TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH EAGLE
COUNTY TO FORM A MULTICOUNTY AREA TRAUMA ADVISORY CQUNCIL .�. .

- RECITALS
1. Pursuant to the provisions of Section 18 of Article XN of the Colorado Constitution
and Section 29-1-203,C.RS.,as amended,Eagle and Pitkin County may cooperate or
contract with one another to provide any function,service or facility authorized to each ,
' County;

_ � 2. The Geueral Assembly of the State of Colorado enacted the Colorado Trauma Care
r System Act,Section 25-3.5-701,et seq.,C.RS.(hereinafter AcY');

t 3. Tlris Act requires that the Board of Commissioners of each County establish an Area
Trauma Advisory Council(hereinafter"Council")witliin each Couuty;
= 4. This Act allows t6e goveming body of a County to agree with the goveming body of
- one or more odier counties to form a multicounty Area Trauma Advisory Council,Secrion
t 25-3.5-704(lxc}(A),C.RS.;

� 5.Pitkin County recognizes that appropriate care for those persons experiencing a
- traumatic injury is immediately necessary and that much of the infras�ucture and
" ` cooperative spirit needed to create such a multicounty organization including shared
"� i resources,equipment,and facilities that provide trauma service akeady exist;

6.The Board of County Commissioners of Pitkin County recognize that the benefits and ,
_ � advantages obtained by working with Eagle County to develop a statewide trauma system
are greater than by participatmg as individual counries and therefore desire to participate
' with Eagle County iu a multicounty Area Trauma Advisory Council.

• - ; � NOW TI-IEREFORE BE IT RESOLVED that the Board of County Commissioners of
� i Pitldn County,Colorado,approves the intergovemmental between Pitkin and Eagle
t Counties wluch provides for the multicounty Area Trauma Advisory Council and

THIS AGREEMENT is entered into this�day of ,1997,by and
between the Boazd of County Commissioners o the County o agle,Colorado(hereinafrer -
"Eagie"and the Boazd of County Commissioners of the County of Pitkin,Colorado(hereinafrer
"Pitkin"),sometimes refeaed to herein as the"County"or"Counties"as the case may be.
- WHEREAS,pursuant to the provisions of Section 18 of Article XIV of the Colorado

NOW,THEREFORE,for and in consideration of the mutval promises,covenants,and y;t,, .�,,
obligations hereinafter set forth,Eagle and Pitkin agree as follows: 1,

1. Eagle and Pitkin agree to jointty establish in cooperation with each other a � '�
multicounty Area Trauma Advisory Council for the Roaring Fork Valley fo include Pitkin l.'C;�,, y
County and those portions of Eagle County in the Roaring Fork Vailey,excluding Redstone.
The purpose of this Council is to satisfy all requirements and obligations for Eagle and Pitkin �,'
regazding the creation and development of an area trauma advisory council and provide for the � .�` � +.
inclusion and participaUon of each County in the Statewide Trnuma System as directed under 25- "�� :".�

2. This multicounty Area Trauma Advisory Council shall represent equitably the � � `
interests of Eagle and Pitkin Counties. �'•;. :.

� 3. The Eagle and Pitkin multicounty Area Trauma Advisory Council shall be known �;�? `A ,
to all interested parties as the "Roaring Fork Valley Area Trauma Advisory Council",or
"ATAC".

4. In accordance with 25-3.5-701,et seq.,C.R.S.and the desires of the participating �'?
counties,the Roaring Fork ATAC membership will be comprised of eleven individuals as �'!�'

One(1) facility administrator =1
• � Two(2) svrgeons invoived in trauma care
�.i One(1) licensed physician involved in providing emergency trauma or medical
. � • services � -
Two(2)licensed nurses
_ One (1) representative from a key resource facility(as defined in the Act)for the
azea
Three(3)pre-hospital care providers
One(1) representative of local government �
5. The Roaring Fork ATAC will convene beginning in June of each year. Prior to
June of each year,the Boazd of County Commissioners for Eagle and Pitkin will make alt
.. � necessary appointrnents to the Council. '

There shall exist a nomination subcommittee comprised of existing members from the
Council which shall obtain input from health caze facilities and providers within the azea served fi �
by the Roaring Fork ATAC,solicit nominations and make a recommendation conceming the �
necessary appointments to the Council as a whole. Prior to April 1 st of each year,after a vote in .�
the�rmative by a majority of inembers at any official business meeting,the Roaring Fork

ATAC shall fonvard a slate of candidates to the Boazd of County Commissioners of each county ,sg `

Notwithstanding the expiration of his or her term,a member shall serve until replaced by the
Counties. - .

