Use Code standatds for •
the AFR-2 zone.

� Commission subsequently considered tl�e Moore PUD Detailed Subrnission application at public
meetings ai August 20&27, 1996 and recommended approval to the Board. The Commission
considered the Applicant's rezoning request at a public meeting on March 17, 1997, and
forwarded a recommendation of approval to the Board.
.. 9. Tlie Board considered the General�Submission application at public meetings on
,Tanuary 10;January 24;January 31;February 13;Febraary 21;and Febnaary 28,aJl in 1995.The `
duly noticed public hearing was opened on January 24, 1995 and was continued at each of the ;
subsequent meetings and officially closed on February 28, 1995. The Board considered the
Moore PUD Detailed Submission application at public meetings on November 2Q and December �� �
17, 1996, January 8, 1997,January 13, 1997,Pebruary 12, 1997,and March 26, 1997,and at a �
duly noticed public hearing on April 2, 1997.Throughout tltese meetings and hearings,evidence
and testimony was offered by the Applicant,Staff,and members of the pubiic. �

! 13. The Board further finds that the proposal to rezone portions of tl�e Moore property (��
was referred to the City Planning and Zoning Commission for review under the Aspen Area t'`
Community Plan at General Submission,as required by the Pitkin County Land Use Code. �?�.

- � 14. The Board further finds that appropriate and legai notice was provided to the �
• � public witl� regard to the Moore project, including residential GMQS hearings, and that the �
, � � i County is in compliance with the applicable sections tl�e Pitkin County Land Use Code and the
Pitkin County Home Rule Charter.

- . 15. The Moore PUD flpplication requested rezoi�ing to Agricultural/Forestry-3("AF-
3"),a zone district whiclt existed when tlie application was submitted on September 1, 1993(see
- Exhibit H). When the Board granted General Submission approval pursuant to Board
Resolution 95-3Q the Board postponed consideration of rezoning until Detailed Submission.
Board Resolution 95-30 was originally signed on July 18, 1995,and recorded at Book 799 at �
Page 158. The Resolution recorded at Book 799 at Page 158 mistakenly included references to
? rezoning of it�e property pursuant to Bozrd Ordinance 95-08,when,in fact,all rezoning actions 4
? were postponed until final approval consistent with Pitkin County Land Use Code procedures. �
` Board Resolution 95-30 was corrected,signed on J�nuary 25i 1996,and re-recorded at R,et'g(9�IoN !�

� that actions pertaining to rezoning were not taken at General Submission,and that the Board did

18. Tlie Board further finds that die Moore PUD is entitled to one (1) Residential
GMQS exemption pursuant to Section 5-510.2(c)of the Pitkin County Land Use Code. "
19. The Bo1rd further finds that the Plnnning and Zoning Conunission properly
scored the 1993 and 1994 Metro Area Residential GMQS applications in lccordance with � r�'
codified scoring procedures,both in the Commission's original considerations and at the March •
17, 1997 duly noticed public ]tearing. Since all applicants in the 1993 and 1994 Metro Area -
Residential competitions received their requested GMQS allotments, the Commission •
appropriatety permitted tlie Applicant to amend a�id modify the application,in accordance with
.... established practice. The Board further finds the 1993 and 1994 Metro Area Residential GMQS !,
. allotments were properly awarded pursuant to the Pitkin County Land Use Code.

j 20. The Applicant deleted a 35 acre tract of open space from the Moore PUD !
subsequent to Detailed Submission review by the Planning and Zoning Commission,but prior to e
' Detailed Submission approval by tlie Board. Changes were also made to the configuration of

G. The employees of the Aspen School District and Aspen Valley Hospital shall be allowed to '�"

7. Tite Moore Family Partners[iip, at its discretion, may construct subsrade space (unfinished •
baseivents) for some of the affordable units/lots. The number and location of units✓]ots witU
basements shall be determined after site-specific soils studies at Final Plat.The Applicant shall ;r��`
be reimbursed for the cost of construction of this additional space by individual lot owners.The
cost of the basements to be borne by the!ot owners shall be added to the resale of the units(not -
to exceed$20,000),but lot owners shall not be allowed to receive value appreciation for the cost •
of acquiring basement space.
e : . 8. Tl�e Applica�t shall submit a Final Drainage and Erosion Control Plan to the County Engineer �
E for review and approval,prior to the issuance of an eart6ntoving permit for the project.The Plan
� shall include specific details on die location and sizing of all temporary retention ponds.

9. Prior to the issuance of an earthmoving permit, tlie Applicant sitall submit designs for all
' retaining walls for the internal road system that are in excess of 6 feet high, prepared by a
i registered professional engineer,to the County�agineer for review.
. . ! 10. The Applicant shall obtain an access permit for the Moore PUD from the County Engineer,prior
� � ! to projecf constniction. Should tiie Applicant dedicate Moore Drive to the County, individual
-. � ' access pennits will be required off of Moore Drive,prior to the issuance of earthmoving permits L•
� � for individual lots. '
11. The Applicant shall not be required to install 1,000 gallon water storage facilities as required by
Condition 30(i)of Board Resolution 95-30(Exhibit A). The provision for on-site 1,000 gallon
water storage is not necessary in that the Moore PiJD wi►t be provided a water supply for
firefigiiting by the City of Aspen.

12. Prior to Final Plat, tl�e plans for the affordable housing units on Lots 6-9 sUall be revised to
include windows on the east e�evations.The ptans for Lots 19-22 shall be revised to compty with
� minimum dimensional standards for single-family homes as set forth by the Housing Authority
Guidelines.

13. Tl�e number of parking spaces in the Elemeniary/Middle Sehool lot shall be limited to 187.This • .
! , parking lot shall include perimeter landscape screening as shown on the landscape plan.
14: The Aspen Consolidated Sanitation District engineer shall ftnalty approve the on-site collection '

j units,one(1)Category 4 four-bedroom unit to be allocated to qualifying entployees of tl�e Aspen
Valley Hospital District, two (2) Resident Occupied four-bedroom units, two (2) Category 4

allocations. The subject property has been deemed to be within the �.
"Metro Area" for purposes of growth management competition. The
1993 metro area residential pool contained 24 allotments.
. Including the Moore application, there were two applications
submitted for the 1993 Metro Area residential growth management
competition. Th� other application was submitted by Fabienne
Benedict for the Benedict Stillwater Ranch project and requested 4 _
four allotments. The Moore application received a score of 87.5
from the Planning Commission while the Benedict application
received a score 83.25.
�E 6. The Planning and Zoning Commission considered the •
! Applicant's request at public meetings on February 3, 1994;
f Februa:! �:��, 1994; August 16, 1994 and October 4, 1994. The
Planning Commission found the application to be consistent with
the applicable provisions of the Pitkin County Land Use Code.
