THIS INTBRGOVERATMENTAL AGR£EMENT,("Agreement")is made this S� day of , 1997, by and between the BOARD OF COUNTY COMMISS E OF P[TKIN COUNTY("Pitkin County")and the BOARD OF COUNTY COMMISSIONERS OF EAGLE COUNTY("£agle County"). _ `r�' RECITALS *'` . NOW THEREFORE, for and in consideration of the mufixal eovenanks and ( �; agreements of the parties and other good and valuable consideration,the adequacy and { s: suf�ciency of which is hereby aeknowledged,the parties agree as follows: . The Pitkin County Road and Bridge Department shall be physically :� • b!, responsible for snow removal and rock and debris removal associated with the snow � sj removal in the Frying Pan Va11ey,which includes the Frying Pan Road and the North I Fork Road,and the Eagle-Thomasville Road Iteimbursement by Eagle County for Pitkin �', County's costs shall be only as pravided in this Agreement. 2. The Eagle/Thomasville Road shall continue to be plowed on a � contractual basis between Pitidn Counry and an independent snow removal � contractor. Pitkin County shall be responsible Far removal of any isolated rock fall ��:�'��'`• occurring on any of the Frying Pan Valley roads. In the event of a large debris problem ��• on the Frying Pan ValIey roads,Eagte County shall assist Pitldn County in the removal effort. ti y , 4. Eagle County will reimburse Pitkin County for man hours and '• '_,; equipment time for snow removal on Ehe 19 milc Eagle County portion of the Frying Pan Road at an hourly rate of$60.89. This rate is calculated by adding the hourly ! �'. wage($22.39)of an equipment operator tu the hourly cost for operation of the tandem plow truck with wing($38.50). Should the equipment operator exceed 40 hours per '-�� {:",`:.. week,the hourly wage will increase fo 533.59(which accounts for time and one hal�, j raising the total hourly cost of snow removal to$72.09. Pitldn County shall invoice -?" � Eagle County on a monthly basis for man hours, eyuipment and materials. Eagle County shall remit payment to Pitlun County within 60 days of receipt of invoice. 5. Eagle County shall reimburse Pifkin County for sanding material used � . on the 19 mile Eagle County portion of the Frying Pan Road. The cosf of sanding ��s-,� - material is approximately$12.00 per ton,and shall be included in the monthly invoice E • j� described in paragraph 4,with the same payment terms applied. t� 6. £agle County shall stage a grader at the Thomasville/Meredith Fire �' ' Station. This grader will be used by Pitkin County in emergency situations or in the � event the Eagle/Thomasville Road requires additional winter maintenance,this would � be determined by Pitkin County. Pitkin County shall be responsible for fueling of the � F grader and for maintenance of the lubricating fluid Ievels in the grader. . , f: �'. 7. This Agreement tnay be ehanged or modified only in writing by an . ,; agreement approved by the respective Boards and signed by the authorizeci Directors of � ;', the Road and Bridge Departments for each County. . t!; ' 8. Should one or more seetions or provisions of this AgreemenE be � ' �f' judieially adjudged invalid or unenforeeable,such judgmenY shall not affect,impair or - invalidate the remaining provisions of this Agreement, the intention being that the ' t' various seetions and provisions hereof are severable. 9. This Intergovernmental Agreement shall be in effect for one year from . ��: the date of execution. The Counfies reserve the right to cancel this Agreement for �. - y unsatisfac.ory performance or lack of services by either �arty, or for unuvailability of budgeted funds for the semces,as determined by the County Manager.