7. Meetings of the Roaring Fork ATAC shall be open to the public and a notice of "'� '=
each meeting,including the agendas,will be posted in the County Administration buildings for �-' � �
each of the Counties at least twe�.ity-four(24)hours in advance(minimum one business day`of .� �
the commencement of the meeting. The members of the Council shall determine a regular �=`' �'
frequency of ineeting times as necessary for all work to be accomplished However, the Council
� shall schedule meetings no less than every three months. Official business may not be conducted ' Y ' `�, `
unless a quorum is present. A quorum shall consist of no less than five(5)members. Each has !.-:_.:.>;..�'�
the right to appoint an alternate to attend meeGngs and vote in the member's absence. Only one :�::;`.:
altemate shall be appointed at any one dme. �;•;^: .

8. Annually,the Council shall submit a report to the Board of County t:

�, Commissioners for each participating County. Said report will indicate the accomplishments to
date and will state the goals of the Council for the coming yeaz. This report may or may not be '
similaz to the one that is due to the Colorado Trauma Advisory Council each year. r

9. The Council is d'uected with complying witli all County responsibilities set forth }'��
in the Act,specificaliy with accomplishing the following activities: Y;f

. On or after January 2,1998,but not later than March 31,1998,the Roaring Fork ATAC shall `_i
. submit to the Counties its recommended azea trauma plan for approval by the Counties. The plan �
� shall comply with the requirements of 25-3.5-704(2)(c)C.RS.and such other requirements as ��
may be established by the Colorado Boazd of Health or the Colorado Deparhnent of Public ?
_ Health and Environment. This means that,among other things as may be required,the plan shall
. address the following:
• A. The provision of minimum services and care at the most appropriate
� facili6es in response to the following factors:facility-established triage �':
' and transport plans;interfacility transfer agreements;geographical barrier;
� population density;emergency medical services and trauma caze �
� resources;and accessibility to designated facilities;

`� B. The level of commitment of counries and cities and counties under an azea
� trauma plan to cooperate in the development and implementation of a
� statewide communicarions system and the statewide trauma care system; '
�
C. The methods for ensuring fa�ility and county or city and county adherence ' •
to the azea trauma plan,compliance with Colorado Board of Health rules �
and proccdures,and commitment to the continuing quality improvement
system described in the AM.

10. Bylaws stating all necessary rules and regulations conceming the operation of this -
Council shall be recommended by the Council to the Counties. Bylaws which govem the •
Roaring Fork ATAC must be agproved by each County prior to taking effect ;�

I 1. Any party to this agreement may terminate its participation in this Roaring Fork
� ATAC with or without reason upon thirty days prior written norice 2o the other parties of Uus �. t
agreement and tfie Colorado Trauma Advisory Council located at the Colorado Department of ���
� Public Health and Environment. k

12. Nothing herein contained shall make or be construed to make the Council,Eagle, 3 j
or Pitkin, a partner of any other of the others,nor is this Agreement intended to create a sepazate �=•�
. govemmental entity as the term is defined in Article I,Title 22,C.R.S.

- - 13. This agreement shall be deemed to be made,shall be subject to,and shall be
� � construed in accordance wiih the laws of the State of Colorado.
, 14. Should any one or more pazagraphs or provisions of this Agreement be judicially
� determined invalid or unenforceable,such determination shall not effect,impair,or invalidate the
� temainin rovisions hereof,the intention bein that the various rovisions hereof are severaL

15. In ihe event tivs Council were to be dissolved for any reason,aIl remaining funds
and capita(ized equipment,if any,received for the specific use by the Council shali be retumed �

ta their source.
16. This Agreement embodies the entire agreement about its subject matter among the
; parties and supersedes all prior agreements and understandings,if any,and may be amended or l
supplemented only by an instrument in writing executed by ail parties to this Agreement.
