1. By Resolution No. 88-47, the Board of Counry Commissioners of Pitkin Counry, • �.`:%- -
Colorado, granted a special review use permit to Etam Construction,Incorporated for the `

Elam Sand and Gravel Pit and Asphalt/fiot Mix/Concrete ptant pursuant to Section 3- c�
21a.10(formerly Section 3-6)of the Pitkin Counry Land Use Code. E��,r>_
2. Resolution No. 88-47 requires an annual review of the Elam operations for r�°:
compiiance with all terms and conditions of the resolution and subsequent resolutions.

3. On January 22, 1997,the Board of County Commissioners(hereinafter,"Board")held 4.'`� .
the annual Public Hearing and Review of the$lam Sand and Gravel Pit Speciat Review �
Permit for the operation year of 1996. "

: -� 5. The next annual review of the Elam Special Review Permit shall be held in December,

, � THEREFOILE,BE IT RESOLVED,that the Board of County Commissioners of
i Pitkin County, Colorado, hereby find Elam Construction, Incorporated to be in
. compliance with their pemut subject to the following conditions:
; ' 1. All material representations made by t6e applicant in the apptication,in subsequent
' � correspondence,and at the public hearing shall be adhered to and considered conditions
� of approvai.

, . ; 2. The applicant shall continue to be bound by all conditions of Resolutions No.8$-47,
.; ! 91-69,94-30,and 95-2d4. �

3. Aa impervious membrane meeting the approval of the Environmental Health Dept. �
. shatl be put azound the Kelly Trucking fuel storage area in the spring of 1997.
4} Pzior to beginning any�crushing activities in 1997,additionai dust conuol devices will '
be insta(Ied on the conveyor system.
5) Tn 1997,the crusher operations will be placed in a different location and configuration (
